TERMS AND CONDITIONS
Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. Not valid in conjunction with any other Canon promotion.
There will be four components of this promotion. Entry is only open to Australian and New Zealand residents as follows:
(a) Gift card prize draw (“Gift Card Prize Draw”) – entry into the Gift Card Prize Draw component is open to both Australian and New Zealand residents;
(b) Canon Island trip prize instant win (“Canon Island Trip Prize Instant Win”) – entry into the Canon Island Trip Prize Instant Win component is only open to Australian residents;
(c) Canon Island trip prize draw (“Canon Island Trip Prize Draw”) - entry into the Canon Island Trip Prize Draw component is only open to New Zealand residents; and
(d) Canon Store exclusive Canon Island trip prize draw (”Canon Store Exclusive Canon Island Trip Prize Draw”) – entry into the Canon Store Exclusive Canon Island Trip Prize Draw is only open to Australian and New Zealand residents who also satisfy the additional eligibility criteria as per Clause 6. Employees (and their immediate families) of the Promoter, participating authorised resellers and agencies associated with this promotion are ineligible to enter.
Promotion commences at 5.00am AEDST or 7.00am NZDST on 01/11/2011 and closes at 5.00pm AEDST or 7.00pm NZDST on 16/01/2012 (“Promotional Period”).

Eligible Canon Store Entrants residing in Australia will be awarded one entry into the Canon Island Trip Prize Instant Win, one entry into the relevant Gift Card Prize Draw and one entry into the Canon Store Exclusive Prize Draw. Eligible Canon Store Entrants residing in New Zealand will be awarded one entry into the Canon Island Trip Prize Draw, one entry into the relevant Gift Card Prize Draw and one entry into the Canon Store Exclusive Prize Draw.
The Promoter reserves the right, at any time, to:
(a) verify the validity of entries including the eligibility of the Eligible Transaction;
(b) verify Australian Eligible Entrants, New Zealand Eligible Entrants and Eligible Canon Store Entrants (collectively referred to as “Eligible Entrants”) personal details (including their identity, age and place of residence); and
(c) disqualify any Eligible Entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry.
Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
Eligible Entrants must retain their original tax invoice(s) for all entries as proof of purchase and any warranty card material for proof of the Participating Product’s original distributorship. Failure to produce the required evidence of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of all of an Eligible Entrant’s entries and forfeiture of any right to a prize.
Multiple entries permitted, subject to the following: (a) only one entry permitted per specified purchase requirement; (b) each entry must be submitted separately and in accordance with entry requirements; and (c) a maximum of one entry per household per day is permitted.
Gift Card Prize Draws (Australian and New Zealand residents): The Promotional Period will contain seventy-seven calendar days, with each day commencing at 12.01am AEDST or 2.01am NZDST (except 01/11/2011 at 5.00am AEDST or 7.00am NZDST) and closing at 12.00am AEDST or 2.00am NZDST (except 16/01/2012 at 5.00pm AEDST or 7.00pm NZDST) (each, a “Promotional Day”). A total of seventy-seven Gift Card Prize Draws will be conducted for this promotion. Entries received during each Promotional Day will be entered into the Gift Card Prize Draw for that Promotional Day, which will take place on the following business day. Each Promotional Day will contain one Gift Card Prize Draw and three prizes will be drawn for each Promotional Day. Entries in each Gift Card Prize Draw will NOT be entered into any subsequent Gift Card Prize Draws. If no entries are received for a particular Gift Card Prize Draw then that prize will be awarded in the relevant unclaimed prize draw. All Gift Card Prize Draws will take place between 02/11/2011 and 17/01/2012 inclusive at 1.00pm AEDST at Canon Australia Pty Ltd of 1 Thomas Holt Drive, North Ryde NSW 2113. Gift Card Prize Draw winners will be notified in writing within two business days of the relevant Gift Card Prize Draw with instructions on how to claim their prize and a unique winning code (as per Clause 23).
The first three valid entries randomly drawn in each Gift Card Prize Draw will each win either an AUD$500 gift card or AUD$500 (for Australian Eligible Entrants) or a NZD$500 gift card or NZD$500 (for New Zealand Eligible Entrants) (“Gift Card Prize”). Winners who made an Eligible Transaction at the following authorised resellers: Harvey Norman; Camera House, Ted’s Cameras, Digital Camera Warehouse, JB Hi-Fi, Domayne; Bing Lee; The Good Guys; Dick Smith Electronics; Noel Lemmings; or Bond and Bond will each win a gift card to be used at the authorised reseller that the winner made their Eligible Transaction from. Winners who made an Eligible Transaction at any authorised reseller that is not listed above will win AUD$500 (for Australian Eligible Entrants) or NZD$500 (for New Zealand Eligible Entrants) to be awarded in the form of a cheque. There will be a total of two hundred and thirty-one Gift Card Prizes awarded.
Any ancillary costs associated with redeeming a Gift Card Prize are not included. Any unused balance of a Gift Card Prize will not be awarded as cash. Redemption of a Gift Card Prize is subject to any terms and conditions of the issuer including those specified on the Gift Card Prize.
Canon Island Trip Prize Draw (New Zealand residents): all entries received from New Zealand Eligible Entrants during the Promotional Period will be entered into the Canon Island Trip Prize Draw which will take place at 2.00pm AEDST or 4.00pm NZDST on 18/01/2012 at Pro-Logic Promotion Management, Unit 3, 52 Sunset Avenue, Barrack Heights, NSW, Australia 2528. Canon Island Trip Prize Draw winners will be notified in writing with instructions on how to claim their prize and a unique winning code (as per Clause 23). The first two valid entries randomly drawn in the Canon Island Trip Prize Draw will each win a Canon Island trip prize (“Canon Island Trip Prize”).
Canon Island Trip Prize Instant Win (Australian residents): all entries received from Australian Eligible Entrants during the Promotional Period will be awarded an instant win entry. Canon Island Trip Prize Instant Win winners will be notified immediately in writing online with instructions on how to claim their prize (as per Clause 23).
Canon Store Exclusive Canon Island Trip Prize Draw (Australian and New Zealand residents): all entries from Eligible Canon Store Entrants received during the Promotional Period will be entered into the Canon Store Exclusive Canon Island Trip Prize Draw which will take place at 2.30pm AEDST or 4.30pm NZDST on 18/01/2012 at Pro-Logic Promotion Management, Unit 3, 52 Sunset Avenue, Barrack Heights, NSW, Australia 2528. The Canon Store Exclusive Canon Island Trip Prize Draw winner will be notified in writing within two business days of the Canon Store Exclusive Canon Island Trip Draw with instructions on how to claim their prize and a unique winning code (as per Clause 23). The first valid entry randomly drawn in the Canon Store Exclusive Canon Island Trip Prize Draw will win a Canon Island Trip Prize.
There will be a total of fifty-seven Canon Island Trip Prizes awarded instantly to Australian Eligible Entrants during the Promotional Period. There will be a total of two Canon Island Trip Prizes awarded to New Zealand Eligible Entrants via the Canon Island Trip Prize Draw. There will be a total of one Canon Island Trip Prize awarded to Eligible Canon Store Entrants via the Canon Store Exclusive Canon Island Trip Prize Draw.
Each Canon Island Trip Prize includes a four-day trip for two people to one location within Australia (to be determined by the Promoter, in its absolute discretion) valued at up to AUD$12,000 (for Australian Eligible Entrants) or NZD$15,000 (for New Zealand Eligible Entrants) depending on date and location. Prize includes return economy airfares from the winner’s nearest Australian capital city or New Zealand airport to one location within Australia to be determined by the Promoter, in its absolute discretion, three nights minimum 3 star twin share accommodation and breakfast, lunch and dinner for two people for the duration of the trip and selected activities. Spending money, additional meals, taxes (excluding airline and airport taxes), insurance, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. Canon Island Trip Prizes must be taken on the 26/03/2012, or on a date stipulated by the Promoter, in its absolute discretion, subject to booking and flight availability.
During the entire duration of a Canon Island Trip Prize, a nominated parent/guardian must accompany any person under 18 years of age. Itinerary to be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of a Canon Island Trip Prize. Canon Island Trip Prizes are subject to the standard terms and conditions of individual prize and service providers. Winners may be required to present a credit card at time of accommodation check in.
If for any reason a winner does not take a Canon Island Trip Prize or an element of the Canon Island Trip Prize by the time stipulated by the Promoter, then the Prize or that element will be forfeited.
If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
All winners will have their names published on

www.canon.co.nz/winnersannouncement within fourteen days of winner notification and any winners who reside within Victoria, Australia will be published in The Australian on 10/02/2012. The Promoter’s decision is final and no correspondence will be entered into.
All winners (of any prize) must complete the prize claim process to receive their prize. To claim their prize, winners must access a prize claim website

All prize claims for Canon Island Trip Prizes must be received by 21/02/2012. All claims for Gift Card Prizes must be received by 5.00pm AEST or 7.00pm NZST on 24/04/2012. No responsibility will be accepted by the Promoter for late or misdirected prize claims.
Total prize pool value in Australia is up to AUD$811,500. Total prize pool value in New Zealand is up to NZD$160,500. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
A draw for any unclaimed Canon Island Trip Prizes may take place at 2.00pm AEDST or 4.00pm NZDST on 22/02/2012 at Pro-Logic Promotion Management, Unit 3, 52 Sunset Avenue, Barrack Heights, NSW, Australia 2528, subject to any directions from a regulatory authority. Eligible Entrants consent to the Promoter using the Eligible Entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Eligible Entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
Any cost associated with accessing any website connected with this promotion is an Eligible Entrant’s responsibility and is dependent on the Internet service provider or telecommunications provider used. The use of any automated entry software or any other mechanical or electronic means that allows an Eligible Entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that Eligible Entrant invalid.
Quality control errors will not invalidate an otherwise valid prize claim. Unless otherwise due to fraud or ineligibility under these Terms and Conditions, all prize claims in excess of the advertised prize pool will be honoured. Any Canon Island Trip Prize Instant Win prizes that are part of the advertised total prize pool will be awarded in the unclaimed prize draw. There will be a total of fifty-seven Canon Island Trip Prize Instant Win winning notifications produced for this promotion.
As a condition of accepting a Canon Island Trip Prize, the winners (and any companion/s) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
Winners of a Canon Island Trip Prize (“Activity”) and their companions acknowledge that the Activity may contain dangerous activities that may result in injury or death, and participate at their own risk. Winners and their companions must: (a) attend, undergo and pass any appropriate training, briefings, required medical tests and other requirements of the Promoter and Activity organisers as determined by them in their absolute discretion; (b) not have any heart condition or history thereof, or other medical conditions that would make it dangerous to participate in the Activity; (c) not be under the influence of drugs or alcohol; (d) comply with all directions of the Promoter and Activity organisers at all times; and (e) wear all safety and other equipment required. The Promoter and Activity organisers, in their absolute discretion, at all times reserve the right to: (a) prevent any winner or his/her companion from participating in the Activity if, at any time, they reasonably believe that the winner or his/her companion poses a safety risk or for any other reason; and/or (b) cancel the Activity if the conditions are deemed dangerous. If the Activity is varied for any reason beyond the control of the Promoter it may not be rescheduled and no compensation will be offered.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if any Canon Island Trip Prize is cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or Eligible Entrant; or (g) use of a prize.
The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, by the relevant regulatory authorities. Entry is conditional on providing this information. When joining MyCanon, Eligible Entrants may opt in to receive marketing and general information from the Promoter.
