PROMOTION TERMS AND CONDITIONS
1. The terms and conditions apply to the “top sporting moment of all time” promotion (“the Promotion”) entered via ESPN.com.au (the Website”) commencing on Tuesday 20th December 2011 at 12:00 (AEST) and concluding on Wednesday 25th January 2012 at 23:59 (AEST) (the “Promotion Period”).
2. The promoter of the competitions is ESPN Inc, a Delaware company with its registered offices at ESPN Plaza, Bristol, CT, USA (the “Promoter”).
3. The Promotion is open to all Australian residents aged 18 years or over at the date of entry who enter during the Promotion Period, excluding employees of the Promoter, any of the Promoter’s related companies, The Walt Disney Company, employees families, agents and anyone involved in the administration of the Promotion. The eligibility of any entrant is at the sole discretion of the Promoter. By entering the Promotion entrants hereby warrant that all information submitted by them is true, accurate and complete.
4. No purchase or proof or purchase is necessary to enter the Promotions and only one entry form per entrant is permitted. Anyone who enters more than once will be excluded from the Promotion.
5. All entries must include all details requested on the Website for the Promotion and be submitted in accordance with these terms and conditions any other terms of entry detailed on the Website. Each correct and eligible entry received during the Promotion Period will be considered by the judges. The Promoter does not accept responsibility for network, computer hardware or software failures of any kind, which may restrict or delay the sending or receipt of an entry. The Promoter accepts no responsibility or liability for any lost, damaged or incomplete entries and all such entries will be deemed invalid. Proof of submission of a form will not constitute proof of entry.
6. The Promotion prize is a 50-inch LG HD television valued at AUD $800 and an ESPN “30 for 30” DVD box set valued at AUD $125 (the “Prize”).
7. There will be one winner (the “Winner”) determined by the judges from the correct and eligible entries received via the Website. The Winner will be the entrant who, in the sole opinion of the judges, has submitted the most creative and original entry. The Winner will be determined by the Promoter within 48 hours of the conclusion of the Promotion Period.
8. The Promotion is a game of skill. Chance plays no part in determining the Winner.
9. The Promoter's decision is final and binding on all entrants. No correspondence will be entered into and no entries can be returned. Entries that do not comply in full with these entry rules and conditions will be disqualified.
10. The Winner shall be notified by telephone or email within 7 days of the judge’s decision and announced on the Website and the ESPN Australia/ New Zealand Facebook page. The Winner must claim the Prize within 14 days of notification. Failure to respond to a prize notification within this time period will result in disqualification and an alternative winner may be selected from the eligible entries received at the Promoter’s discretion. If winners are not able, for whatever reason, to accept the Prize, the Promoter reserves the right in its discretion to award the Prize to another participant. The Promoter will not be liable if the Prize cannot be taken by a winner for any reason beyond the control of the Promoter. Before the Prize is awarded, the Winner may be required to sign a statement of eligibility and liability/publicity release.
11. No alternative prize will be awarded and there are no cash alternatives to the Prize. If for any reason it is not possible to provide the Prize, the Promoter reserves the right to substitute the Prize for a prize of equivalent or greater monetary value. The terms and conditions of any third party supplier may apply to the Prize as indicated.
12. The Promoter's privacy policy (which is available on the Website) shall apply to all entries to the Promotion. All entrants may be sent the Promoter's newsletter from which they may unsubscribe at any time.
13. The Promoter accepts no responsibility for resultant loss or damage (other than death or personal injury caused by the negligence of the Promoter or their agents) as a result of entering the Promotion or any prize awarded.
14. By entering the Promotion participants hereby assign all copyright which they may own in their entries to the Promoter and participants acknowledge that the Promoter will own all copyright in their entries.
15. The Winner may be required to participate in publicity surrounding a promotion and consents to his/her name, location and photograph being published for the purposes of promoting the Promoter and its business.
16. By participating in the Promotion the participant will be deemed to have read and understood these terms and conditions and will be bound by them. The Promoter may, in its sole discretion, change the dates of entry into a Promotion and the Promoter reserves the right to alter or withdraw the Promotion or these terms and conditions at any stage if deemed necessary in its sole opinion or if circumstances arise outside its control.
17. These terms and conditions are governed by and construed in accordance with the laws of New South Wales, Australia, whose courts shall be the courts of exclusive jurisdiction.
