The Promoter is Nissan Motor Co. (Australia) Pty. Ltd., 260-284 Frankston-Dandenong Road, Dandenong South, Victoria, 3175, ABN 54 004 663 156 (Nissan).
Information on how to enter, prizes, and, other details contained within promotional material form part of these terms and conditions. Entry into the competition shall be deemed an acknowledgement and acceptance of these terms and conditions.
Entries not completed in accordance with these terms and conditions are invalid.
To be eligible to enter, you must be an Australian resident aged 18 years or above who is the proprietor of a mechanical or panel workshop with a valid ABN, and you must register to participate by completing the registration form online at www.thefuelagency.com.au/nissanpromo (Registered Participant). Registered Participants will receive one entry into the promotion draw for every $200.00 (excl. GST) of Nissan Genuine Parts purchased on a single invoice from an authorised Nissan Dealer. The number of entries granted per invoice will be rounded down to the nearest $200.00. To complete the entry, Registered Participants must then record their purchases of Nissan Genuine Parts on the competition website.
Registered Participants who are members of the GetGenuine GetRewards® program will receive one additional entry into the promotion draw for every $200.00 (exc GST) of Nissan Genuine Parts purchased on a single invoice from an authorised Nissan Dealer. The number of entries granted per invoice will be rounded down to the nearest $200.00.To complete the entry, Registered Participants must then record their purchases of Nissan Genuine Parts on the competition website.
Employees and immediate families of the Promoter, associated companies and agencies are ineligible to enter.
This promotion applies to sales of Nissan Genuine Parts, Nissan Genuine Accessories and Automate products only. No other franchise or aftermarket products will be included or have any bearing whatsoever on the results of this promotion.
Entries for the promotion open at 08.00 (AEDT) on 1 January 2013 and Qualifying Purchases must be made by 20.00 (AEDT) on 31 March 2013 (Qualifying Period). All entries must be received by the Promoter by 20.00 (AEST) on 8 April 2013.
Entries for the promotion can be recorded on the competition website between 08.00 (AEDT) on 1 January 2013 and 20.00 (AEST) on 8 April 2013. Purchases must be made during the Qualifying Period to qualify for entry into the draw.
Entries will be deemed to be accepted at the time of receipt and not at the time of transmission. Incomplete or incomprehensible entries will be deemed invalid.
The draw will be conducted by The Fuel Agency.
The draw will take place at Nissan After Sales at 8-22 Quality Drive, Dandenong South, Victoria, 3175 at 11.00 (AEST) on 11 April 2013.
The draw will be conducted electronically and supervised by CIE Legal.
There are twelve (12) prizes for the Promotion. There will be three prizes awarded in each Region. For each Region, the first valid entry drawn will win the First Prize, the second valid entry drawn will win the Second Prize and the third valid entry drawn will win the Third Prize.
The prizes for the Promotion are as follows:
First prize 4 x $2000.00 Anaconda Gift Voucher;
Second Prize 4 x $1500.00 Anaconda Gift Voucher;
Third Prize 4 x $1000.00 Anaconda Gift Voucher.
Each Region is defined as follows:
Victorian Region: all participating trade customers located in Tasmania and Victoria;
New South Wales Region: all participating trade customers located in Australian Capital Territory and New South Wales;
Queensland Region: all participating trade customers located in Queensland;
Western Region: all participating trade customers located in Western Australia, South Australia and Northern Territory;
A limit of one (1) prize per person applies (except in South Australia). Anaconda Gift Cards are subject to the terms and conditions for redemption and use stipulated on the vendor’s website at
www.anaconda.com.au.
The total prize pool is $18,000.00.
Prize winners will be notified by telephone, and confirmed by mail and email within two days of the draw. Prize winners will be notified about the prize they won and the particulars of how the prize is to be collected.
Prize winners will be published in The Australian newspaper on 30 April 2013.
Prizes are not exchangeable or redeemable for cash. Prize values are in Australian dollars. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to any applicable State regulation. The Promoter will make all reasonable efforts to deliver the prize to the winner by 31 May 2013.
Should any prize/s for the promotion remain unclaimed by 14.00 (AEST) on 1 August 2013, despite every reasonable effort taken by the Promoter to contact the prize winners, the Promoter may conduct a further draw as is necessary in order to distribute the prize/s at Nissan After Sales, 8-22 Quality Drive, Dandenong South, Victoria, 3175 at 11.00 (AEST) on 8 August 2013. Any winner(s) in the unclaimed prize draw will be notified by telephone and confirmed by mail and e-mail and will have their name(s) published in The Australian on 15 August 2013.
Entrants are permitted to submit multiple entries. Entrants can only enter in their own name. The use of automatic entry software, mechanical or electronic devices that allows an individual to automatically enter the Promotion is prohibited and may render all entries submitted by that individual invalid.
The Promoter reserves the right, at any time, to verify the validity of entries by reviewing the invoices identified on the purchase registrations. It is a requirement that all invoices (as proof of purchase) must be supplied upon request. Proof of identification, age, residency and entry considered suitable for verification is at the discretion of the Promoter.
The Promoter takes no responsibility for any FBT implications and advises the registered participants to seek independent financial advice.
The Promoter reserves the right in its sole discretion to disqualify any individual who it has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal right to recover damages or other compensation from such an offender is reserved.
If this promotion is interfered within any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law, and subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
The Promoter, its associated agencies and companies associated with this Promotion will take no responsibility for the prizes damaged or lost in transit. Once the prizes have left the premises of the Promoter, the Promoter’s associated agencies or the companies associated with this promotion, the Promoter, the Promoter’s associated agencies and the companies associated with this promotion will not be responsible for any delay, failure to deliver, or damage caused to the prizes during transit.
The Promoter reserves the right to prohibit the winners taking part in any or all aspects of the prizes, if the Promoter determines, in its absolute discretion that the winners are not in the mental or physical condition necessary to be able to safely participate in the prizes.
It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements.
To the full extent permitted by law, the Promoter, the Promoter’s officers, employees and agents, the Promoter’s related companies and all those entities' personnel exclude all liability for any loss (including any damage, claim, injury, cost or expense, including loss of opportunity) which is suffered or incurred by any individual in connection with the Promotion or prizes, including: (i) any direct, indirect, economic or consequential loss; (ii) any loss arising from the negligence; (iii) any liability for personal injury or death. Nothing in these conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia.
To the full extent permitted by law, the Promoter, the Promoter’s officers, employees and agents, the Promoter’s related companies and all those entities' personnel exclude all liability for any loss (including any damage, claim, injury, cost or expense, including loss of opportunity) which is suffered or incurred by any individual in connection with the Promotion or prizes, including but not limited to: (i) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (ii) any theft, unauthorised access or third party interference; (iii) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (iv)any variation in prize value to that stated in these terms and conditions; (v)any tax liability incurred by the winner or entrant; (vi) any prize(s); or participation in or use of any prize(s).
The Promoter may require the winner(s) from the promotion to partake in media exposure, including but not limited to future promotional, marketing and publicity without any further reference, payment or other compensation.
The Promoter’s’ decision is final and no correspondence will be entered into. Failure by the Promoter to enforce any of its rights does not constitute waiver.
All entry details become the property of the Promoter. The Promoter may use the name and photograph of the prize winner(s) for promotional purposes without compensation, unless the prize winner(s) advises the Promoter otherwise when accepting the prize. By entering the promotion, unless the Promoter is otherwise advised, Entrants consent to the Promoter using their personal information provided for facilitating the promotion, awarding prizes and for future promotional, marketing and publicity purposes, and disclosing that information to its related entities and contractors for those purposes.
