BLUE’S NIREY KNIFE SHARPENER COMPETITION – ISSUE #275
TERMS AND CONDITIONS1.Information on how to enter and prize forms part of the terms and Conditions of Entry. Participating in this promotion is deemed acceptance of these Conditions of Entry.
2.The Promoter reserves the right, at anytime during or after the closing date of the promotion, to verify the validity of entries and to disqualify any entrant who tampers with the entry process or who submits an entry that is not in accordance with these Conditions of Entry. Errors and omissions may be accepted at the Promoter's discretion. Failure of the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

Entry is only open to residents of Australia over 18 years of age, except employees (and their immediate families) of the Promoter, companies and agencies associated with this promotion are ineligible to enter.
4.To enter, entrants must go online to wwwbluescountry.com.au and fill out the entry form containing your full name, contact number, full address including postcode, email address and tell us in 25 words or less “What’s your favourite section of Blue’s and why?”
5.Incomplete, indecipherable entries will be deemed invalid.

Only one (1) entry per person is permitted. Entrants using multiple aliases or email addresses will be disqualified at the discretion of the Promoter.
7.All entries become the property of the Promoter and will not be returned. Incomplete, illegible and invalid entries will not be included in the judging. The promoter is entitled to use any of the entries submitted for any purposes at its discretion, including for any future promotion, marketing and publicity purposes.

and promotion closes 11.59pm AEST July 6th , 2012. 9.The judging will take place at the promoter’s premises Suite 6, Level 2, 12 Browning Street, West End, Queensland on July 7th 2012 at 9 am AEST. The winner will be published in the #277 issue of Blue’s Country magazine onsale August 1st 2012
10.This is a game of skill and chance plays no part in determining the winner. Each entry will be individually judged based on literary and creative merit of the answer provided to the question.
11.The Promoter’s decision is final and no correspondence will be entered into.
12.The best 4 (four) valid entries, as determined by the judges, will be deemed the winners and will receive a Nirey Model 198 Electric Knife Sharpener.
13.Every valid entry will also receive a 3 (three) issue trial subscription to Blues Magazine. Starting with the first available issue after the drawing. Valid for new subscribers only.

Total prize value is $596 AUD.15.In acceptance of the prize, the winner acknowledges that they may incur ongoing costs associated with the prize which are the entire responsibility of the winner.
16.If the prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification.
17.The prize is not exchangeable and cannot be taken as cash. The Promoter takes not responsibility for any variation in the prize value.
18.Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
19.If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
20.The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or website user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, technical problems or traffic congestion on the Internet or website, software failure, theft or destruction or unauthorised access to or alteration of entries and any injury or damage to participants or any other person’s computer related to or resulting from participation in or down-loading any materials in this competition.
21.Nothing in these Conditions of Entry limits, excludes or modifies or purports to limit, exclude or modify the statutory implied guarantees/warranties as provided under the Trade Practices Act, ASIC Act, or the Competition and Consumer Act including the statutory consumer guarantees under the Australian Consumer Law or similar laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
22.The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) of for personal injury which is suffered or sustained, as a result of using the prize, except for any liability which cannot be excluded by law, including the Non-Excludable Guarantees. It is a condition of accepting the prize that the winner must sign a legal release (if required by the Promoter), in a form determined by the Promoter in its absolute discretion.
23.The Promoter may conduct such further draws at the same place as the original draw as are necessary on August 8th, 2012 in order to distribute the prize if unclaimed by that date subject however to reference to all relevant state and territory regulations and any written directions given under Reg 37 of the Lottery and Gaming Regulations 1993 (SA). In the event of a winner in the unclaimed prize draw, the winner will be published in the July #278 issue of Blue’s Country magazine.
24.The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter.
