Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

Entry is only open to QLD residents. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter.

Promotion commences 9am (local time) on 10/09/12 and closes 9am (local time) on 14/10/12 (“Promotional Period”).

To enter, eligible entrants must, during the Promotional Period, enter the promotion by completing all of the competition form details, placing it in the entry barrel located on Level 1, Wintergarden, 171-209 Queen Street Mall Brisbane

The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

Only one (1) entry permitted per person per weekly draw

There will be two draws each Monday at 9am on the following dates (10 draws in total): 17/09/12, 24/09/12, 1/10/12, 08/10/12 and 15/10/12. Draws will be comprised of entries received in the week preceding. Each draw will take place at Wintergarden Centre Management, Level 2, Broadway on the Mall, 170 Queen St, Brisbane Qld 4001. The Promoter reserves the right to draw additional reserve entries in each draw and record them in order in case an invalid entry or ineligible entrant is drawn. Non-winning entries in each draw will be entered into subsequent draws. In the event no entries are received in a particular draw, the prize will be awarded in the subsequent draw.

Winners will be notified by email and phone dependant on details provided on entry form.

The Promoter’s decision is final and no correspondence will be entered into.

Winners will be responsible for liaising with Wintergarden Centre Management to arrange redemption of their prize. Wintergarden Centre Management Office operates standard business hours only. Centre Management can be contacted on (07) 3229 9755. Proof of identity to match the entry form must be provided to Wintergarden Centre management before the prize will be awarded.

If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

Total prize pool value is a maximum of AUD RRP $4, 900 (incl. GST). Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.

The Promoter does not guarantee participating retailers to remain the same throughout the duration of the Promotion.

A draw for any unclaimed prizes may take place on 01/11/2012 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners, if any, will be notified by email and phone dependant on the details provided on the entry form.

Entrants consent to the Promoter using the entrant’s name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. By opting in, entrants agree to become a member of the Lovers of Wintergarden club and the Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.

The laws of the State of Queensland, Australia apply to this promotion to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of Queensland, Australia.
