Information on how to enter and the prize form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
Entry is only
open to Australian residents aged 18 years or over. Individuals must have a valid Facebook account to be able to access the Facebook Page.
Employees (and their immediate families) of the Promoters and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
Promotion commences on 1st of October 2012 and ends at 11.59pm AEDST on 14th of October 2012 ("Promotional Period").
To enter, individuals must complete the following steps during the Promotional Period:
a) Visit the realestate.com.au Pty Ltd Facebook Page at
www.facebook.com/realestateAus (“Facebook Page”);
b) Become a fan of the Facebook Page by clicking the ‘like’ button (if not an existing fan of the Page);
c)
Click the 'Create Your Dream Home' application located on the Facebook Page and then follow the prompts on screen to create their virtual dream home (based on the options available on the website);d) Fully complete the online entry form, including their first and last name, date of birth, suburb, state, postcode, telephone number and valid email address;
e) Read and consent to the Terms and Conditions and tick the appropriate tick boxes (as featured on the entry form); and
f) Submit the fully completed online entry form so that it is received by 11.59pm AEDST on 14th of October 2012.
Only one entry permitted per person and per Facebook account.
The Promoters reserve the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoters’ discretion. Failure by the Promoters to enforce any of their rights at any stage does not constitute a waiver of those rights.
Incomplete or indecipherable entries will be deemed invalid.
If there is a dispute as to the identity of an entrant, the Promoters reserve the right, in their sole discretion, to determine the identity of the entrant.
1.The draw will take place at Anisimoff Legal, Level 5, 492 St Kilda Road, Melbourne VIC 3004, on Wednesday the 17th of October 2012 at 9:30am AEDST. The Promoters may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.
The winner will be notified in writing and via telephone and their name will be published in The Australian on 24th of October 2012.
The Promoters’ decision is final and no correspondence will be entered into.
The first valid entry drawn will win $10,000, awarded in the form of a cheque made out to the winner or deposited into the winner’s nominated account via electronic funds transfer (as per the winner’s preference).
Subject to the unclaimed prize draw clause, if for any reason the winner does not take the prize, then the prize will be forfeited.
Total prize pool value is $10,000.The prize, or any unused portion of the prize, is not transferable or exchangeable.
A draw for the prize, if unclaimed, may take place on 17th of January 2013 at the same time and place as the original draw, subject to any directions from a regulatory authority. The winner will be notified in writing and via telephone and their name will be published in The Australian on 24th of January 2013.
Each entrant acknowledges that realestate.com.au Pty Ltd provides the images on the Facebook Page to use solely for the purposes of creating the entrant’s virtual dream home, as contemplated on the Facebook Page. Each entrant acknowledges that all intellectual property in images provided on the Facebook Page and the Entrant’s virtual dream home shall be and will remain vested in realestate.com.au Pty Ltd (ABN 21 080 195 535). Entrants agree that the Promoters are entitled to use the entrant’s virtual dream home in any manner and for any purpose at their absolute discretion, including using the entrant’s virtual dream home for the Promoters’ promotional, marketing and publicity purposes (both in relation to this promotion and the Promoters products and services generally) without any further reference or payment or other compensation to the entrant, and further that the Promoters are entitled to amend, edit, select, crop, retouch, add to and/or delete from any part of the entrant’s virtual dream home (if using it for promotional/marketing purposes). Each entrant consents to any use of the entrant’s virtual dream home which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).
By entering this promotion, entrants consent to the Promoters using their name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoters.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoters, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoters reserve the right, in their sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
Any cost associated with accessing the Facebook Page is the entrant’s responsibility and is dependent on the Internet service provider used.
The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoters (including their respective officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoters (including their respective officers, employees and agents) are not responsible for and exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoters’ control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoters) due to any reason beyond the reasonable control of the Promoters; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize.
As a condition of accepting the prize, the winner must sign any legal documentation as and in the form required by the Promoters and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
The Promoters collect personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoters may, unless otherwise advised, send electronic messages or telephone the entrants in relation to this promotion and related purposes. Entrants should direct any request to opt out, access, update or correct information to the Promoters. All entries become the property of the Promoters.
Entry and continued participation in the promotion is dependent on entrants following and acting in accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at

The information an entrant provides will only be used for the purposes outlined in these Terms and Conditions.
