TERMS & CONDITIONS FOR THE '2013 OPERA AUSTRALIA SUBSCRIBERS PRIZE'
Acceptance of conditions
Information regarding prizes and how to enter forms part of these conditions. By entering into this competition, entrants are deemed to accept these terms and conditions.
Restrictions on entry
Entry is open only to all Australian residents (excluding South Australian residents) over 18, except directors, management and employees (and the immediate families of directors, management and employees) of Opera Australia, Mazda Australia Pty Limited (and its related corporations), Mazda Dealers, and the advertising and sales promotion agencies (and employees, volunteers and contractors of these agencies) engaged by Opera Australia and Mazda Australia Pty Limited.
Duration of competition
The competition begins on Monday 20 August 2012 at 12.01am AEST, and closes on Friday 21 September 2012 at 5.00 pm AEST (‘Competition Period’). To be eligible for entry, consumers must purchase a subscription from the Opera Australia 2013 Subscription Season and the subscription forms must be received by the Promoters within the Competition Period.
Method of Entry
Entry is automatic on subscription to Opera Australia (providing the subscription form is received by the Promoters within the Competition Period). Subscriptions can be purchased by completing an original subscription order form and submitting it by mail, phone, fax, online or in person. Forms are available in the 2013 Subscription Brochure or from Opera Australia’s website –
www.opera-australia.org.au. For further information on the prize, Opera Australia can be contacted via PO Box 291 Strawberry Hills, NSW, 2012, by phone (02) 9699 1099 or by fax (02) 9699 3184.
Providing they comply with these terms and conditions, those persons who have subscribed to Opera Australia for 2013 are entitled to one entry per subscription form.
The Promoters accept no responsibility for any late, lost, incomplete, misdirected, incorrectly submitted, delayed or illegible entries, claims or correspondence whether due to error, omission, alteration, corruption, tampering, deletion, transmission interruption, communications failure, theft or otherwise. The Promoters have no control over mobile telephone communications, networks or lines and accept no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. The Promoters are not liable for any consequences of user error including (without limitation) costs incurred.
Draw details
The draw will be conducted on Wednesday 3 October 2012 at 3.00 pm AEST at the premises of Opera Australia, 480 Elizabeth Street, Surry Hills, NSW. The first valid entry randomly drawn will win the prize.
Prize details
The prize is a CX-5 AWD 2.2L Diesel Maxx Sport Auto valued at $43,849 (including GST). Prize value includes 12 months registration, 12 months compulsory third party insurance, stamp duty, other applicable statutory charges, dealer delivery and administration charges. The prize does not include comprehensive insurance or any other accessories not specified.
Subject to their availability, the prize will be awarded to the prize winner or their representative at Mazda Opera in the Domain, Sydney, NSW, onSaturday 2 February 2013 at 8.00 pm (delivery of the prize will occur within twenty eight (28) days thereafter at the Promoter’s discretion). If the prize winner resides in Victoria they will receive a certificate of ownership of the prize within twenty eight (28) days of the draw. The prize will include one night’s accommodation twin share in a minimum 4-star hotel in Sydney CBD, RRP $500 for the winner and one guest to attend Mazda Opera in the Domain if they reside outside metropolitan Sydney. Should the winner reside outside NSW, the prize will include return economy flights for two people, departing on 2 February 2013 and returning on 3 February 2013, from the nearest capital city, RRP $1,000 to attend the award presentation at Mazda Opera in the Domain. In this case it would be the winner’s responsibility to provide their own transport to the required airport in their nearest capital city.
Other ancillary costs incurred by the winner and his/her guest, as a result of redeeming the prize are the responsibility of the winner.
Prize pool
The total prize pool may be up to a maximum value of $45,349 (including GST), depending on the prize winner’s place of residence.
Publicity
The prize winner must, at the Promoter’s request, participate in all promotional activity (such as publicity and photography) surrounding the winning of the prize, free of charge, and consent to the Promoters using their name and image in promotional material.
Restrictions
If the winner of a prize is under the age of 18 years at the date of the draw, the prize will be awarded to the winner’s parent or guardian.
The eligible winner must hold a full Australian drivers license. If the drawn winner does not hold a full Australian drivers license, the prize may be transferred to the winner’s nominated fully licensed driver.
Exclusion of liability
The Promoters and their associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
Without limiting the previous paragraph, the Promoters and their associated agencies and companies will not be liable for any damage in transit to the prize.
The vehicle will not include comprehensive insurance. The winner is advised to arrange their own insurance prior to collection of the vehicle.
Notification of winners
The winner will be notified in writingand their name and state/territory of residence will be published in the Public Notices section of The Australian newspaper on Wednesday 10 October 2012. The winner’s notification letter will include an assurance that the prize will be delivered within twenty eight (28) days of the presentation ceremony. If the prize winner resides in Victoria they will receive a certificate of ownership of the prize within twenty eight (28) days of the draw.
By entering this competition, each entrant requests that his or her full address not be published.
Disqualification of entries
If a winning entry is deemed not to comply with these conditions of entry, the entry will be discarded and a new winner of that prize will be determined by drawing a further valid entry in accordance withthe following clause. The judges’ decision is final and no correspondence will be entered into.
An entry will be declared invalid if the subscription package is cancelled prior to the draw date.
The Promoters may, in their sole discretion, disqualify all entries from, and prohibit further participation in this competition by, any person who tampers with or benefits from any tampering with the entry process or with the operation of the competition or acts in violation of these conditions, acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person.
Changes in prize value
The Promoters accept no responsibility for any variation in prize value. Where a prize is unavailable for any reason, the Promoters may substitute for that prize another item of equal or higher value as determined by the Promoters, subject to the approval of the gaming authorities in each state and territory, where required.
The prize is not transferable (save for the scenario described previously under Restrictions) or exchangeable and cannot be redeemed for cash. If the winner does not take an element of the prize for any reason at the time stipulated by the Promoters then that element of the prize will be forfeited by the winner.
Tax statement
The Promoters accept no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought.
Unclaimed prize draw
In the event of the prize not being accepted or claimed within 3 months of the draw, the relevant winner’s entry will be deemed invalid and the Promoters reserve the right to conduct such further draws on Friday 11 January 2013 at 10.30am AEST at the same location as the original draw as are necessary to distribute the prize, subject to any written directions given by the Victorian Commission for Gambling Regulation and New South Wales Office of Liquor, Gaming and Racing. The winner will be notified in writingand their name and state/territory of residence will be published in the Public Notices section of The Australian newspaper on Friday 18 January 2013. The winner’s notification letter will include an assurance that the prize will be delivered within twenty eight (28) days of the presentation ceremony. If the prize winner resides in Victoria they will receive a certificate of ownership of the prize within twenty eight (28) days of the unclaimed prize draw.
Privacy statement
All entries will be the property of the Promoters. The information entrants provide will be used by the Promoters for the purpose of conducting this promotion and processing subscription purchases. The Promoters may disclose entrants’ personal information to their contractors and agents to assist in conducting this competition or communicating with entrants and to State and Territory gaming authorities and winners’ names may be published as required under the relevant legislation. The Promoters are bound by the National Privacy Principles in the Privacy Act 1988.
