The Everyday Rewards Summer Fruits Win a Sporty Kids Package Promotion is a promotion conducted under the Other Benefits component of the Everyday Rewards Program.

1. Information on how to enter the Promotion and a description of the prizes that may be won in the Promotion form part of these Terms & Conditions of Entry. Participation in the Promotion constitutes acceptance of these Terms & Conditions of Entry. Entries not complying with these Terms & Conditions of Entry are ineligible and the Promoter reserves its absolute right to disqualify any Cardholder from the Promotion if any entries do not comply with these Terms & Conditions of Entry.

2. The Promotion is open to all members who have registered for the Everyday Rewards Program. Entry into the Promotion is free.  Directors, management and employees of Salmat Digital Pty Ltd and its agencies directly associated with this Promotion are ineligible to enter. These Terms & Conditions of Entry will be displayed on www.everydayrewards.com.au and available at each participating store at the commencement of the Promotion.

3. Definitions within this Promotion:
Card - means an Everyday Rewards Card issued by the Promoter as part of the Everyday Rewards Program
Cardholder - means a person who holds an Everyday Rewards Card, and who is Registered according to the Everyday Rewards Program database. 
Participating <store/s> - means any Woolworths and Safeway stores across Australia(excluding Tasmania) promoting the Everyday Rewards program.
Promotion - means the Everyday Rewards Summer Fruits Win a Sporty Kids Package promotion governed by these Terms & Conditions of Entry and conducted as a promotion under the Other Benefits component of the Everyday Rewards Program.
Promotional Period - means 00:01am AEDST on Monday 28 January 2013 to 23:59 AEDST on Sunday 24 February 2013.
Promoter - The Promoter and Permit holder is Woolworths Limited ABN 88 000 014 675 of 1 Woolworths Way, Bella Vista, NSW, 2153
Registered - means that all mandatory Cardholder information has been correctly completed in the legal name of the Cardholder, according to the Everyday Rewards database.

4. The Promotion commences 00:01am AEDST on Monday 28 January 2013 to 23:59 AEDST on Sunday
   24 February 2013 (“Promotional period”).

5. To enter the Promotion, spend $5 or more in one transaction on any nectarines, plums and peaches during the promotional period from a participating store and present your registered Everyday Rewards card prior to finalising the transaction. One entry will be recorded for each purchase transaction.
6.  The Prize winners will be determined by an automated random draw of all valid entries. The Prize draws will take place at 10:00am AEDST on Monday 4th March 2013. The prize draw will take place at Salmat Digital Pty Ltd, Level 2, 116 Miller Street, North Sydney, NSW 2060

7.   Breaking a single transaction into multiple amounts for use with one or more Cards is not permitted, and will void all Promotional entries attributed to such Cardholders.

8.    The first 100 valid entries randomly drawn will be the winners. The Prize winners will be contacted by phone within 2 days of the draw and in writing within 7 days of the draw. Winners first initial, surname and state will be published on www.everydayrewards.com.au on Wednesday 6 March 2013. If any winning entry is invalid, that entry will be discarded and the prize will be awarded by randomly drawing another entry in accordance with these Terms and Conditions of entry.

9.  Each prize comprises of a Sporty Kids Package and includes a cricket set, soccer ball, football, frisbee, 2 x t-shirts, 2 x caps and 2 x drink bottles and is valued at $100.00. The total prize pool is valued at $10,000. Prize is not transferable     or exchangeable and cannot be redeemed for cash.

10. If a winner does not claim their prize within 3 months from the date of determination of that winner, their entry will be deemed invalid and the Promoter may conduct such further draws at the same place as the original draws as are necessary subject to regulatory authority. The unclaimed prize draw will take place at 10:00am AESTon Monday 29 May 2013 at Salmat Digital Pty Ltd, Level 2, 116 Miller Street, North Sydney NSW 2060. If in the case of an unclaimed prize draw. The prize winners will be contacted by phone within 2 days of the draw and in writing within 7 days of the draw. Winners names and state will be published on www.everydayrewards.com.au  Thursday 6 June 2013.

11. The Promoter accepts no responsibility for any tax implications that may arise from winning of the prizes.  Independent financial advice should be sought.

12. The Promoter reserves the right to disqualify all entries from any Cardholder who is in breach of the Terms & Conditions of Entry or the Terms and Conditions of the Everyday Rewards Program or who manipulates, seeks to manipulate or benefits from manipulating, the entry process or the Promotion.

13. The Promoter and its agencies and companies associated with this Promotion will not be liable for any loss (including but not limited to indirect or consequential loss), damage or personal injury which is suffered or sustained (including without limitation to that caused by any person's negligence) relating to the Promotion or the awarding or taking of the prizes except for any liability which cannot be excluded by law (in which case liability is limited to the minimum amount allowable by law).

14. The Promoter may use any personal information that a Cardholder has provided to it as part of the Everyday Rewards Program for the purpose of running the Promotion, and also in advertisements, publications, media statements and other promotional material associated with the Promotion. For purposes of public statements and advertisements the Promoter will only publish the winner’s first initial, surname and state.  The Promoter may disclose the information for those purposes to its related bodies corporate and contractors. Unless the Cardholder has opted-out of communication within their Registration, the Promoter may use personal information a Cardholder has provided to send the Cardholder information about Woolworths' products and services (including via electronic means), and may disclose the information to its related bodies corporate, agencies and contractors (including call centers, advertising agencies and direct mail houses) the Promoter engages for that purpose.  In most cases you can gain access to your personal information by contacting the General Manager Corporate Services, Woolworths Limited, PO Box Q70, QVB, Post Shop Sydney 1230 or phone the Woolworths  Privacy Helpline  on 1300 134 802.  The Promoter is bound by the National Privacy Principles contained in the Privacy Act (Cth) 1988.  A copy of the Promoter's privacy policy can be viewed at the Website.  To update, personal information the Promoter holds about them, entrants can contact the Promoter at www.everydayrewards.com.au or in writing at Everyday Rewards, PO Box 8000, Baulkham Hills NSW 2153.

15. In the event there is a dispute concerning the conduct of the Promotion, the decision of the Promoter is final and no correspondence will be entered into.
