World For Kids Pty Ltd Terms and Conditions

The terms and conditions of sale below apply to all purchases of World For Kids Pty Ltd products.

By placing an order with us you will be deemed to have read, understood and agreed to these Terms and Conditions. If you need any clarification on anything within these Terms and Conditions then please contact us at info@fastcarbeds.com.au or on (02) 9897 1500 prior to placing an order. Nothing in these conditions affects your statutory rights as a consumer.

We, and similar expressions, refer to World For Kids Pty Ltd (ACN 158 303 845). You, and similar expressions, refer to you, our customer or proposed customer.

PAYMENT
Full payment by either cash or credit is required prior to delivery of the products.
Company or personal cheques will not be accepted. You are responsible for any costs incurred in arranging payment for the goods e.g. bank transfer fees and related charges.

RISK AND TITLE
All risk and title in World For Kids Pty Ltd products passes on receipt of full payment of the products by you.

DELIVERY
You are liable for payment of all delivery charges, including any additional charges incurred as a result of difficulties with access. You must ensure correct delivery address details are provided to us and notify us in advance if there will be difficulties accessing the delivery address (e.g. staircases or narrow passages). We will use reasonable endeavors to meet the estimated delivery date.

If we do not meet the estimated delivery date for any reason, our liability will be limited, at our option, to resupplying the goods at a different time or at a maximum, to the refund of the purchase price. Products will only be delivered if a person aged over 18 years and able to accept delivery is at the delivery address.

World For Kids Pty Ltd will deliver to the front door only. If you require the furniture to be delivered beyond the front door into the house, World For Kids Pty Ltd will do so providing you accept the following terms:
*That you provide as much detail as possible when placing your order, including exact address and delivery details including floor level and access requirements.
* That it is your sole responsibility to ensure that there is adequate space and access to receive the furniture.
*That the premises are safe for our driver to deliver to.
*That World For Kids Pty Ltd accepts no responsibility for any damage to your property caused by the delivery.
*That if you are in doubt regarding potential damage that may occur as a result of the delivery that you will ask the delivery men to leave the furniture by the front door rather than risk damage to the property or furniture.
*That if there are any physical obstructions to overcome there may be an extra charge for delivery.
* The customer will be deemed to have accepted the furniture and agreed that it is as ordered unless World For Kids Pty Ltd is notified in writing within five days of delivery.
*That if delivery is required up stairs or in an elevator that World For Kids Pty Ltd will require the buyer to provide assistance with the transportation of the furniture within the house, complex, building. At no time will our driver be responsible to take any items up stairs or an elevator without adequate help from the buyer. Our Insurance ceases at the kerb.
INSTALLATION
We recommend professional installation of our products. The purchaser agrees to bear the full liability if any damages occur during installation. Any claims for damages occurring from installation will not be refunded or exchanged. At the discretion of World For Kids Pty Ltd, we may offer you a rebate price on replacement parts.

LED LIGHTING AND SOUND
The car bed you purchase may be supplied with LED lighting and sound. These are operated by remote control. Care is required when assembling your car bed and World For Kids Pty Ltd recommends professional installation of your car bed.

World For Kids Pty Ltd makes no warranties with respect to lighting and sounds which have been subjected to misuse, accident, or maintenance, repairs or alterations made by anyone other than World For Kids Pty Ltd.

World For Kids Pty Ltd will, at our discretion, replace power boxes, leads, remotes and any other parts required when items are faulty from the factory. Directions will be given as to the appropriate method of installing replacement parts and it is at the buyer’s liability to install these parts.

VARIATIONS AND SPECIFICATIONS
Your product may exhibit different characteristics to the sample of showroom furniture. Furniture may vary in appearance and characteristics such as creasing and the degree of softness. We reserve the right to change dimensions, design and construction and to pattern match fabrics according to our best judgment without prior notice.

CUSTOMER GUARANTEES
The following only applies if you are a deemed "consumer" under the Australian Consumer Law and may not apply in your particular case. In telling you the following, we do not vary or extend the remedies otherwise available to you.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure

If there is a defect in your World For Kids product that appears within the first 12 months, we will do the following:

1.If a product has a minor defect, we will, at our option, repair it or offer you a replacement. A replacement part will be required to be installed by the buyer or at the buyers expense if needed.

2.At time of delivery, f a product has a major defect, you are entitled to:
  •reject the goods and receive a refund; or
  •reject the goods and receive an identical replacement, or one of similar value if reasonably available; or
  •keep the goods and receive compensation for the drop in value caused by the defect.

To the full extent permitted by law, the maximum aggregate liability of World For Kids for any breach of a condition, guarantee or warranty whether implied by law or otherwise (including the Australian Customer Law), is limited to the amount payable by you to us in respect of the product giving rise to the liability.

In addition to the rights and remedies you may have available under the Australia Customer Law or any other law that applies to the goods or services that you have purchased from World For Kids, you may also be entitled to additional benefits under the terms of any additional Extended Warranty that comes with your Product.

In order to submit a claim for a defective product, you will need to (at your own expense) contact World For Kids Customer Service on (02) 9897 1500 and send notice in writing to Fast Car Beds at PO Box 50, Regents Park, NSW, 2143, or by email at info@fastcarbeds.com.au with details of your name, address, telephone number, World For Kids product details, and details of the defect claimed including images of defects.

INTELLECTUAL PROPERTY
You acknowledge that at all times all intellectual property including, but not limited to, designs, techniques, methods of manufacture, photographs, specifications, artwork, text, patented inventions and registered designs remain the property of World For Kids Pty Ltd.

The customer will not knowingly allow any intellectual property belonging World For Kids Pty Ltd to be reverse engineered, pirated or copied or breached in any other manner. World For Kids Pty Ltd may be entitled to compensation for any loss of royalties, damages and/or costs arising from the breach of World For Kids Pty Ltd intellectual property rights.

PRIVACY
We may collect personal information in connection with our dealings with you. If so, we will abide by our privacy policy, a copy of which is available on request.

GENERAL
If any part of these terms and conditions is found to be void, invalid or otherwise unenforceable, then that part will be deemed to be superseded by a valid, enforceable provision that matches the intent of the original provision as closely as possible. The remainder of these terms and conditions continues to be enforceable and valid.

GOVERNING LAW
These terms and conditions will be governed by and construed in accordance with the laws of the State or Territory in Australia where the products are purchased.
