2.Prizes2.1 There will be: (a) One (1) major prize awarded (to the major prize winner, as below);
(b) Three (3) runners-up prizes awarded (one to each of the three (3) runners-up); and
(c) One hundred (100) consolation prizes (awarded to the next one hundred (100) best entries, as outlined below).

2.2 The Major Prize consists of: One (1) x $1,000 Westfield Gift Card from Westfield, redeemable in VIC, NSW, ACT, QLD, WA or SA. In the event that the winner is from TAS or NT, the winner will receive a Gift Card from Eastlands Shopping Centre, Hobart Tasmania; or Casurina Square, Casurina Northern Territory; and
One (1) x session with a personal stylist for up to four (4) hours (valued at $500) (“Stylist Session”). The Stylist Session will occur on a date to be arranged between the Promoter and the winner of the Major Prize, at a location to be agreed, and will include style and fashion tips for the winner. In the event that the Promoter and the Major Prize winner cannot come to agreement on date and location, the Promoter shall determine the date and location of the Stylist Session in its absolute discretion, acting reasonably.

Any ancillary costs (including travel) associated with redeeming the Gift Card are not included. Any unused balance of the Gift Card will not be awarded as cash. Redemption of the Gift Card is subject to any terms and conditions of the issuer including those specified on the Gift Card.
 The prize does not include any travel, accommodation, or expenses.

The total value of the major prize is $1500.

2.3 The runners-up prize (three (3) to be awarded) is: • 1 x Sunbeam Mixmaster Series 2 (MX7700) mixer (valued at $199.00).

The total value of the three runners-up prizes is $597.00.

2.4 The consolation prize (one hundred (100) to be awarded) is: • One (1) Betty Crocker Whoopie Pie Pack (375g - 400g)(valued at $5.19).

The total value of the consolation prize pool is $519.00.

The total value of the entire prize pool is valued at $2,616.

2.5 The judges' decision is final and no correspondence will be entered into.
2.6 All prize items are valued inclusive of GST and the Promoter takes no responsibility for any variations in item values. The prizes are not transferable, exchangeable or redeemable for cash. In the event that any prize item is unavailable, the Promoter reserves the right to substitute a prize item of equal or greater value. Any taxes (other than GST, if any) which may be payable as a consequence of a winner receiving the prize are the sole responsibility of the winner.
2.7 To the extent permitted by law, the Promoter makes no representations or warranties as to the quality/suitability/merchantability of any of the goods/services offered as prizes; and accepts no responsibility for loss or damage to prizes in transit.

3.Who may enter
The only persons who may enter and be awarded prizes are residents of the place specified in Condition 1.1, who have attained the age specified in Condition 1.2 (if an age is specified in that condition), who are not (i) employees of, or contractors to, the Promoter or any of its agencies involved with this competition, or (ii) members of the immediate family of such employees and contractors.

"Immediate family" means spouse, de facto spouse, parent, natural or adopted child, and sibling (whether natural or adopted by a parent), whether or not they live in the same household as the employee/contractor.

"Promoter" means General Mills Australia Pty Limited ABN 71 007 663 041

4.Entrants bound by conditions
By participating, entrants agree to be bound by these conditions.

5.How to enter
To be eligible to enter, individuals must have purchased a Betty Crocker Whoopie Pie mixture, and must have retained the purchase receipt as proof of purchase.

To enter, during the Promotional Period entrants must:
(a) Read and accept these terms and conditions
(b) Log onto [http://www.bettycrockerwhoopiepies.com.au] follow the prompts to the registration page and register their details (full name, residential address, daytime telephone number and valid email address, among other things); and
(c) Upload a photograph of a customised Betty Crocker Whoopie Pie, using the original Betty Crocker Whoopie Pie mixture available at participating stockists.


6.Selection of winners6.1 The selection of the winner, runners-up and consolation prizes of the Betty Crocker Whoopie Pies competition will be judged by The Promoter.
6.2 At the time and date specified in Conditions 1.7 and 1.8, the judge will choose: (a) one (1) major prize winner;
(b) three (3) runners-up; and
(c) one hundred (100) consolation entries together, ("the Winners").

The Winners will be the entrants who have been judged to have entered the most creative and/or original submission in line with Condition 5(c)above. Subject to verification, the entrant with the best submission will win the Major Prize, the entrants with the next three best submissions will each win the runners up prize, and the entrants with the next one hundred best submissions will each win the consolation prize.

Each entry will be individually judged based on the merits of their submissions according to clause 6.1 above. Chance plays no part in determining the winners.

6.3 The judges may select additional reserve entries which they determine to be the next best, and record them in order, in case of an invalid entry or ineligible entrant.
6.4 The Promoter reserves the right to disqualify any entrant submitting an entry which infringes a third party’s intellectual property rights, or in the opinion of the Promoter, includes objectionable content, including but not limited to profanity, nudity, potentially insulting, scandalous, inflammatory or defamatory images or language.
6.5 Incomplete or indecipherable entries will be deemed invalid.


7.Special conditions of entry7.1 All entries must be: a. the original independent creation of the entrant;
b. owned by the entrant; and
c. free of any claims, including copyright or trademark claims by other parties.

7.2 Entrants consent to any use of their entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).
7.3 Entries must not: a. have been published previously;
b. have won prizes or awards in other competitions;
c. be restricted in any way;
d. reference any third parties or third party brands; or
e. infringe any third party rights.

7.4 It is a condition of the awarding of each prize that the winner must, if requested to do so by the Promoter (acting reasonably), sign and return any Affirmation of Eligibility to Enter, Ownership of Entry, and Release and Compliance statements provided to the winner by the Promoter. The failure to return the signed statements will result in the entitlement to the prize being forfeited and the selection of another winner.
7.5 The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.



8.Limitations on entry8.1 There is no limit to the number of entries per person, subject to the following: (a) each entry must be substantially unique; and
(b) each entry must be submitted separately and in accordance with entry requirements.


9.Duration
This competition starts at the Sydney time and date specified in Conditions 1.3 and 1.4. Entries must be received by the Sydney time and date specified in Conditions 1.5 and 1.6.

10.No quality, etc, representations/exclusion of liability
To the extent permitted by law, the Promoter:
10.1 makes no representations or warranties as to the quality/suitability/merchantability of any of the goods/services offered as prizes;
10.2 accepts no responsibility for loss or damage to prizes in transit;
10.3 accepts no responsibility for late, lost or misdirected registrations; and;
10.4 is not liable, to the extent permitted by law, for any loss suffered or sustained, to person or property and including, but not limited to, consequential (including economic) loss by reason of any act or omission, deliberate or negligent, by the Promoter, or its servants or agents, in connection with the arrangement for supply, or the supply, of any goods or services by any person to the prize winner and, where applicable, to any family/persons accompanying the winner.
10.5 Condition 10 does not affect, and is not intended to affect, any rights a consumer might have, which are not able to be excluded under applicable Australian consumer protection laws. To the fullest extent permitted by law, any liability of the Promoter or its servant or agents for breach of any such rights is limited to the payment of the cost of having the prize supplied again.

11.Conditions of Accepting the Major Prize11.1 It is a condition of the awarding the Major Prize that the Major prize winner must, if requested to do so by the Promoter, provide a receipt evidencing proof of purchase of the Betty Crocker Whoopie Pie mixture used in its photo entry. In the event that the Major Prize Winner cannot produce this receipt, the Promoter reserves the right to disqualify the Major Prize Winner from the Promotion and select a new Major Prize Winner.
11.2 The Major Prize Winner agrees to be photographed during their redemption of the Major Prize at a Westfield shopping centre on the date nominated by them and consents to the photographs being used by General Mills Australia Pty Limited for promotional purposes only. Any rights in respect of any such photographs will be owned by the Promoter immediately upon creation.
11.3 The Major Prize must be redeemed by the Major Prize winner within three (3) months of the Major Prize Winner being notified they have won the major prize. In the event the major prize is unclaimed, the winner is not responsive or the prize is not awarded for any reason, an alternative winner will be selected from the three runners up winners.

12.Winner notification and publication
The winners will be notified by telephone and/or email, using the details provided in their entry.

13.Use of Headings
Headings and subheadings in these Terms and Conditions are inserted for convenience only and shall not be used to interpret the text of these conditions in any way adverse to an interpretation in favour of the Promoter.

14.Ownership of entries and Privacy14.1 All entries (including the photo submissions) become and remain the property of the Promoter.
14.2 All opt-ins become and remain the property of the promoter
14.3 The Promoter reserves the right to use the content of winning and runners-up entries for the purpose of future promotions or promotional advertising.
14.4 The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers and prize suppliers. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.

15.Internet15.1 Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
15.2 If for any reason this competition is not capable of running as planned, including but not exclusively infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the competition.
15.3 The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of, entries.
15.4 The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email or entry to be received by the Promoter on account of technical problems or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this competition.
15.5 CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR THE INFORMATION ON A WEBSITE, OR TO OTHERWISE UNDERMINE THE LEGITIMATE OPERATION OF THIS COMPETITION, MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, WHETHER SUCCESSFUL OR NOT, THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW.

16.LIABILITY, INDEMNITY AND RELEASE16.1 Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
16.2 Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) taking of any the prize or attendance at any prize event.
16.3 The entrant indemnifies and holds harmless the Promoter to the extent permitted by law in respect of any claim by any person (including but not limited to other entrants in the promotion), arising as a result of or in connection with the entrant’s participation in the promotion.
16.4 In this Condition 16, “all claims” means and includes any action, suit, proceeding, claim, demand, damage, penalty, cost or expense however arising.

        7.4 It is a condition of the awarding of each prize that the winner must, if requested to do so by the Promoter (acting reasonably), sign and return any Affirmation of Eligibility to Enter, Ownership of Entry, and Release and Compliance statements provided to the winner by the Promoter. The failure to return the signed statements will result in the entitlement to the prize being forfeited and the selection of another winner.
        7.5 The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
    Limitations on entry
        8.1 There is no limit to the number of entries per person, subject to the following:
            (a) each entry must be substantially unique; and
            (b) each entry must be submitted separately and in accordance with entry requirements.
    Duration

    This competition starts at the Sydney time and date specified in Conditions 1.3 and 1.4. Entries must be received by the Sydney time and date specified in Conditions 1.5 and 1.6.
    No quality, etc, representations/exclusion of liability

    To the extent permitted by law, the Promoter:
        10.1 makes no representations or warranties as to the quality/suitability/merchantability of any of the goods/services offered as prizes;
        10.2 accepts no responsibility for loss or damage to prizes in transit;
        10.3 accepts no responsibility for late, lost or misdirected registrations; and;
        10.4 is not liable, to the extent permitted by law, for any loss suffered or sustained, to person or property and including, but not limited to, consequential (including economic) loss by reason of any act or omission, deliberate or negligent, by the Promoter, or its servants or agents, in connection with the arrangement for supply, or the supply, of any goods or services by any person to the prize winner and, where applicable, to any family/persons accompanying the winner.
        10.5 Condition 10 does not affect, and is not intended to affect, any rights a consumer might have, which are not able to be excluded under applicable Australian consumer protection laws. To the fullest extent permitted by law, any liability of the Promoter or its servant or agents for breach of any such rights is limited to the payment of the cost of having the prize supplied again.
    Conditions of Accepting the Major Prize
        11.1 It is a condition of the awarding the Major Prize that the Major prize winner must, if requested to do so by the Promoter, provide a receipt evidencing proof of purchase of the Betty Crocker Whoopie Pie mixture used in its photo entry. In the event that the Major Prize Winner cannot produce this receipt, the Promoter reserves the right to disqualify the Major Prize Winner from the Promotion and select a new Major Prize Winner.
        11.2 The Major Prize Winner agrees to be photographed during their redemption of the Major Prize at a Westfield shopping centre on the date nominated by them and consents to the photographs being used by General Mills Australia Pty Limited for promotional purposes only. Any rights in respect of any such photographs will be owned by the Promoter immediately upon creation.
        11.3 The Major Prize must be redeemed by the Major Prize winner within three (3) months of the Major Prize Winner being notified they have won the major prize. In the event the major prize is unclaimed, the winner is not responsive or the prize is not awarded for any reason, an alternative winner will be selected from the three runners up winners.
    Winner notification and publication

    The winners will be notified by telephone and/or email, using the details provided in their entry.
    Use of Headings

    Headings and subheadings in these Terms and Conditions are inserted for convenience only and shall not be used to interpret the text of these conditions in any way adverse to an interpretation in favour of the Promoter.
    Ownership of entries and Privacy
        14.1 All entries (including the photo submissions) become and remain the property of the Promoter.
        14.2 All opt-ins become and remain the property of the promoter
        14.3 The Promoter reserves the right to use the content of winning and runners-up entries for the purpose of future promotions or promotional advertising.
        14.4 The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers and prize suppliers. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
    Internet
        15.1 Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
        15.2 If for any reason this competition is not capable of running as planned, including but not exclusively infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the competition.
        15.3 The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of, entries.
        15.4 The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email or entry to be received by the Promoter on account of technical problems or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this competition.
        15.5 CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR THE INFORMATION ON A WEBSITE, OR TO OTHERWISE UNDERMINE THE LEGITIMATE OPERATION OF THIS COMPETITION, MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, WHETHER SUCCESSFUL OR NOT, THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW.
    LIABILITY, INDEMNITY AND RELEASE
        16.1 Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
        16.2 Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) taking of any the prize or attendance at any prize event.
        16.3 The entrant indemnifies and holds harmless the Promoter to the extent permitted by law in respect of any claim by any person (including but not limited to other entrants in the promotion), arising as a result of or in connection with the entrant’s participation in the promotion.
        16.4 In this Condition 16, “all claims” means and includes any action, suit, proceeding, claim, demand, damage, penalty, cost or expense however arising.
