Terms and Conditions of Entry
Information on how to enter this competition and prize details form part of these conditions of entry. By submitting a registration, entrants accept these conditions of entry.
The Promoter is HSR Group Pty Ltd of PO Box 41, Wondai, QLD, 4606, ABN 44 121 286 922.
Entry is only open to Australian residents aged 18 years or older. Employees of the Promoter, of participating retail outlets and of the agencies associated with this promotion (including the immediate family members of those employees) are ineligible to enter.
The promotion commences 12am AEST on or by 01 August 2012 and closes 12am AEST on or by 31st March 2013.
To enter and be eligible to receive the prize, an Eligible Entrant must, during the Promotion Period fully complete and submit the online registration form with entrant’s name, business or farm name, Postal address, phone number, email address, product purchased and number of bags, retailer product was purchased from, and relevant invoice number. The registration form may be accessed by clicking on the link provided in an email from HSR or via the web address or via HSR Seeds Facebook page. Once all of the fields in the registration form have been answered, the Eligible Entrant must click on the "submit" button in order to submit the form to HSR. An email in response to the submitted entry should be received by the entrant. The promoter accepts no responsibility for late, lost, incomplete, illegible or misdirected entries.
Only HSR Seed purchases with invoices dated from 01 July 2012 to 31 March 2013 before 12am AEST will be eligible to use as an entry.
When an entry is received by HSR, for each 5 bags of seed recorded, one entry will be submitted into the prize draw for that entrant.
This is a game of chance and skill plays no part in determining the winner.
Incomplete, indecipherable, or illegible entries will be deemed invalid.
Entries submitted in conjunction with any other promotion of the Promoter will be invalid.
The Promoter accepts no responsibility for late entries or entries not received for any reason. Entries will be deemed to be accepted at the time of receipt and not at the time of transmission. No responsibility will be taken for lost, late or misdirected entries. The Promoter is not responsible for technical difficulties with the entry mechanism and does not warrant that the entry mechanism will be available at all times.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of work) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions of Entry or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
The Promoter's decision in relation to any aspect of the Promotion is final and binding on each person who enters and no correspondence will be entered into.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
The first entrant’s name drawn will win the AUD$5000 cash prize. There is only one prize draw and prize to be awarded. The draw will take place at HSR Seeds Head Office, Wondai, QLD, 4606 on Monday, 1st April, 2013, in the presence of a Justice of the Peace.
Prize value is in Australian Dollars.
The winner will be notified by email and phonecall within 72 hours from the draw, and the prize will be presented using the details provided by them after contact.
The winner will be presented with a cheque at the Retailer’s Premises where the product purchase was made, at a time agreed on by the Promoter and Prize winner. Any photographs taken of the prize presentation remain the property of the Promoter and will be able to be used for editorial and promotional content.
In the event that any Prize has not been claimed by 01 May 2013, the Promoter reserves the right to select another winner, subject to any written directions given by the relevant State or Territory lotteries department.
Total value of the prize is AUD$5000 including GST.
In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion, subject to any written directions from a relevant regulatory authority.
Any ancillary costs associated with redeeming the prize are not included.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to (a) disqualify any entrant; and/or (b) subject to any written directions from a State or Territory lotteries department, to modify, suspend, terminate or cancel the promotion, as appropriate.
Any cost associated with accessing the Promoter’s website is the entrant’s responsibility and is dependent on the Internet service provider used.
Liability for any tax (other than FBT) arising out of participation in this promotion (including acceptance of a prize or reward) is the sole responsibility of the entrant. Entrants should seek independent financial advice in this regard.
To the extent permitted by law, the Promoter will not be liable for any loss or damage whatsoever (including but not limited to indirect or consequential loss) or personal injury suffered or sustained in connection with this Promotion or as a result of accepting the prize.
All entries become the property of the Promoter. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize/reward suppliers and as required, to Australian regulatory authorities. Entry is conditional on providing this information. All entries will be entered into a database and the Promoter may use the information for promotional, marketing or publicity purposes including sending electronic messages unless otherwise advised by the entrant by calling the Promoter on 07 4169 0011. Entrants can request access to or correction of their details by contacting the Promoter on 07 4169 0011. Entrants should direct any request to access, update or correct information to the Promoter.
The laws of Australia apply to this promotion to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of Australia for Australian residents.
