TERMS AND CONDITIONS
1.Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this Promotion is deemed acceptance of these Terms and Conditions.
2.Entry is only open to Australian residents. If the entrant is under the age of 18 years old, he/she must have parental or guardian permission to enter ("Eligible Entrants").
3.Employees (and their immediate families) of the Promoter, participating retailers and agencies associated with this Promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
4.Promotion commences at 00.01 (AEDST) on Monday 21st of January 2013 and closes on Monday 11th of March 2013 at 23.59 (AEDST) ("Promotion Period"). From Tuesday 22nd of January 2013 to Tuesday 12th of March 2013 (inclusive) there will be a Daily Draw.
5. To be eligible to enter, Eligible Entrants must:
Purchase any specially marked promotional LOL four (4) Pack from participating retailers during the Promotion Period ("Qualifying Purchase"), and then submit their entry by following the instructions below:
a) Send an SMS text message from their mobile phone to 1991 1121 (SMS cost is $0.55 incl. GST) including the Entrant's Full Name; Post Code; last 4 digits of a Barcode of an LOL pack and a unique code found on the LOL pack; or
b) Visit
www.drinklol.com.au, follow the prompts to the Promotion entry page, input the requested details including the Entrant's Full Name, Residential Address (including Suburb, Postcode and State), Email Address, Age, last 4 digits of a LOL 4 Pack Barcode and the unique code located on the inside of the LOL pack and submit the fully completed entry form.

7.The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
8.Incomplete, indecipherable or illegible entries will be deemed invalid.
9.Over the Promotion Period Entries are subject to the following: (a) only one entry permitted per Qualifying Purchase in accordance with clause 5; (b) each entry must be submitted separately and in accordance with entry requirements; and (c) unrecognised barcode numbers will be deemed invalid.
10.Entrants must retain a copy of their purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant's entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the LOL four (4) pack purchase, the store of purchase, and that the purchase was made during the Promotion Period but prior to entry.
11.Daily Draw: There will be a Daily Draw conducted from Tuesday 22nd of January 2013 to Tuesday 12th of March 2013 (inclusive) at 2pm AEDST ("Daily Draw Period"). The Daily Draw will be conducted during the Daily Draw Period from the Entries received for the each State/States or Territories grouping: VIC/TAS, NSW/ACT, WA, QLD, SA/NT ("Group"). One Daily Draw Winner will be randomly chosen each day during the Daily Draw Period by an electronic drawing system by a pre-determined time. The total number of winners will be 50 and the maximum number of winners per Group shall be: 15 winners from VIC/TAS, 15 winners from NSW/ACT, 5 winners from WA, 10 winners from QLD and 5 winners from SA/NT ("Daily Draw Winner/s"). Each Daily Draw Winner will be issued a Unique Prize Claim Number. The Unique Prize Claim Number must be recorded by the Daily Draw Winner for prize verification purposes. In the event of any dispute with the Promoter, or at the Promoter's request, each Daily Draw Winner will be required to correctly quote their Unique Prize Claim Number to be awarded their Daily Draw Prize. The Promoter reserves the right to withhold the awarding of a Daily Draw Prize to a provisional winner who cannot provide a valid Unique Prize Claim Number. Any Daily Draw Prize awarded to ineligible or invalid entrants will be re-drawn during a second chance draw. Each Daily Draw Winner will be contacted by telephone and in writing within two (2) business days of the Daily Draw and the details of all Daily Draw Winners will be published in The Australian newspaper on Friday 29th March 2013.
12. Daily Draw Prize:
The Promoter will provide each Daily Draw Winner with the following:
i. two (2) adult return economy airfares (including airfare related taxes and charges) for the winner and one (1) travel companion to Melbourne, VIC from the Australian capital city closest to the winner's ordinary residential address (excluding Victorian residents);
ii. two (2) nights' accommodation in a minimum 3 star Hotel in a standard twin share room (excluding Victorian residents);
iii. transfers to and from the accommodation (provided by the Promoter under paragraph ii. above) to the Event; and
iv. two (2) Tickets to the Event
(i to iv. above referred to as the "Daily Draw Prize")
13.Total flights, transfers and accommodation are valued at up to $2,000 (Recommended Retail Price incl. GST, depending on point of departure). Tickets for the Event are valued at $300 (incl. GST) All other costs including, without limitation, meals, beverages, laundry services, spending money, transport to and from departure point, insurance, travel insurance and all other ancillary costs not expressly provided for above, as well as the costs of obtaining any of these, are the responsibility of the winners and their travel companions. Any passes, tickets or vouchers issued by the Promoter are subject to prevailing terms and conditions of use applicable to them.
14. Meet and Greet Prize:
In addition to the Daily Draw Prize on Tuesday 12th of March 2013 at 2:30 pm AEDST five (5) Daily Draw Winners will be randomly selected by an electronic drawing system from the fifty (50) Daily Draw Winners to "Meet and Greet" Reece Mastin at the Event. ("Meet and Greet Prize")
15.If a Daily Draw Winner is under 18 years of age, he/she must have parental or guardian permission to accept the Daily Draw Prize and must be accompanied by a parent or a guardian while travelling and to the Event and the Meet and Greet Prize (where applicable). The Promoter reserves the right at any time to seek to verify to the Promoter's satisfaction the fulfilment of these conditions, including provision of relevant documentation and evidence.
16. The event is an all ages performance during which Reece Mastin will perform 6 songs. The performance will take place at a time on Saturday in April 2013 at a date to be determined and at a Melbourne venue to be determined. Winners will be advised of the date and venue of the performance on or before Friday 15th of March 2013 ("Event").
The total prize pool is valued at up to $115,000 (incl. GST). Approx. allocation by state is VIC / TAS: $34,500, NSW/ACT: $34,500, WA: $11,500, QLD: $23,000 and SA/NT: $11,500.
17.The Promoter's decision in relation to any aspect of this Promotion, including the selection of any winner and the criteria it applies in determining the winner, is final and binding on every entrant. No correspondence will be entered into.
18.The Daily Draw Prize and the Meet and Greet Prizes are not transferable or exchangeable. If any part of the Daily Draw Prize or the Meet and Greet Prize is unavailable or unable to proceed, the Promoter, in its discretion and subject to state permit approval, reserves the right to substitute all or any part thereof with a product or prize to an equal value.
19.Should an entrant's contact details change during the Promotion Period, it is the entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter in writing.
20.The Promoter accepts no responsibility for loss or damage to any prize in transit.
21.As a condition of accepting the Daily Draw Prize or the Meet and Greet Prize, the winner may be requested to sign legal documentation in the form required by the Promoter in its absolute discretion, including but not limited to a legal release and indemnity form.
22.All values and amounts that appear in these Terms and Conditions are in Australian Dollars and are inclusive of GST unless expressly stated otherwise.
23.Subject to the unclaimed prize draw clause, if for any reason a winner does not take a prize, then the prize will be forfeited.
24.A draw for any unclaimed Daily Draw Prizes may take place no later than 3 business days before the Event at the same time and place as the original Daily Prize Draw, subject to any directions from a regulatory authority. Winners, if any, will be notified by telephone within two (2) days of the draw and by mail and their details will be published in The Australian newspaper on Friday 5th April 2013.
25.Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
26.If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
27.The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
28.Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia ("Non-Excludable Guarantees").
29.Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use/taking of a prize including, without limitation, travelling to and from the Event, use of the accommodation and attendance at the Event.
30.The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.
