COMPETITION
TERMS AND CONDITIONS1.
Instructions on “How to Enter” form part of these Terms and Conditions. Participation in this competition is deemed acceptance of these Terms and Conditions.
2.
The competition is open to all residents of Australia aged 13 years and over except employees of the Promoter, their immediate families and agencies associated with this competition.
3.
The competition commences at 10:00am AEDST on 18 February 2013
and closes 31 March 2013 at 23:59pm AEDST (“Competition Period”).4.
Entry is online. To enter, individuals must during the Competition Period:
(a) Visit
http://www.australiscosmetics.com.au/win and follow the prompts to enter the competition, provide your full name, email address, phone number, date of birth, street address, suburb, state, postcode and provide a creative response to the question: " FACT: Australis Cosmetics Foundations are all under $20. Tell us in 25 words or less, with the extra money you'll save on Foundations, what would you spend it on and why?".
Submit your completed entry as instructed.
(b) The one (1) best and most creative response from eligible participants, as judged by the Promoter will win the major prize.
5.
The Promoter reserve the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age, and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
6.
Incomplete, indecipherable, or illegible entries will be deemed invalid and will not be included in the competition.
7.
Multiple entries per person are permitted provided that (i) each entry submitted is a substantially unique entry; and (ii) each entry is submitted separately and in accordance with entry requirements.8.
This is a game of skill; chance plays no part in determining the winner. Each entry will be individually judged based on its literary and creative merit of the answer to the question provided. The judges’ decision in relation to any aspect of the competition will be final and binding on every person who enters. No correspondence will be entered into.
9.
The entrant warrants to the Promoter that the entry submitted is an original artistic work of the entrant that does not infringe the rights of any third parties. The entrant agrees to indemnify the Promoter against all claims and costs by third parties arising from a breach of the warranty set out in this condition.
10.
The Promoter is entitled to use any of the entries submitted in any manner and for any purpose at its absolute discretion, including using the entries for future promotions or their agents’ book publications, promotional, marketing and publicity purposes without any further reference or payment or other compensation to the entrant. The Promoter is entitled to amend, edit, select, crop, retouch, add to or delete from any part of the submitted entry.
11.
Entries must not be offensive, defamatory or racist. Any entry which the judges deem inappropriate will be invalid. The entrant agrees to indemnify the Promoter in relation to his/her entry.
12.
Judging will begin on 4 April 2013 at the Promoter’s premises, Heritage Brands (Australia) Pty Ltd, 30 Bando Road, Springvale, Victoria, 3171, Australia. This competition will be judged by a panel of judges appointed by the Promoter.
All valid Entries will be assessed in the judging process. Judges will judge each En try based on the following criteria (weighted according to the accompanying percentage): (i) creativity (40%); (ii) product marketability (40%); and (iii)
originality (20%). Winners will be notified by email only using the contact details provided in their entry.
13.
There will be one (1) winner in total. The winner will win one (1) each of the items outlined below. Total prize valued at AUD $2172.35 inc GST.

The Promoter may review further entries, at the same place as the original judging is held, as are necessary on 25 April 2013, in order to distribute any prize unclaimed by that date, subject however to any written directions given under Reg 37 of the Lottery and Gaming Regulations 1993 (SA).

Entries will be deemed to be accepted at the time of receipt and not at the time of transmission.
17.
The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, (including but not limited to) any injury or damage to participants or any other person’s computer related to or resulting from participation in or downloading any materials in this competition.
18.
Any costs associated with accessing
http://www.australiscosmetics.com.au/win is the entrant’s
responsibility and is dependent on the Internet service provider used.
19.
Prize must be taken as offered. The prize, or any unused portion of the prize, is not exchangeable or cannot be redeemed as cash. The prize cannot be used in conjunction with any other special offer. The prize is valued in Australian dollars and is based on recommended retail process at the time of printing. The Promoter accepts no responsibility for any variation in the prize value. Prize winner is advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize.
20.
If the prize or portion of the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State Regulation.
21.
Prize winners must provide a valid street delivery address. The Promoter will make all reasonable efforts to deliver the prizes to the delivery addresses provided. The Promoter cannot guarantee that any prizes returned to the Promoter due to non-delivery at the provided address will be re-sent to the prize winner. The Promoter and its associated agencies, and companies associated with this competition will take no responsibility for prizes damaged or
lost in transit.
22.
The Promoter reserves the right to request winners or their parent or legal guardian to sign a winner’s deed of release or any other relevant forms or agreements that the Promoter deems necessary, to verify proof of identity, proof of age, proof of residency at the nominated prize delivery address in order to claim a prize. Proof of identification, residency, age and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner or their parent or legal guardian cannot provide suitable proof, the winner will forfeit the
prize in whole and no substitute will be offered.
23.
In the event of war, terrorism, state of emergency or disaster, the Promoter reserve the right (subject to all relevant
state and territory regulations and including but not limited to natural disaster) to either provide an alternative prize to the same value as the original prize or to cancel, terminate, modify or suspend the competition.
24.
In the event that for any reason whatsoever the winner does not take all elements of the prize at the time stipulated by the Promoter, then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.
25.
If for any reason this competition is not capable of running as planned (including but not limited to) infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupts or affect the administration security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and, subject to any written directions given by the various lottery departments, to cancel, terminate, modify or suspend the competition.
26.
Except for any liability that cannot be excluded by law, the Promoter (including its officers,employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Competition, including, but not limited to, where arising out of the following:
(a) any technical difficulties or equipment malfunction (whether or
not under the Promoter control);
(b) any theft, unauthorized access or third party interference;
(c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
(d) any variation in prize value to that stated in these Terms and Conditions;
(e) any tax liability incurred by a winner or entrant;
(f) redemption or use of the prizes.

27.
All entries become the property of the Promoter and your entry will not be returned to you at the end of the competition. You agree that all of the rights including all intellectual property rights in your entry, belong to the Promoter and you assign all rights you may have to the Promoter upon you sending an entry. You agree to do all things which may include signing documents to effect the transfer of these rights to the Promoter. You consent to the Promoter doing anything or omitting to do anything that infringes your moral rights in your entry including
your right to be attributed as the author of your entry, the right not to have your authorship in the entry falsely attributed and the right of integrity of authorship.
28.
You may not disclose your entry to anyone other than the Promoter. You may only use your entry to participate in this competition. You may keep a copy of your entry for your personal records.
29.
By entering the competition, the entrant consents to receipt of any email regarding the competition, and other emails which inform the entrant of the Promoter other publications, products, services and events and to promote third party goods and services it may be interested in.
30.

These Terms and Conditions constitute the entire agreement between you and the Promoter with respect to this competition. These Terms and Conditions are governed by the laws of the State of Victoria, Australia.

To obtain a copy of these Terms and Conditions or for notification of the winners, send a self-addressed stamped envelope to the Promoter. Please specify whether you are requesting a copy of these Terms and Conditions or a winner’s list and the name of the competition. Requests for winners' lists must be received no later than three (3) months after the end of the Competition Period.
