1. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Entry is only open to Australian residents
aged 18 years or over.
Individuals must be able to take the major prize from 30/11/2012 to 02/12/2012, as outlined in clause 13 below.3. Employees (and their immediate families) of the Promoterand agencies associated with this promotion are ineligible to enter.Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
4. Promotion commences on 20/08/2012 and ends at 11.59pm AEST on 16/09/2012 ("Promotional Period").

Only one (1) entry is permitted per person.7. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. 9. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
10. The draw will take place at Anisimoff Legal, Level 5, 492St Kilda Road, Melbourne, VIC 3004 at 2pm AEST on 24/09/2012. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.
11. Winners will be notified by telephone and email and thename of the major prize winner will be published in The Australian on08/10/2012.
12. The Promoter's decision is final and no correspondence will be entered into.
13. The first valid entry drawn will win the major prize, valued at $4,592 and consisting of: (a)a set of four (4) Dunlop Sport Maxx RT tyres valued at $1,592; and (b)a V8 Supercars Experience at the 2012 Sydney Telstra 500 valued at $3,000. The prize includes a set of four (4) tyres only and does not include fitting or installation on the vehicle.The V8 Supercars Experience at the 2012 Sydney Telstra 500 includes the following:
A membership for the winner and one (1) companion to the "Pit Lane Club" corporate hospitality facility at the 2012 Sydney Telstra 500, each day from 30/11/2012 to 02/12/2012. The membership includes admission to the 2012 Sydney Telstra 500 for the three days of the event (i.e. from 30/11/12 to 02/12/12);An escorted walk for the winner and one (1) companion on the pre-race grid prior to each race of the V8 Supercars at the 2012 Sydney Telstra 500;A hot lap around the 2012 Sydney Telstra 500 track for the winner and one (1) companion (as passengers) with a professional driver, at the exact time/date determined by the Promoter, but sometime between 30/11/2012 and 02/12/2012. The major prize does not include any flights, transport, transfers, accommodation, spending money, meals, insurance, items of a personal nature, in-room charges or any other ancillary costs incurred in the process of taking any element of the major prize. The major prize winner and their companion must make their own way to the2012 Sydney Telstra 500 event and any costs incurred in doing so will be the responsibility of the winner and their companion (as incurred) and will not be borne by the Promoter. The V8 Supercars Experience at the 2012 Sydney Telstra 500 must be taken from 30/11/2012 to 02/12/2012.During the entire duration of the V8 Supercars Experience at the 2012 Sydney Telstra 500, a nominated parent/guardian must accompany any person under 18 years of age. Itinerary to be determined by the Promoter in its absolute discretion. Admission to the 2012 Sydney Telstra 500 is subject to the event venue and ticket terms and conditions, including any applicable age restriction. The Promoter and event organisers hereby expressly reserve the right to eject the winner (and/or his/her companion) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize.
14. The next valid entry drawn will win the second prize valued at $250 and consisting of the following items:
A signed rear perspex window from Mark Winterbottom's V8 Supercar (Car #5) valued at $200; and
A Dunlop Podium Winning Cap, worn and signed by Mark Winterbottom valued at $50. Size and style of the cap is set and cannot be varied by the winner.
15. The next valid entry drawn will win the third prize valued at $120 and consisting of the following items:
a signed rear ¾ glass window from David Reynolds' V8 Supercar (Car #55) valued at 80; and
a limited edition signed David Reynolds driver cap valued at $40. Size and style of the cap will be determined by the Promoter in its absolute discretion.
16. By accepting the major prize, the major prize winnerand their companion acknowledge that motor racing is a dangerous activity, which may result in injury or death, and participation in the V8 Supercars Experience at the 2012 Sydney Telstra 500 event, including the hot lap element of the prize ("Racing Experience Prize")isat their own risk. V8 Supercars Australia will provide the Racing Experience Prize ("Prize Supplier"). The winner and their companion: (a) must attend, undergo and pass any appropriate training, briefings, safety demonstrations, required medical tests and other requirements (including blood alcohol testing) of the Promoter and the Prize Supplier as determined by them in their absolute discretion; (b) must declare to the Promoter or the Prize Supplier any health-related issues that may affect their safe participation in the Racing Experience Prize and obtain a written clearance from their doctor in this respect; (c) must not have any heart condition or history thereof, or other medical conditions that would make it dangerous to participate in the Racing Experience Prize; (d) must not be under the influence of any drugs or alcohol; (e) must comply with all directions of the Promoter, the Prize Supplier, the nominated professional driver and race officials; and (f) must wear all safety and other equipment required. The Promoter and the Prize Supplier in their absolute discretion (a) will nominate a qualified professional driver; (b) reserve the right to refuse to allow the winner or their companion to take part in any or all aspects of the Racing Experience Prize if they reasonably believe the winner or their companion pose a safety risk or for any other reason; (c) may cancel the Racing Experience Prize if the conditions are deemed dangerous. If the Racing Experience Prize is varied for any reason beyond the control of the Promoter it may not be rescheduled and in which case, no compensation will be offered.
17. Subject to the unclaimed prize draw clause, if for any reason a winner does not take a prize (or an element of a prize)by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
18. If any prize (or element of a prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that element of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
19. Total prize pool value is $4,962.
20. Prizes are not transferable or exchangeable and cannot be taken as cash.
21. A draw for the major prize, if unclaimed, may take place on 29/10/2012 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winner, if any, will be notified by telephone and via email and their name will be published in The Australian on 05/11/2012.
22. A draw for the second and/or the third prize, if unclaimed, may take place on08/01/2013 at the same time and place as the original draws, subject to any directions from a regulatory authority. Winners, if any, will be notified by telephone and via email.
23. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
24. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
25. Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used.

Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

Except for any liability that cannot by law be excluded, includingthe Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f)use/taking of a prize and/or participationina prize or any element of a prize.
28. As a condition of accepting a prize, each winner (and his/her companion where applicable) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
29. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant.
