TERMS AND CONDITIONS
Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
Entry is only open to
Australian residents aged 18 years or older who, in the event they are the Major Prize winner, are able to participate in the Major Prize as set out in Conditions 13 and 14 (Entrants). The directors, management and employees (and their immediate families) of the Promoter, its related entities, printers, suppliers, providers and agencies whom are directly associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
Promotion commences at 10:00 am (AEST) on 6/8/2012 and
closes at 11:59pm (AEST) on 16/9/2012 (Promotional Period).

c. access the promotional application (Application) made available on the Aussies Love British Columbia Page; and
d. follow the prompts of the Application in the manner required to submit the online entry form, including:
i. providing the Entrant’s full name and current and valid email address;
ii. nominating one (1) of the following ski resorts: Whistler Blackcomb, Big White Ski Resort, Sun Peaks Resort, Fernie Alpine Resort, Panorama Mountain Village, Silver Star Mountain Resort, Apex Mountain Resort, Mount Washington Alpine Resort, Kicking Horse Mountain Resort, Kimberley Alpine Resort, Red Mountain Resort, Whitewater Ski Resort or Revelstoke Mountain Resort (each, a Ski Resort);

providing the first five (5) words or less of their answer to the promotional question: “Why are you curious to ski British Columbia?”; and iv. i
nviting three (3) ‘friends’ who are Australia residents aged 18 years or older (Friends) to ‘like’ the Aussies Love British Columbia Page and then contribute to and complete the Entrant’s answer to the promotional question, by each providing an additional five (5) words or less. For the avoidance of doubt, Friends in this context means Facebook friends of the Entrant.
By participating, Friends agree to be bound to the Terms and Conditions as if they are an Entrant. Entrants acknowledge that their entry into the promotion and opportunity to win a prize is contingent upon three (3) eligible Friends each contributing to the Entrant’s answer to the promotional question in the manner required. The Promoter is not responsible in any way for an ineligible Entrant or Friend or an incomplete or otherwise invalid entry.
The Promoter reserves the right, at any time, to verify the validity of any and all entries and Entrants (including verifying the identity, age and place of residence of an Entrant and their Friends) and to disqualify any Entrant who submits an entry that is not in accordance with these Terms and Conditions, who tampers with the entry process or who engages in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of this promotion. Errors and omissions will be accepted at the Promoter's discretion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
Any entry that contains content that the Promoter, in its sole discretion, considers to be offensive, crude or inappropriate in any way or that the Promoter considers may infringe any intellectual property rights or other rights of any person, corporation or entity will not be accepted as an eligible entry into the promotion. This includes but is not limited to any entry which the Promoter considers to be disparaging of its or any prize supplier’s products or services and/or is otherwise not in keeping with the spirit of this promotion.
Entries will be deemed accepted at the time of receipt by the Promoter and not at the time of transmission. Entries received will be considered final by the Promoter. Incomplete, inaccurate, erroneous, ineligible or incomprehensible entries will be deemed invalid. The Promoter accepts no responsibility for late, lost or misdirected entries. Contact details entered incorrectly via the Application by an Entrant will deem an entry invalid.
Multiple entries are permitted however each entry must be submitted separately, must be substantially unique, must be completed by three (3) Friends who have not previously contributed to an entry of the Entrant and must independently comply with these Terms and Conditions.Facebook membership, Facebook pages, the ‘liking’ of Facebook pages, Facebook applications and use of Facebook generally are subject to Facebook’s prevailing terms and conditions of use available at

The Promotional Period will be divided into six (6) weeks and six (6) corresponding judging for the purpose of awarding Weekly Prizes in this promotion (each, a Promotional Week). Each Promotional Week will commence at 12:00am (AEST) (excluding the first Promotional Week, which will commence at 10:00 am (AEST)) each Monday during the Promotional Period and close at 11:59pm (AEST) the following Sunday evening during the Promotional Period.
Entries will NOT rollover into subsequent Promotional Week(s) (if any). All valid entries will be judged by a panel of appropriately qualified judges at the Promoter’s premises to determine
six (6) Weekly Prize winners and one (1) Major Prize winner. This is a game of skill and chance plays no part in determining the winners. Each eligible
entry will be individually judged based on creative merit and originality of the answer provided to the promotional question. All reasonable steps to notify the winners of the results of the judging will be taken by the Promoter. The judges’ decision is final and no correspondence will be entered into.
For each Promotional Week, the Entrant judged to have submitted the best entry from all eligible entries received for that Promotional Week will win one (1) Resort Swag and Sports Equipment prize, valued at up to $75.00 (each, a Weekly Prize). Weekly Prize winners will be notified on
www.becuriousinbc.com (Promotional Website) each Monday following the close of the relevant Promotional Week. The precise merchandise included in a particular Weekly Prize will be determined by the Promoter in its sole discretion and will be featured on the Promotional Website during the Promotional Week for which that Weekly Prize will be awarded.
The Entrant judged to have submitted the best entry from all eligible entries received during the Promotional Period will win one (1) trip for the winner and three (3) travel companions to Vancouver, Canada, valued at up to $15,500.00, depending on the date and point of departure (Major Prize).
The Major Prize will be awarded to the winning Entrant only and not to any Friends who contributed to the Entrant’s winning entry. The Major Prize winner will be determined by 21/9/2012 and notified by email by 21/9/2012. The
Major Prize comprises of the following components:a. four (4) return economy airfares from one (1) of the following Australian cities: Brisbane, Sydney or Melbourne (whichever is closest to the winner’s ordinary residential address) to Vancouver, Canada (inclusive of airfare related taxes and charges). For the avoidance of doubt, transport and/or transfers to and from the departure airport in Brisbane, Sydney or Melbourne, Australia are not included in the Major Prize and are the responsibility and at the cost of the winner and their travel companion(s) (if any);
b. return economy transfers from Vancouver International Airport to the Ski Resort nominated on the winning entry;
c. five (5) nights’ accommodation at the Ski Resort nominated on the winning entry (quad share) (or similar) and up to two (2) nights’ accommodation in Vancouver at a resort nominated by the Promoter, valued at up to $2,600.00. The precise number of nights’ accommodation in Vancouver will be determined by the Promoter in its sole discretion and will depend on resort availability and the winner’s required flight arrangements; and
d. five (5) day lift-pass and five (5) days equipment hire for each of the winner and their travel companion(s) (if any).
The Major Prize must be booked by 1/12/2012 via a licensed travel agent nominated by the Promoter and travelled in full by 30/4/2013, or the Major Prize is forfeited. Redemption of the Major Prize is subject to availability at the time of booking and may be dependent on travel class availability and specific room category availability. The Major Prize is not valid to be taken during high season, Australian and Canadian school holidays or public holidays, Christmas or New Year periods or between 1/12/2012 – 20/1/2013 (inclusive). The winner must provide the Promoter and its nominated travel agent with a minimum of twenty-one (21) days advance notice of intention to travel.
All components of the Major Prize must be taken together and when offered or are forfeited. For the entire duration of the Major Prize, a nominated parent or legal guardian must accompany any person under 18 years of age. Accommodation must be confirmed before final booking of the flights. Once booked, any changes to travel and/or accommodation may incur a cancellation or amendment fee at the sole cost of the winner.
The Major Prize winner and their travel companion(s) (if any) must depart from and return to the same departure point and travel together. The Major Prize winner and their travel companion(s) (if any) may not accrue frequent flyer points. The Major Prize cannot be used in conjunction with travel discounts or special offers. Winner may be required to present credit card at time of accommodation check in. The itinerary for the Major Prize is to be determined by the Promoter in its absolute discretion.
Use of the Major Prize and any passes, tickets or vouchers issued as part of the Major Prize may be subject to prevailing prize supplier terms and conditions of use. The winner and their travel companion(s) (if any) will also be subject to, and must abide by, the terms and conditions of the Promoter and any third parties, including but not limited any travel/travel agent/travel insurance /services/transfers/tour or Ski Resort or accommodation providers or ski instructors or officials, and in particular, health, behaviour, age and safety requirements. Any breaches of such terms and conditions may affect the ability to receive benefits of the Major Prize and such benefits may be forfeited. No compensation will be payable if the winner or their travel companion(s) (if any) are unable to use any element of the Major Prize as stated for whatever reason, including refusal of entry or departure into or out of Vancouver, Canada, refusal of entry or ejection from the Ski Resort or other accommodation, or participation in certain activities for health, age, behaviour or safety reasons. The winner and their travel companion(s) (if any) must follow all reasonable directions given by the Promoter and any Major Prize supplier (including but not limited to ski instructors or officials) during the course of their participation in the Major Prize, including all directions in relation to health, age, behaviour and safety. If the winner or any travel companion(s) (if any) fail to participate in the Major Prize in the manner required, as stated in this condition and in the reasonable opinion of the Promoter and/or any Major Prize supplier, the balance of the Major Prize will be forfeited with no compensation payable.
All additional costs not expressly stated, but which may be incurred in acceptance and use of the Major Prize, are the responsibility of the winner and their travel companion(s) (if any). Such additional costs include, but are not limited to, spending money, meals and beverages, telephone calls, laundry services, taxes including arrival and departure taxes (if applicable) but excluding airfare related taxes and charges included in the Major Prize, insurance, travel insurance, passports, visas (if applicable), vaccinations, transport to and from departure point (being Brisbane, Sydney or Melbourne, Australia only), transfers (unless otherwise advised), items of a personal nature, in-room charges and all other ancillary costs are not expressly included in the Major Prize.
The Major Prize winner is solely responsible for their entry and the entry of their travel companion(s) (if any) into Vancouver, Canada, at their own expense, including ensuring all necessary passports, visas, travel authorisations, medical advice and recommended vaccinations and immunisations have been obtained prior to travel and, if required, on or by a date nominated by the Promoter. Failure to do so may result in the Major Prize being forfeited.
The winner and their travel companion(s) (if any) acknowledge that the Major Prize may involve skiing and/or other dangerous activities, which may result in injury or death, and participates at their own risk. The winner and their travel companion(s) (if any): (a) must attend, undergo and pass any appropriate training, briefings, safety demonstrations, required medical tests and other requirements (including blood alcohol testing) of the Promoter and a Major Prize supplier as determined by them in their absolute discretion; (b) must declare to the Promoter or a Major Prize supplier (as applicable) any health-related issues that may affect his/her safe participation in any part of the Major Prize and obtain a written clearance from their doctor in this respect; (c) must not have any heart condition or history thereof, or other medical conditions that would make it dangerous to participate in any part of the Major Prize; (d) must not be under the influence of any drugs; (e) may consume alcohol in moderation but must not be under the influence of alcohol during any activities to the extent that it impairs or affects their understanding, judgment or participation in the activities, and subject to any limitations of a Major Prize supplier; (f) must comply with all directions of the Promoter, a Major Prize supplier and relevant officials; and (g) must wear all safety and other equipment required. The Promoter and a Major Prize supplier in their absolute discretion: (a) reserve the right to refuse to allow the winner or their travel companion(s) (if any) to take part in any or all aspects of the Major Prize if they reasonably believe the winner or their travel companion(s) (if any) poses a safety risk or for any other reason; and (b) may cancel the relevant component of the Major Prize if the conditions are deemed dangerous. No compensation will be payable if the winner or their travel companion(s) (if any) are unable to use any element of the Major Prize as stated for whatever reason, including refusal of participation in certain activities for health, age, behaviour or safety reasons.
If a prize (or part of a prize) becomes unavailable for any reason beyond the Promoter’s reasonable control, the Promoter will substitute the prize (or that part of the prize) with a prize to the equal or greater value and/or specification in lieu.
Total maximum prize pool value is up to $15,950.00. A prize, or any unused portion of a prize, is not transferable or exchangeable and cannot be taken as cash. A prize must be taken as offered and cannot be varied. The Promoter accepts no responsibility for any tax implications that may arise from prize winnings. Independent financial advice should be sought.
The Promoter may award a prize to the next best judged entry by 29/9/2012 in order to award the prize if unclaimed by that date. Any unclaimed prize winner(s) will be notified by 5/10/2012 on the Promotional Website (if they have won a Weekly Prize) or by email (if they have won the Major Prize). All reasonable steps to notify any unclaimed prize winner(s) of the results of the judging will be taken by the Promoter. The judges' decision is final and no correspondence will be entered into.
Prize values are based on the recommended retail prices including GST (depending on the date and point of departure for the Major Prize) at the time of printing and may vary depending on the exchange rate at the time of redemption. The Promoter accepts no responsibility for changes in prize value between now and the ultimate prize redemption date.
Entrants can only enter in their own name. Entrants who provide incorrect, misleading or fraudulent information are ineligible to participate in the promotion and all entries of an Entrant who is deemed by the Promoter to have provided incorrect, misleading or fraudulent information may, at the discretion of the Promoter, be deemed invalid. The Promoter reserves the right to request the Entrant produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the Entrant’s identity, age, residential address, eligibility to enter and claim a prize, and any information submitted by the Entrant in entering the promotion, before issuing a prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or an Entrant or entry has not been verified or validated to the Promoter’s satisfaction then all the entries of that Entrant will be ineligible and deemed invalid. A prize will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion.
All entries submitted become the property of the Promoter. Entries will not be returned to any Entrant. As a condition of entering into this promotion, each Entrant agrees to assign all of their rights, title and interest (including copyright) in and to their entry to the Promoter. Each Entrant warrants to the Promoter that each entry submitted is an original literary work of the Entrant that does not infringe the rights of any third party. If the Promoter suffers loss or incurs any costs in connection with any breach of these Terms and Conditions or any other legal obligation by an Entrant, the Entrant agrees to indemnify the Promoter for those losses, damages and costs.
Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (Non-Excludable Guarantees).
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or Entrant; or (f) taking of a prize.

The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, and prize suppliers.
