Conditions of Entry
Information on how to participate and prizes form part of these Conditions of Entry. Entry for and/or participation in this Promotion is deemed acceptance of these Conditions of Entry.
The Promotion commences at 6.00 am AEST on 12/08/12 and closes at 5.00 pm AEDT on 12/10/12 ("Promotion Period").
Entry to the Promotion is only open to Australian residents aged 13 years of age and older ("Entrants"). Entrants under the age of 18 years must have the consent of each of their parents and/or legal guardians to enter this Promotion. Employees of the Promoter and the Promoter's suppliers and agencies associated with the Promotion (and those employees' immediate families) are ineligible.
How to Enter
To submit an entry, individuals must during the Promotion Period:
visit the Promotion Website located at
www.facebook.com/bonds; follow the instructions and links to the promotional page at the Promotion Website including by connecting to the "Bonds Shop For Your Shape" application on the Promotion Website and accepting the permissions requested to allow access to the requested Facebook profile information; and
nominate the style of Bonds underwear from one of the 8 ranges of Bonds underwear set out on the Promotion Website (their "Tribe") that they feel best represents them by clicking the "join" button for their Tribe.
Entrants may only enter the Promotion once per Facebook account. A person may only enter themselves, their own child or any other person from whom they have prior permission to submit an entry in this Promotion. Entrants are responsible for their own costs associated with accessing the Internet. All entries must be submitted by a person and any automated entries, fraudulent entries or entries by persons using an alias shall be invalid.
The Promoter reserves the right, at any time, to verify the validity of entries and Entrants and to disqualify any entries from, and prohibit further participation in this Promotion by, any person who tampers with or benefits from any tampering with the entry process or with the operation of the Promotion or acts in violation of these conditions, acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person, or who submits an entry that is not in accordance with the Conditions of Entry. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's decision in relation to all aspects of the Promotion is final and no correspondence will be entered into.
The Promoter accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction or otherwise. Entries are deemed to be received at the time of receipt into the Promoter's database and not at the time of transmission by the Entrant.
Prize
Each prize is "a drawer full of undies" consisting of a variety of Bonds underpants products for each winner and 5 friends up to a total value of AU$625.00 (including GST) each, depending on the style of Bonds underpants nominated by each winner.
The Bonds underpants products comprising each prize will be based on the style (which must consist of one of the 8 Tribe styles), colours and range of sizes nominated by each winner, and will be subject to availability.
The total prize pool is valued at up to $5,000 (including GST).
The prizes are not transferable or exchangeable and cannot be taken as cash.
25% off applies to RRP. Discount cannot be used on sale items, gift cards, or in conjunction with any other offer. Where available, facebook like discounts still apply. Offer expires at 11:59pm AEST 12/10/12. One use per customer. Only available for use at Bonds.com.au.
How the winner is determined
Entries will be divided into entry groups based on the Tribe selected by each entrant (Tribe Entry Pool).
A draw will be conducted in respect of each Tribe Entry Pool at 10.00am AEDT on Friday 19 October 2012 at With Collective, Level 4, 17-19 Alberta Street, Sydney 2000 NSW. The first valid entry randomly drawn from each Tribe Entry Pool will win the prize for that Tribe.
Unclaimed prizes
The Promoter may conduct such further draws as are necessary at With Collective, Level 4, 17-19 Alberta Street, Sydney 2000 NSW on Monday 21 January 2013 at 10.00am AEDT in order to distribute a prize if unclaimed by that date, subject however to any directions given by any gaming authority in Australia, where required.
All Entrants (other than the original prize winner) in the relevant Tribe Entry Pool will be eligible to win the unclaimed prize for their Tribe, as applicable. The first valid entry randomly drawn for a Tribe's unclaimed prize will win that prize.
Notification of winners
The winners of the prizes will be notified by email within 2 days of the draw, and the names of the winners of the prizes will be published in The Australian newspaper on Wednesday 24 October 2012.
In the event of any unclaimed prize draw, the unclaimed prize draw winner(s) will be notified by email within 2 days of the unclaimed prize draw, and the name(s) of the unclaimed prize draw winner(s) will be published in The Australian newspaper on Friday 1 February 2013.
Prize Delivery
Prizes will be delivered to the winner's address specified by the relevant winner at the time of claiming their prize.
Each winner is responsible for distributing the prize to their nominated friends (in the winner's absolute discretion). The Promoter accepts no liability for the distribution of any part of a prize to any winner's friends or otherwise.
The Promoter makes no representations or warranties as to the availability of any particular style, colour or size of Bonds underpants product nominated by any winner and the final composition of each prize is at the Promoter's discretion.
The prizes will be delivered within 6 weeks of the draw or unclaimed prize draw as the case may be. The Promoter and its associated agencies and companies will not be liable for any damage or delay in transit to prizes.
General
If for any reason this Promotion is not capable of running as planned, including but not limited to tampering, unauthorised intervention, fraud or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity, reputation or proper conduct of this Promotion, the Promoter reserve the right in its sole discretion, subject to any written directions given by the gaming authorities in each State and Territory, to cancel, terminate, modify or suspend the Promotion.
The Promoter and associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss, loss of profits, loss of opportunity or tax liability), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person's negligence) in connection with this Promotion or accepting or using any Incentive, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
The information ("Information") provided with an entry and an Entrant's Facebook profile images ("Images") will be used by the Promoter for the purpose of conducting this Promotion. The Information and Images may also be used by the Promoter for future marketing and promotional activities, including direct marketing. The Information and Images may also be used by the Promoter (at its discretion) on its website (
www.bonds.com.au) and Facebook Page (
www.Facebook.com/Bonds), in connection with this Promotion. The Information and Images may also be used by the Promoter's agencies associated with this Promotion. The Promoter may disclose Entrants' personal information to contractors and agents to assist in conducting this Promotion, to communicate with Entrants and to State and Territory gaming authorities. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988. While the Promoter has chosen to advertise this Promotion via Facebook, the Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. As such, Entrants fully release Facebook from any liability associated with the Promotion.
The laws of Australia apply to this Promotion to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of Australia.
