1. Terms and conditions of entry

All entries are via the website

Participants must be prepared to
travel on set dates and stay in the Kimberley from 5th July to 13th July, 2012.
By entering this competition, participants authorise to be subscribed to the Promoter’s online and offline database.
Participants may enter as many times as they like. No scripting is allowed for on-line entries (which will be deemed invalid).
Entries will close at 11.59pm WST on Sunday 27th May 2012.
The competition will be promoted via online display unit advertising.
2. Promotion dates
The promotion commences on Monday 30th April 2012 at 10.00am AEST and concludes on Sunday 27th May 2012 at 11.59pm AEST (The promotional period).
Entries received 30th April 2012 – 27th May 2012.
The winner will be drawn and announced on
www.australiasnorthwest.com and winner notified by phone and email within 48 hours of the prize being drawn.
By entering the Promotion, entrants consent to their personal information being collected and used by the Promoter for any promotional activities, including the winner’s personal participation in reasonable promotional activities as requested by the Promoter, and any future marketing and publicity purposes without any further reference, payment or other compensation.
The competition start time and finish time may fluctuate due to unforeseen web upload and download times. Although the

3. Prizes & Prize Winner Selection
Winner and companion must be prepared to travel on set dates and be in the Kimberley from the 5th of July to the 13th July 2012.
The 1st valid entry drawn by the promoter will be deemed the prize winner and will win the following prize package for 2 people valued at $9,000 including, but not limited to:

The winner (and their companions) are responsible for all other expenses including spending money, meals (unless specified in the itinerary), drinks, transfers (unless specified in the itinerary), laundry charges, activities (unless specified in the itinerary), incidentals, energy surcharges, gratuities, services charges, passports, visas, travel insurance and all other ancillary costs. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances.
Transport to and from departure point including but not limited to additional domestic airfares if required, any additional meals, any extra sightseeing or activities, any additional accommodation, personal spending money, and all other ancillary costs, as well as obtaining any of these, are the responsibility of the winner and their travel companions. The prize package also excludes medical expenses, items of a personal nature, beverages, optional
Tours not outlined, laundry, telephone calls, additional nights, room upgrades or other ancillary costs associated with redeeming the prize other than those specified. These costs and expenses are the responsibility of the winner. Any extension to the duration of the prize is at the winner’s sole expense and subject to availability at the time of booking. For the removal of doubt, taxes for domestic travel are included in the prize winning domestic airfares provided by the promoter.
Unless expressly stated in these terms and conditions all other expenses (including travel to and from the departure point) become the responsibility of the winner.
The flights associated with the prize must be utilized at the same time, for the same travel dates, to the same destination.
It is a condition of accepting the prize that the winner may be requested to present their credit card upon arrival at any hotel to cover all incidentals they may incur including their stay at that hotel.
If the prize or portion of the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State Regulation.
The Promoter is neither responsible nor liable for any loss or damage suffered in the event that there are any changes to the prize travel itinerary.
As a condition of accepting the prize, the winner (and their companions) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
By accepting this prize the winner will be required to take part in further promotional activities. The winner must agree to write a blog for the duration of their trip which will be posted daily.
Winners are selected using a random draw by an independent person.
The draw will take place on Monday 28th May 2012 at 2.00pm AEST at the offices of Australia’s North West Tourism, 10 Frederick Street, Broome, WA, 6725.

4.Entry
The promotion is
open to all residents of Australia who are 18 years and older.6. Promoter’s Decision
The Promoter’s decision is final and no correspondence will be entered into. The prize package is non-transferrable, non-refundable and non-negotiable and cannot be redeemed as cash.
7. Unclaimed Prizes
If the winner is unavailable to travel from 5th July to 13th July 2012, then the winner would forfeit the prize. In the event that the winner is unable to redeem any component of the prize by the prize fulfilment date stipulated by the Promoter, then the prize will be forfeited by the winner and neither cash nor another prize will be awarded in lieu of the forfeited component(s) of the prize.
In the event that the winner forfeits the entire prize, or provides contact information that is invalid, or is unable to be contacted for any other reason, a re-draw will occur. The re-draw prize selection process will take place on Thursday, 31th May 2012 at 2.00pm AEST at the offices of Australia’s North West Tourism, 10 Frederick Street, Broome, WA, 6725. The winner will notified immediately by phone and email.
The re-drawn winners name will be printed in the Australian on Saturday 2nd June 2012
8. Entry restrictions
Employees of the Promoter and their immediate families together with agencies and/or companies associated with this promotion are ineligible to enter. Immediate family refers to spouse, defacto spouse, parent, natural or adopted child, and sibling (whether natural or adopted by a parent). Entries that are deemed to be inaudible, incomprehensible, unable to be viewed, or deemed to be offensive or illegal by the Promoter will also be ineligible. Entries not completed in accordance with the Conditions of Entry, or received after close of entry, will not be considered. Incomplete or inaudible entries will be disregarded.
9. Promoter’s Liability
The Promoter shall not be liable for any loss or damage whatsoever (including but not limited to direct or consequential loss) or personal injury suffered or sustained by the prizes or in connection with any other prizes. The Promoter makes no representations or warrantees as to the quality/suitability/merchantability of any of the goods/services offered as prizes. To the extent permitted by law, the Promoter associated agencies and its contractors are not liable for any loss suffered or sustained, to person or property and including, but not limited to, consequential (including economic) loss by reason of any act or omission, deliberate or negligent, by the Promoter, or its contractors, servants or agents, in connection with the arrangement for supply, or the supply, of any goods or services by any person to the prize winner and, where applicable, to any family/persons accompanying the winner. The Promoter does not now, nor will ever sell or rent any personal information that you share with Australia’s North West and affiliate sponsors or partners. The Promoter may also use the information that you provide to send updates, news, and other information regarding Australia’s North West.
10.Communication Failure
The Promoter and their associated agencies and companies will take no responsibility for email transmission issues which may delay notification to prize winners.
11. External Intervention Limit
In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war or act of terrorism, the Promoter may, in its absolute discretion, cancel the competition and recommence it from the start on the same conditions. Should these circumstances effect the Promoter being able to proceed with the competition, the relevant state legislative authorities will be consulted in advance. No changes to the terms and conditions will be made without first consulting the relevant regulatory authorities.
12. Promoter’s Fesponsibilities
The Promoters and their associated agencies assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.
13. Promoter’s Fights
If, for any reason, this competition is not capable of running as planned, due to causes including but not limited to tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition. Should the Promoter be unable to proceed with the competition, the relevant state legislative authorities will be consulted in advance. No changes to the terms and conditions will be made without first consulting the relevant regulatory authorities.
14. Promoter’s Liability
The Promoter and their associated agencies, companies and contractors will not be liable for any misadventure, accident, injury, loss or claim that may occur:
during the draw;
whilst undertaking any travel won on or connected with their entry into the draw; or in the participation in any prize; as a consequence of late, lost or misdirected email;
due to the broadcast of any program relating to the competition or the publication of any material, including any statements made by any compere, staff member, journalist, other entrants or any other person;
in relation to failure of an email entry message to be received by the Promoter on account of technical problems or traffic congestion;
Arising from or related to any problem or technical malfunction of any telephone network or lines or mobile communications network related to or resulting from participation in this promotion.
