Stop Before You Shop Promotion
1.This competition (the "Promotion") is conducted by Jamaica Blue Pty Ltd, ACN 059 236 387 of 424 New South Head Road, Double Bay, NSW 2028, Australia (the "Promoter").
2.The promotion will be administered by Slingshot Digital Ventures Pty Ltd, (ACN 150 786 164) of Level 13, 338 Pitt St, Sydney, NSW 2000, Australia.
3.Entry to the Stop Before You Shop Promotion shall be deemed acceptance of these terms and conditions. All entry instructions and prize information published by the Promoter form part of these Terms and Conditions.
4.Entry is open to all Australian residents over the age of 13 except employees and immediate families of Slingshot Digital Ventures, the Promoter and any related entities.

The promotion runs from 10.00hrs (EST) 16 July 2012 to 10.00hrs (EST) 6 August 2012 ("Promotional Period").
6.No entries received later than 10.00hrs (EST) 6 August 2012 will be accepted.
7.Employees and immediate families of the Promoter and their associated companies and agents and the immediate families of such employees are not eligible to enter the competition.
Entry into the Promotion

There are two (2) methods of entry into the Promotion.
9.Entrants may enter the Promotion through Facebook. To enter the Promotion through Facebook entrants must:
a)Be a user of the Facebook platform.
b)Become a fan of the Jamaica Blue Timeline (http://www.facebook.com/JamaicaBlueCafes).
c)Fill out the required form in full. 10.
Entrants may enter the Promotion through the Shop Before You Shop website (www.sbys.com.au). To enter the Promotion through the Shop Before You Shop website entrants must:
a)Visit the Shop Before You Shop website (www.sbys.com.au).
b)Fill out the required form in full. 11.Entries in each Prize Pool must not be, without limitation:
i)Late;
ii)Delayed;
iii)Incomplete;
iv)Incomprehensible;
v)Obscene;
vi)Defamatory;
vii)Libellous;
viii)Threatening;
ix)Pornographic;
x)Harassing;
xi)Hateful;
xii)Racially or ethnically offensive;
xiii)Capable of encouraging conduct that would be considered a criminal offence;
xiv)Capable of violating any law; and/or
xv)Capable of giving rise to civil liability.
12.The Promoter may disqualify any individual who the Promoter has reason to believe has breached any of these Conditions, or engaged in any unlawful or other improper misconduct which places the fair and proper conduct of the competition at risk.
13.The Promoter is not responsible for any technical malfunction of any communications network or any lost, late, delayed, ineligible, incomplete or corrupted entries, however this may happen.
14.If you are under the age of 18 you must obtain the prior permission of your parent or guardian to enter.
Details of Determining Winners
15.This is a game of chance.
16.
21 entrants will receive prizes.
17.There is a limit of one (1) entry per mobile phone number. 18.Upon entering the Promotion and filling out the required form entrants will be sent a SMS with a code.
19.In each Jamaica Blue cafe in Australia (see locations here:
http://www.jamaicablue.com.au/default.asp?PageID=68&plugletInstanceId=5&mapId=18) there will be a poster displaying each prize from the Prize Pool with a corresponding sequence of numbers (the "code") for each prize.
20.If the entrant's code is identical to one of the codes on the poster they are eligible to claim the specific prize attached to that code.

To verify the code the entrant must email the following details to info@jamaicabluecompetitions.com.au
a.Full name
b.The telephone number of the mobile with which they received the code.
c.The code they received upon entry. 22.The Promoter will then verify that the entrant was issued this specific code upon entry and that it corresponds to the prize in question.
23.The Prize is only available upon successful verification by the Promoter.
24. Until verification there has been no prize awarded and no obligation to provide a prize to the entrant exists.
25.There is one (1) code for each prize.
Details of Prizes and Draw
25.
The Prize Pool consists of:
a)One (1) AUD$10000.00 ANZ Visa Gift Card and
b)Twenty (20) AUD$1000.00 ANZ Visa Gift Cards.26.The total RRP of Prize Pool 1 is AUD$30000.00.
27.The twenty one (21) prizes in Prize Pool 1 will be featured on the posters in each Jamaica Blue store with a specific code for each prize as described in the Details of Determining Winners section.
28.Winners for Prize Pool 1 will be determined at 12.01PM 6 August 2012 in the offices of Slingshot Digital Ventures, 338 Pitt Street, Sydney, NSW 2000, Australia.
29.Winners will be notified at 12.30PM 6 August 2012 through email provided in the entry process.
30.All winners of prizes valued at over AUD$250.00 will be notified by email and will have their name published in "The Australian" on 20 August 2012.
General Prize Details
31.The total RRP of all prizes available in the Promotion is AUD$30000.00.
32.In the event that any Prize from Prize Pool 1 is not claimed by the Winner within five (5) calendar days of the close of 20 August 2012, an unclaimed prize draw will take place at 12.01pm on 27 August 2012 in Slingshot Digital Ventures, 338 Pitt Street, Sydney, NSW 2000, Australia.
33.Winners will be notified at 12.30PM 27 August 2012 through email provided in the entry process.
34.All winners of prizes valued at over AUD$250.00 will be notified by email and will have their name published in "The Australian" on 3 September 2012.
35.Any element of the Prize is not to be resold for cash or profit in any way.
36.In the event that for any reason whatsoever a winner does not take an element of the prize(s) at the time stipulated then that element of the prize will be forfeited by the winner/s and cash will not be awarded in lieu of the prize/s.
37.Prizes are not exchangeable or redeemable for cash. Any unused balance will not be refunded or credited on expiry.
38.The Promoter is not liable for any loss or damage or for personal injury suffered or sustained by the taking of the Prize except for any liability which cannot be excluded by law.
39.If the Promoter is unable to contact the winner for the purposes of distributing the Prize, that winner will forfeit the prize entirely and it shall be awarded to the next selected winner in the promotion. The Promoter will not be liable where a winner forfeits their prize.
Privacy
40.Entrants will be invited to opt-in to receive marketing communications from the Promoter. The decision by entrants to grant or withhold their consent in relation to the use of their information for marketing purposes will not affect the selection of the winners.
41.The Promoter reserves the right to disqualify any entry or entrant that fails to comply with these Terms and Conditions.
42.This Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. By entering, you understand that any personally identifiable information you provide in connection with the Promotion you are providing to the Promoter and not to Facebook.
43.The personally identifiable information you provide in connection with the Promotion will be collected, stored and used in accordance with the Promoter's Privacy Policy, located at
http://www.jamaicablue.com.au/default.asp?PageID=17&n=Privacy 44.Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of:
(a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control);
(b) any theft, unauthorised access or third party interference;
(c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
(d) any variation in prize value to that stated in these Terms and Conditions;
(e) any tax liability incurred by a winner or entrant; or
(f) use of a prize.
45.Entrants (or their parent or legal guardian if entrant is not the age of majority in his/her state of residence) agree to release, discharge, indemnify and hold harmless the Promoter and Facebook, and each of their respective officers, directors, employees, representatives and agents (the "Indemnified Parties") from and against any claims made by winners, entrants, or any other third parties, related in any way to the operation of this Promotion as well as any other claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in any Promotion-related activity or participation in this Promotion.
