1. Information on How to enter and prizes form part of these Conditions of Entry.
2. The promotion period begins on the 10th August, 2012 at 12:01am and ends on the 26th August, 2012 at 11.59pm AEDST.
3. These Terms and Conditions apply to the competition (including without limitation the information on how to enter and prize details). By entering the competition, you acknowledge that you have read and understood, and agree to be bound by these Terms and Conditions. IF YOU DO NOT ACCEPT THESE CONDITIONS YOU MUST NOT ENTER.

6. Employees of Bluemouth Interactive Pty Ltd and associated companies and their immediate families and any agencies associated with this promotion are excluded from entry.
7. Winners or the person nominated to redeem the prize must be a resident of Australia. Entrants from other countries than Australia may participate and enter, but may not win. If the country of origin is uncertain, at time of judging and a winner notified which is not Australian, the prize will automatically be be forfeit; The major prize will then be awarded to the 2nd place winner (and so on – if required) until an Australian resident is determined such that the first prize is awarded / distributed , subject to any relevant legislation.
8. Judging entries will take place at 10.00am on the 28th August, 2012 at Bluemouth Interactive, Suite 1502, 9 Yarra Street, South Yarra, 3141. Prize winners name will be published on the Bluemouth Facebook page by 29th August, 2012.

9. The entry judged most creative will win a redballoon.com.au experience voucher up to the value of $1295.00.
There is a total of one (1) prize to be won.
The winner (or appointed nominee) must choose 1 (only) experience from the below list of driving experience and locations. For ease of explanation given the 6 different experiences and locations, the prize is marketed as a “redballoon hyper car driving experience”.

10. Total maximum prize pool is $1295.00 and equates to the Sydney experience. The total prize pool offered will be lowered in other states – if a non-Sydney location is nominated by the winner - being Gold Coast $590, Melbourne $950, Perth $895, Adelaide $1185, or Brisbane $999. Any difference / gap in prize value to $1,295 maximum will not be provided in cash or any other value. The nominated prize is the total value of the prize only. Bluemouth Interactive Pty Ltd reserves the right to substitute a similar experience up to the value of $1,295 if the above driver experiences are discontinued by the operator or retailer: redballoon.
11. The winner may redeem an alternative driving experience voucher from redballoon if equal to or lesser value than the prize pool amounts stipulated above – relevant to each location.
12 The person taking the redballoon hyper car driving experience must be over 25 years old, have a fully valid driver’s license and be competent in using a manual transmission. L Plates are not acceptable. Guidelines advise the experiences are for participants with a maximum height of approximately 190cm and maximum weight of 125kgs. This experience is not suitable for pregnant women or those people suffering from a heart condition. The person taking the experience must be drug and alcohol free. The experience providers reserve the right to refuse participation.
Additional areas of note specific to individual experiences.
· The Gold Coast prize stipulates participants must be 30 years of age or older and have held a license for more than 5 years.
· In Sydney, participants will be required to sign an indemnity form prior to participating in the experience. A security bond of $2000 by way of credit card is taken on the day. The security bond is the full responsibility of the participant.
· In Melbourne, participants must complete insurance documents and pay a security bond of $5,000 on a valid credit card at least one week prior to the day of your drive (No Amex accepted). The full bond is returned to you after the event providing there is no damage to the vehicle. The bond is the full responsibility of the participant.
· In Adelaide, participants must pay a refundable $5000.00 security deposit (swiped via credit card), to cover insurance excess and any infringements or extra charges. The bond is the full responsibility of the participant.
· Similar conditions may be mandated at the Brisbane and Perth experiences.
13. Prize must be taken in its entirety. All components of the prize must be taken together.

15. Redballoon, try to ensure that their promotional information is accurate and up-to-date. However, the content or format of some experiences may change slightly from time to time. The experience provider (upon confirmation of each booking) will provide the final details about each experience. The experience provider will notify the winner of any subsequent changes directly. The winners participation in each experience is conditional upon acceptance of the experience provider's terms and conditions at the time your booking is confirmed by the experience provider.
16. Certain experiences provided by experience providers are subject to minimum age, weight, health or other restrictions. These restrictions are outlined on the relevant experience information page and also in the email of your booking confirmation. Please read this information carefully. It is the winners responsibility to understand any restrictions prior to confirming the booking. If the winner is forced to cancel due to restrictions, you may be liable for charges by the provider of your experience. Bluemouth Interactive Pty Ltd will not contribute to this.
17. Any security deposits are the full responsibility of the participant.
18. All of these experiences are considered dangerous. Prior to redeeming or participating in any experience you should be aware of the risks involved. RedBalloon can provide further information if you are in any doubt about any experience. Experience providers warrant that they maintain appropriate public liability insurance for all risks associated with its business and service provisions. Redballoon and Bluemouth Interactive Pty Ltd make no warranty or representation about their business or services whatsoever. The responsibility rests with the person taking the experience to make independent enquiries with the experience provider or other third parties as to the need to acquire your own insurance cover.
19. All travel (to and from your residence to experience provider), transfer and accommodation costs to get and house the winner or person taking the redballoon hyper car driving experience are the full responsibility of the winner. The winners are responsible for all other expenses including spending money, meals, drinks, transfers (unless specified), laundry charges, incidentals, gratuities, services charges, and all other ancillary costs.
20. Weather: Driving is an all weather sport. If conditions make it unsafe your experience may be postponed. If postponed, all costs to return including travel, transfers and accommodation costs and any re-booking fee are the full responsibility of the winner.
Disclaimers
21. Bluemouth Interactive Pty Ltd makes no representation as to the safety, conditions or other issues that may exist at any destination.
22. The winner must adhere fully to the terms and conditions of the individual experience won – including that the winner or nominee must be fit and healthy enough to perform the chosen “redballoon hyper car driving experience”.
23. By entering this competition, entrants accept and acknowledge full responsibility for their decision to participate in this driving experience should they be chosen as winners. The winners release the Promoter and other organisers, their related bodies corporate, affiliates, officers, agents and employees, from all liabilities, loss and damage of any kind arising at any time out of or in connection with the acceptance of, and participation in, the prize. Without limiting the foregoing, the released parties not be liable for any injury, sickness or death, property loss or damage or other direct or indirect loss or damage of any kind, howsoever sustained or incurred, in connection with or arising out of the driving experience. The winner acknowledges that they have been warned that there is a possibility of an accident causing injury, death or property damage in accepting the prize.
24. If the prize provided by the Promoter cannot, in the opinion of the Promoter, be provided for any reason, the Promoter reserves the right to provide an alternative prize to the same value, as that part of the prize being replaced.
25. It is the Entrant’s responsibility to advise the Promoter of any change in personal details.
26. If for any reason any winner does not, once the prize has been booked, take the prize or an element of the prize- at the time stipulated by the Promoter, then the prize will be forfeited and will not be redeemable for cash.
27. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
28. The Promoter’s decision is final and no correspondence will be entered into.
29. The experience must be taken within 12-months of notification, otherwise the experience is forfeit.
30. Bluemouth Interactive Pty Ltd and their associated agencies and companies are not responsible for any incorrect or inaccurate information, either caused by you or for any of the equipment or programming associated with or utilised in the competition, or for any technical error, or any combination thereof that may occur in the course of the administration of the competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, theft or destruction or unauthorised access to or alteration of entries.
31. The Promoter reserves the right, at any time, to verify the validity of entries and Entrants (including an entrant’s identity, age and place of residence) and to disqualify any Entrant who submits an entry that is not in accordance with these Terms and Conditions.
32. Any form of automated entry using any other devices or software will be deemed to be invalid. We reserve the right to verify the validity of entries and to disqualify any Entrant who tampers with the entry process or who submits an entry that is not in accordance with these conditions.
33. We are not responsible for lost, late, incomprehensible or incorrect entries in the competition. We also accept no responsibility for any tax implications that may arise from prize winnings in the competition. You should seek Independent financial advice about such matters.
34. If for any reason the competition is not capable of running as planned (including but not limited to) technical failures, unauthorised intervention, fraud or any other causes beyond our control which corrupts or affects the administration, security, fairness, integrity or proper conduct of this competition, we are entitled in our sole discretion to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the competition.
35. As a condition of accepting the prize, the winner (and any companion/s) must sign any legal documentation in the form required by the Promoter in its absolute discretion including but not limited to a legal release and indemnity form.
Exclusions and our liability
36. In the event of any vehicle or third party damage and injury, Bluemouth Interactive Pty Ltd accepts and has no liability. Entrants into the competition – should not enter if they do not agree to this strict clause. Bluemouth makes no warranties as to the quality and safety of the experiences. All winners will be required to sign a waiver form before the acceptance of the prize. The waiver will release Bluemouth Interactive Pty Ltd from all liability.
37. We shall not be liable for any loss or damage whatsoever which is suffered (including without limitation direct, indirect and consequential loss and damages) or for personal injury suffered or sustained as a result of entering or trying to enter the competition or accepting any prize offered as part of the competition, except for any liability which cannot be excluded by law.
38. The law implies various conditions and warranties which might apply to us supplying goods or services to you. We exclude all of those conditions and warranties to the fullest extent permitted by law, including without limitation implied warranties of merchantability and fitness for a particular purpose.
Termination
39. We may terminate or cancel your entry in the competition immediately in our reasonable discretion or if you breach any of your obligations under these conditions.
You indemnify us
40. You release and agree to keep us indemnified from any claim, cost, demand, tax, liability or damage (including legal costs on a full indemnity basis) suffered or incurred by us, our directors, employees, agents and representatives arising out of your entry in the competition or any claim by a third party arising from an act or omission by you.
Failure to comply and severability
41. We are not liable for any failure to comply with these conditions. If any part or provision in these conditions is found to be invalid, unenforceable or illegal for any reason, that part or provision shall be severed and the remaining provisions shall continue in full force.
Entire agreement and governing law
42. These conditions constitute the entire agreement between you and us as to its subject matter. By entering the competition, you accept that this agreement is to be interpreted, and any disputes are to be determined by the courts having jurisdiction in Victoria, in accordance with the laws in force in Victoria from time to time, subject to any written directions from any regulatory authority.
