2.Claims are only open to Australian residents aged 18 years or over. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to claim.

Promotion commences 9:30am AEDST on 22/10/12. Claims close 09:30am AEDST on 30/11/12 or when stock runs out, whichever is first to occur (âPromotional Periodâ)
4.To claim, individuals must click on the âMoccona Samplingâ digital ad displayed on various websites, and complete the requested details within the in banner claim form, including their requested sample, full name, full address (including town/suburb, postcode and state), email address, confirm they accept the terms and conditions and confirm they are over the age of 18, during the Promotional Period. If the sample stock is exhausted, the claim functionality will be removed and a post stating that the offer is no longer available will be displayed.
5.The Promoter reserves the right, at any time, to verify the validity of claims and claimants (including a claimantâs identity, age and place of residence) and to disqualify any claimant who submits a claim that is not in accordance with these Terms and Conditions or who tampers with the claim process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
6.Incomplete, indecipherable or illegible claims will be deemed invalid.
7.Only one (1) sample sachet permitted per household.
8.Individuals are able to select to request one (1) sample flavour from either Caramel, Vanilla OR Hazelnut. If a particular flavour becomes exhausted, that flavour will be removed from the selection dropdown and individuals will no longer be able to request a sample of the exhausted flavour.
9.The Promoterâs decision is final and no correspondence will be entered into.
10.The first thirty-two thousand seven hundred and forty-five (32,745) valid and correct claims received will each be awarded a Moccona Sample Sachet of their selected flavour. There will be eight thousand four hundred and fifty-five (8,455) hazelnut flavoured sachets, fourteen thousand three hundred and ninety-five (14,395) caramel flavoured sachets and nine thousand eight hundred and ninety-five (9,895) vanilla flavoured sachets available. Valid claimants should allow up to 30 working days for receipt of their sample pack.
11.Claimants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the claimant must read and consent to all terms and conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to this Promotion.
12.If the gift is unavailable, the Promoter, in its discretion, reserves the right to substitute the gift with a gift to the equal value and/or specification, as appropriate.
13.Sample sachets are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
14.If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any claimant; or to modify, suspend, terminate or cancel the promotion, as appropriate.
15.Any cost associated with accessing the promotional website is the claimantâs responsibility and is dependent on the Internet service provider used.
16.Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (âNon-Excludable Guaranteesâ). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
17.Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoterâs control); (b) any theft, unauthorised access or third party interference; (c) any sample request that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in sample pack value to that stated in these Terms and Conditions; (e) any tax liability incurred by a claimant; or (f) use of a sample sachet.
18.The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, offer suppliers and as required, to Australian regulatory authorities. Claim is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the claimant. Claimants should direct any request to access, update or correct information to the Promoter. All claims become the property of the Promoter.
