1. Instructions on how to enter and prizes form part of these Conditions of Entry. Participation in this promotion is deemed acceptance of these Conditions of Entry. 2. Entry is only open to Australian residents who are 18 years and over who are able to travel on 27 July 2012 to 29 July 2012. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. 3. Promotion commences 00:01 AEST 2 July, 2012 and closes midnight AEST on 8 July, 2012. The judging will take place at Promoter’s premises, 54 Park Street, Sydney NSW 2000 on 9 July, 2012. The judging will be done by a panel of judges appointed by the promoter. The winners will be notified by phone or mail using contact details provided in their entry. 4. To enter, individuals must go to www.nwonline.com.au and follow the prompts on the promotion entry page and input the requested details including their full name, address, telephone number, date of birth, current email address and answer to the competition question in 25 words or less ‘if you could have one celebrity in your Splendour entourage, who would it be – and why?’ and then submit the fully completed form as instructed. 5. Limit one (1) entry permitted per person. 6. This is a game of skill, chance plays no part in determining the winner. Each entry will be individually judged based on its literary and creative merit of the answer to the question provided. The judges’ decision in relation to any aspect of the competition will be final and binding on every person who enters. No correspondence will be entered into. 7. The Entrant warrants to the Promoter that the entry submitted is an original artistic work of the Entrant that does not infringe the rights of any third parties. If the entry or any part of the information provided to the Entrant in relation to the entry was provided by a third party, the Entrant warrants that they have obtained the relevant copyright permission to submit the entry for the purposes of this promotion. The entrant agrees to indemnify the promoter against all claims and costs by third parties arising from a breach of the warranty set out in this condition. 8. The Promoter is entitled to use any of the entries submitted in any manner and for any purpose at its absolute discretion, including using the entries for future promoter’s or their agents book publications, promotional, marketing and publicity purposes without any further reference or payment or other compensation to the entrant. The best (1) valid entry, as determined by the judges, will be deemed the winner and will receive: • Two tickets to Splendour in the Grass three day festival valued at $700 including Virgin Mobile customer benefits including access to the Posh Pits, Fast Lane and other customer-only activations taking place at the festival • Return economy flights for two people from the winner’s nearest capital city to Ballina/Gold Coast valued at up to $1,000 (depending on point of departure) • Private transfers to/from the airport to Byron bay valued at $300 • Four nights’ accommodation for two in a one bedroom suite at BreakFree Eco Beach, Byron Bay valued at up to $1,500 The total prize pool for the promotional period is valued at up to AU$3,500 (incl. GST) (depending on point of departure) 12. The prize must be taken to coincide with the Splendour in the Grass festival on 27 July, 28 July and 29 July, 2012. Flight times and accommodation are subject to availability. The prize cannot be changed once the bookings have been confirmed. 13. The Promoter is neither responsible nor liable for any loss or damage suffered in the event that the Splendour in the Grass Festival 2012 is postponed, cancelled, rescheduled or relocated for any reason whatsoever. 14. The winner (and their companion) are responsible for all other expenses including spending money, meals (unless specified), drinks, transfers (unless specified), laundry charges, activities (unless specified), incidentals, energy surcharges, gratuities, services charges, passports, visas, travel insurance and all other ancillary costs. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances. 15. Unless expressly stated in these terms and conditions all other expenses including but not limited to travel to and from the Splendour in the Grass Festival, travel to and from the departure point from the winner’s place of residence and all other travel costs. These costs become the responsibility of the winner. 16. The Two (2) flights must be utilized at the same time, for the same travel dates, to the same destination. 17. The winner may extend their stay on the trip at the winner’s expense. 18. Transport to and from Departure point including but not limited to additional Domestic airfares if required, any additional meals, any extra sightseeing or activities, any additional accommodation, personal spending money, and all other ancillary costs, as well as obtaining any of these, are the responsibility of the winner and their travel companions. Prize also excludes medical expenses, items of a personal nature, beverages, optional tours not outlined, laundry, telephone calls, additional nights, room upgrades or other ancillary costs associated with redeeming the prize other than those specified. These costs and expenses are the responsibility of the winner. Any extension to the duration of the prize is at the winner’s sole expense and subject to availability at the time of booking. For the removal of doubt, taxes for domestic travel are included in the prize winning domestic airfares provided by the Promoter. 19. All prize items are valued inclusive of GST and the Promoter takes no responsibility for any variations in item values. The components of the Prize may alter for reasons beyond the Promoter’s control. The Prize is not, nor any component thereof, transferable, exchangeable or redeemable for cash. No components of the Prize can be exchanged for other travel or accommodation at other destinations. In the event that any prize item is unavailable, the Promoter reserves the right to substitute a prize item of equal or greater value. Any taxes (other than GST, if any) which may be payable as a consequence of a winner receiving the prize are the sole responsibility of the Winner. 20. It is a condition of accepting the prize that the winner (and any traveling companions) must comply with all the conditions of use of the prize and prize supplier’s requirements 21. It is a condition of accepting the prize that the winner may be requested to present their credit card upon arrival at any hotel to cover all incidentals they may incur including their stay at that hotel. 22. Prize must be taken as offered. The prize, or any unused portion of the prize, is not exchangeable or cannot be redeemed as cash. The prize cannot be used in conjunction with any other special offer. The prize is valued in Australian dollars. The Promoter accepts no responsibility for any variation in the prize value. Prize winner is advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize. In the event that a portion of the prize is awarded to the winner in the form of a voucher / ticket / pass/ letter, redemption of that portion of the prize will be subject to the terms and conditions stipulated on the voucher / ticket / pass/ letter. The Promoter will not be liable for any voucher / ticket / pass/ letter that has been lost, stolen, forged, damaged or tampered with in any way. If a medical circumstance in some way restricts your ability to enter the competition through the required mechanic, you are still eligible to enter however you must briefly state your circumstances upon entry. 26. If your entry is selected as a winning entry, validation of your circumstances/ the validity of your entry will be undertaken by the Promoter. Method of validation (without limitation) will be determined by the Promoter in its complete discretion.
