1. The promoter of the Promotion is Fusion Retail Brands Pty Ltd ABN 44 151 836 083 of Level 1, 109 Burwood Road, Hawthorn VIC 3122, telephone (03) 9420 8000 (“Promoter”).
2. Information on how to enter, mechanics of entry and the Prize, form part of these Terms and Conditions. Entry into the Promotion constitutes acceptance of these Terms and Conditions. It is important that you read and understand these Terms and Conditions.
3. The Promotion commences at 12:01 am AEDT on 14 November 2012 and closes at midnight AEDT on 4 December 2012 (“Promotional Period”).
4. To be eligible to enter the Promotion, you
must be an Australian resident aged 18 years or over. The directors, management and employees (and their immediate families) of the Promoter, its related entities, printers, suppliers, providers and agencies whom are directly associated with the conduct of this Promotion are ineligible to enter.
5. To enter, you must, during the Promotional Period, correctly complete and successful submit the online entry form in the manner required (including providing your full name, current and valid email address and phone number), by either:
a. FACEBOOK ENTRY: (i) visiting the Colorado Facebook page at
www.facebook.com/coloradoshoes (“Colorado Page”); (ii) ‘liking’ the Colorado Page, if you have not already done so; and (iii) accessing the promotional application (“Application”) and following the prompts in the manner required;
OR
b. ONLINE ENTRY: (i) visiting
www.colorado.com.au (“Promotional Website”) and following the prompts in the manner required to access the online entry form.
6. Only one (1) entry per person permitted. Any subsequent entry after your first entry is received will be deemed invalid.
7. Entries will be deemed accepted at the time of receipt by the Promoter and not at the time of transmission. Entries received will be considered final by the Promoter. Incomplete, inaccurate, erroneous, ineligible or incomprehensible entries will be deemed invalid. The Promoter accepts no responsibility for late, lost or misdirected entries.
8. The draw to determine the winner will take place at 12:00 pm AEDT on 17 December 2012 at the Promoter’s premises. Winner will be notified in writing and their name and locality will be published on the Promotional Website on 21 December 2012. All reasonable steps to notify the winner will be taken by the Promoter. The Promoter’s decision is final and no correspondence will be entered into.

The first eligible entry randomly drawn from all entries received will win one AUD$5,000.00 Flight Centre Limited travel voucher (Prize). Prize is subject to prevailing terms and conditions of use and is not replaceable if lost, stolen or damaged. Prize valid for 12 months from the date of issue. Redemption of the Prize is subject to availability and may be dependent on travel class availability, specific room category availability and travel ‘blackout’ periods applying (including school holidays and public holidays). The Prize cannot be used in conjunction with travel discounts or special offers. Travel and accommodation (if applicable) are to be arranged by Flight Centre Limited or other licensed travel agent nominated by the Promoter.
10. Total maximum Prize pool value is AUD$5,000.00. The Prize is not transferable or exchangeable and cannot be taken as cash. The Prize must be taken as offered and cannot be varied. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. The Promoter accepts no responsibility for any variation in Prize value.
11. The Promoter may conduct a further draw at the same time and place as the original draw as is necessary on 18 March 2013 in order to distribute the Prize if unclaimed by that date, subject to any written directions given under applicable State or Territory legislation. In the event of any winner in the unclaimed prize draw, the winner will be notified in writing and their name and locality will be published on the Promotional Website on 25 March 2013. All reasonable steps to notify the winner will be taken by the Promoter. The Promoter’s decision is final and no correspondence will be entered into.
12. You may only enter in your own name. Entrants who provide incorrect, misleading or fraudulent information are ineligible to participate in the Promotion and all entries of an entrant who is deemed by the Promoter to have provided incorrect, misleading or fraudulent information may, at the discretion of the Promoter, be deemed invalid. The Promoter reserves the right to verify the validity of your entry or entries and to request that you produce (within the requested time) appropriate photo identification or other documentation in order to confirm your identity, eligibility to enter and claim the Prize, and any other information submitted you in entering the Promotion, before issuing a Prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or you or your entry has not been verified to the Promoter’s satisfaction then you and your entry/entries will be ineligible and deemed invalid. The Prize will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion.
13. It is a condition of accepting the Prize that the winner and their travel companion(s) (if any) may be required to sign a legal release/s in a form determined by the Promoter in its absolute discretion.
14. The Promoter may, subject to any written directions made under applicable State or Territory legislation, cancel, modify, suspend or delay the Promotion at any time if something happens that is beyond its reasonable control, including for any technical or operational reason or by reason of anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion. If the Prize becomes unavailable, for any reason beyond the Promoter’s reasonable control, then a comparable prize of equal or greater value will be awarded in lieu, subject to any written directions made under applicable State or Territory legislation.
15. The Promoter, its associated agencies and companies excludes all liability (including negligence) except for any liability that cannot be excluded by law, for any direct or indirect injury, loss and/or damage arising in any way out of the Promotion. This includes, but is not limited to: (i) technical malfunctions, delays or failures, including those resulting from accessing any materials related to this Promotion and any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this Promotion as a result of any technical malfunctions, delays or failures; (ii) theft, unauthorised access or third party interference; (iii) lost or damaged entries, Prize claims or Prizes; and/or (iv) acceptance and/or use of the Prize.
16. Use of Facebook generally is subject to the Facebook prevailing terms and conditions of use available at
www.facebook.com/policies. You acknowledge that the Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. You also understand that you are providing your information to the Promoter and not to Facebook. To the extent permitted by law, you agree to indemnify, defend and forever hold harmless, Facebook and its associated agencies and companies, against any and all losses, actions, claims, costs, expenses and damages (of any nature) which may be incurred by you in respect of your participation in the Promotion. Any questions, comments or complaints about this Promotion must be directed to the Promoter and not to Facebook.
17. Costs associated with accessing the Application, Colorado Page and/or the Promotional Website remain your responsibility and may vary depending on the Internet service provider used. Contact details entered incorrectly via the Application and/or the Promotional Website by you will deem your entry invalid.
18. The use of any automated entry software or any mechanical, electronic or other means that allows you to automatically enter repeatedly is prohibited and will render all entries submitted by you invalid.
19. The Promoter reserves the right to disqualify you for: (a) tampering with the entry process; (b) submitting an entry which is not in accordance with these Terms and Conditions; or (c) if you are engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Promotion. The Promoter’s legal rights to recover damages or other compensation from you are reserved.
20. Any attempt, deliberate or otherwise, to cause malicious damage or interference with the normal functioning of the Application, Colorado Page and/or the Promotional Website or the information on the Application, Colorado Page and/or the Promotional Website, or to otherwise undermine the legitimate operation of this Promotion may be a violation of criminal and civil laws and, should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these Terms and Conditions or any other legal obligation by you, you agree to indemnify the Promoter for those losses, damages and costs.
21. As a condition of entering this Promotion, you consent to, in the event you are the winner, the Promoter using your name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period of time without further notification, remuneration or compensation for the purpose of promoting, publicising or marketing the Promotion (including any outcome), and/or promoting any products or services manufactured, distributed and/or supplied by the Promoter. You agree that the Promoter may, in the event you are the winner, publish or cause to be published your name and locality in any media, as required under the relevant State or Territory lottery legislation. You also agree that, in the event you are the winner, you will participate in all reasonable promoted activities in relation to the Promotion as requested by the Promoter and its agents.
22. By entering the Promotion, you consent to the use of your personal information as set out in this Clause 22. The Promoter may collect and use personal information submitted by you for the purpose of conducting the Promotion. If the personal information requested is not provided, you cannot participate in the Promotion and are deemed ineligible. Personal information may be provided to third party organisations, including but not limited to agents, contractors and service providers that assist in maintaining the Colorado Page and the Promotional Website and/or conducting the Promotion, and, if required may be provided to Australian regulatory authorities. The Promoter may, for an indefinite period, unless otherwise advised, use the information to improve our goods and services and for promotional, marketing, publicity, research and profiling purposes, including contacting you in the future with marketing materials via any medium such as sending electronic messages or telephoning you. The Promoter may share information with its Australian related companies or promotional partners who may also contact you with marketing materials in this way. You can stop this information being used for this purpose by contacting the Promoter. All personal information will be stored at the office of the Promoter. A copy of the Promoter’s Privacy Policy in relation to the treatment of personal information collected can be found at the Promotional Website. To request access, update or correct information, or for any another privacy related questions, please contact the Promoter’s Privacy Officer on the contact details listed in Clause 1. All entries become the property of the Promoter.
