Terms and Conditions
The promoter is Sportsbet Pty Ltd ABN 87 088 326 612, a company incorporated in Australia under the Corporations Act 2001 (Cth). 'Sportsbet.com.au' (“Promoter”).
This Promotion commences at 3pm (AEDST) on Friday 1 March 2013 and ends at 11.59pm (AEDST) on Wednesday 13 March 2013 (“Promotion Period”).
Information on how to enter and the Prize forms part of these terms and conditions (“Terms”). Participation in this Promotion is deemed acceptance of these Terms.
This Promotion is open to all entrants who:
are over 18 years of age;
are residents of either New South Wales or Queensland;
are able and willing to travel to Manly on 16 March 2013 and attend the Newcastle Knights v Manly Warringah Sea Eagles NRL match at Brookvale Oval on that date; and
are not management, employees or agents of Sportsbet or its related entities (or immediate family members of such people) or of retailers and agencies associated with this Promotion, (“Eligible Entrants”).
To enter, Eligible Entrants must during the Promotion Period log on to promotions.sportsbet.com.au/knightsvip and follow the competition steps:
Provide their answer in writing or upload their YouTube link to the following question: ‘Why do you deserve to join the Knights for their Round 2 clash in Manly?’ in 25 words or less (collectively, the “Entry Criteria”). Any posts left on the Promoter’s Facebook timeline will not satisfy the Entry Criteria and will not count as an entry.
The Promoter may remove any Content that does not comply with these Terms and Conditions. Entrants warrant and agree that:
they will not submit, produce, share or distribute any Content that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 18 or otherwise unsuitable for publication;
they will obtain prior consent from any person in respect of that person or their property that appears in their Content;
they will obtain full prior consent from any person who has jointly created or has any rights in the Content, to the uses and terms herein;
their Content shall not contain viruses or cause injury or harm to any person or entity;
they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems; and
the Promoter reserve the right to disqualify any entrant who submits or uploads any material that does not comply with these Terms and Conditions.
Any entrant whose Sportsbet.com.au account is closed or suspended during the Promotional Period will have his or her entry forfeited.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms or who tampers with the entry process. If a dispute arises as to the identity of an entrant, the Promoter reserves the right to determine the identity of that entrant.
Incomplete, indecipherable or illegible entries will be deemed invalid.
There is a limit of one (1) entry per person.
All valid video and comment entries will be judged by Sportsbet’s team on Thursday 14 March 2013 at Level 4, 241 Castlereagh Street, Sydney, NSW 2000.
The winner will be the video or comment that Sportsbet’s judges consider to be the most entertaining (based on humour, creativity and originality). The judges may also determine the next best entry for use in the event that the original winner is unable to be contacted or is ineligible or unavailable to win the Prize.
There will only be one winner of this Promotion.
The winner will receive the following:
An invitation to watch the Newcastle Knights’ final training session in Newcastle at Hunter Stadium before their match against the Sea Eagles on 17 March 2013 at Brookvale Oval (“Match”), and enjoy a BBQ with the team after training;
Free return car travel between Hunter Stadium in Newcastle and Brookvale Oval in Manly on 17 March 2013 with Club CEO Matt Gidley;
An invitation to attend the Knights’ dinner on the night before the Match;
One (1) night’s accommodation for the winner and one (1) guest, on 16th March 2013, in the same hotel as the Knights;
A Knights jersey signed by the team;
Access to the warm-up area at Brookvale Oval to watch the team warm up before the Match;
One (1) ticket to watch the Match from pitch side seats; and
Access to the Knights’ changing rooms after the Match, (the “Prize”).
The total Prize pool is valued up to $3,000. If any part of the Prize is unavailable, the Promoter reserves the right to substitute it with a prize of equal value and/or specification, subject to any written directions from a regulatory authority.
All of the activities mentioned in section 15 will be supervised and should the winner’s behaviour be deemed inappropriate by either the Newcastle Knights or Sportsbet’s management (“Management”) the winner will forfeit the Prize (or part thereof).
The winner will be required to wear Sportsbet clothing and/or merchandise, as directed by Sportsbet, at all public activities described in section 15.
The winner will be notified by email and telephone on Thursday 13 March 2013, and the winner’s name will be published on the Newcastle Knights website.
The Promoter will use all reasonable efforts to contact the winner, but if the winner cannot be contacted by 12.00pm (AEDST) on Wednesday 13 March 2013, the Prize will be awarded to the next best entry (judged in the same manner as the original winner). The substitute winner will be notified by email and telephone on Friday 15 March 2013.
By entering the Promotion all entrants consent to the use by Sportsbet of their name, image, likeness, username, initials, and/or their comment or video entry, for publicity and commercial purposes in connection with the Promotion and/or the Promoter’s products and services, in any media and for an infinite period, without further compensation. This includes but is not limited to use on TV, Facebook, YouTube, radio, print, display advertising, the Promoter’s Betterbet Blog and website.
The Prize (or any part thereof) is not transferable or redeemable for cash.
General:
This Promotion is only intended for entrants who act at all times in good faith, sincerely, without fraud, and who place bets with Sportsbet for the purpose of recreation and entertainment.
Professional gamblers or other gamblers considered by Management to be abusing this Promotion may have their right to participate in this Promotion revoked.
The Promoter reserves the right to cancel or change this Promotion at any time during or before the Promotional Period without notice, subject to regulatory authority.
The decisions of Management regarding the Promotion are final. No correspondence will be entered into.
Entry to the Promotion is free, but entrants are responsible for any costs imposed by their internet service or other technology providers.
The Promoter may prohibit an entrant’s participation in this Promotion, cancel or suspend the Prize (or part thereof) if the Promoter considers that the entrant behaves in a way which may diminish their name or reputation, or is contrary to law, these Terms or is otherwise inappropriate.
Errors and omissions may be accepted at the Promoter’s discretion.
Failure by the Promoter to enforce any of their rights does not constitute a waiver of those rights.
The Promoter accept no responsibility for any tax implications that may arise from the Prize. Independent financial advice should be sought. Where the operation of this Promotion results in, for GST purposes, supplies being made for non-monetary consideration, entrants agree to follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.
If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable the Promoters control, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion.
As a condition of the Promotion, the winner may be required to sign legal documentation that the Promoter and/or the Prize suppliers deem necessary.
The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, Prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use entrants’ information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning entrants. Entrants should direct any request to opt out, access, update or correct information to the Promoter.
All entries become the property of The Promoter.
To the fullest extent permitted by law, the Promoter (and the Prize suppliers) will not be liable for any loss or damage an entrant or winner suffers as a result of participating in this Promotion (including the Prize), unless caused by the Promoter’s gross negligence or wilful misconduct.
Facebook Acknowledgements:
Participation in this Promotion is considered acceptance of the following:
a complete release of Facebook by any entrant or participant;
an acknowledgement that this Promotion is in no way sponsored, endorsed or administered by, or associated with Facebook; and
that the information provided by each entrant is provided the Promoter (as detailed in these Terms and Conditions) and not to Facebook.
Participation and entry in this Promotion is conditional upon the entrant complying with all rules, regulations and guidelines set down by Facebook
