Terms and Conditions
1. Information on how to enter forms part of the terms of entry. Entry into the Promotion is deemed acceptance of these terms and conditions.
2.
Entry is open to existing Repco trade account customers who are residents of Australia, 18 years and over and whose account(s) are current and in good standing ("Eligible Entrants"). Employees and their immediate families of Exego Pty Ltd trading as Repco, Oxygen Interactive Marketing and their associated agencies and companies are not eligible to enter.
3. The competition commences on 1st April 2013 at 00:01 (AEDT) and concludes on 31st May 2013 at 23:59 (AEST) ("Promotion Period")
4. The Promotion will be advertised on the website
www.repcotrade.com.au, April and May Trade Solutions catalogues including inserts.
5. To enter, Eligible Entrants must make a qualifying spend on their Repco trade account during the Promotion Period, excluding spend relating to core deposits, engines, exchange parts and capital equipment spend over $2000.
6. An Eligible Entrant will automatically receive one (1) entry into the prize draw for every $100 they spend on a participating supplier brand (as communicated on the promotional advertising and listed in clause 7) during the Promotion Period.
7. Participating supplier brands: Castrol, Penrite, Gates, Shell, Monroe, Ryco, Nulon, Narva, Stanley, Bosch, NGK, Clutch Industries, Trico, Bendix, TRW, PBR, STP, CRC and Armorall.
8. Prizes will be awarded to the account holder only and it is a condition of accepting the prize that the winning entrant's Repco Trade Account must be current (during the Promotion Period and at the time of the draw) and the winning entrant must not be in default under their Repco Trade contract.
9. Only one prize per Repco account customer is permitted (Residents of South Australian are entitled to win more than one prize).
10. The Promoter reserves the right to request winners to provide proof of identity and proof of residency at the nominated prize delivery address. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.
11. The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. This includes, but not limited, to entrants and households using multiple email addresses, postal addresses, PO Box addresses to register single or multiple purchases. The Promoter reserves the right to disqualify a winner if Promoter becomes aware that the winner and/or the winner's entry is of a type described in this clause.
12. Any entry that is made on behalf of an Eligible Entrant by a third party will be invalid.
13. Each valid entrant who has entered the Promotion throughout the Promotion Period will be entered into the draw. There will be a total of 101 winners. The prize draw will take place at Oxygen Interactive Marketing, Level 1, 16 Palmer Parade Cremorne VIC 3121, on 11th June 2013 at 10:00 (AEST).
14. Major Prize: The first (1) valid entry drawn will win a trip for two (2) adults to Chicago, USA to watch Nascar as a guest of the Napa Racing Team valued up to $13,000.
The prize includes:
• Return economy airfares for two (2) adults from the winner's nearest Australian capital city to Chicago, with flights departing on 11th September 2013 and returning 18th September 2013;
• Seven (7) nights twin share accommodation in a 5-star hotel for two (2) adults;
• Two (2) tickets to Nascar event at Chicagoland Speedway
• Meet and Greet with the NAPA Racing Team
• NAPA Merchandise
• $1000 spending money
The Major Prize winner and his/her companion must be taken to coincide with the 2013 Nascar event, taking place on 15th September 2013 subject to booking and flight availability.
15. Minor Prizes: The 2nd - 41st entry drawn will win a Repco 8 Drawer Chest (RTC8D90) valued at $399. The 42nd - 71st entry drawn will each win a Repco 1/2`` Drive Air Impact Wrench (RCIW2360) valued at $340. The 72nd - 101st entry drawn will each win 30 x Repco Cordless Variable Impact Wrench (RCLIWV) valued at $726.
16. All winners will be notified of their prize via telephone and in writing within 2 days of the draw. Major and Minor Prize winners will have their details published in the Public Notices section of The Australian newspaper on 29th June 2013.
17. Total Prize Pool value is up to $60,940 (including GST)
Major Prize Conditions
18. Spending money, additional meals, excursions, insurance, passports, visas, vaccinations, transport to and from departure point, items of a personal nature, in-room charges, hotel incidentals and all other ancillary costs are not included.
19. The Major Prize winner and his/her companion are responsible for ensuring that they have valid passports, and any requisite visas, vaccinations and travel documentation. Passports must be valid for at least six (6) months after the expected date of return.
20. The Nascar event ticket prizes are subject to the event venue and ticket terms and conditions. The Promoter and event organisers hereby expressly reserve the right to eject the winner (and/or his/her companion) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the Major Prize.
21. The Major Prize winner and his/her companion must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers. The Major Prize winner may be required to present their credit card at time of accommodation check in.
22. By accepting the Major Prize, the Major Prize winner agrees to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed, filmed and/or chaperoned throughout the duration of the prize.
General Prize Conditions
23. Major and Minor Prizes cannot be transferred or redeemed for cash and subject to availability. Unless expressly stated in these terms and conditions, all other expenses become the responsibility of the winners.
24. If any prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State Regulation.
25. Once prizes have left the Promoter's premises, the Promoter takes no responsibility for prizes damaged, delayed or lost in transit.
26. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.
27. Prize values are based upon the recommended retail prices at the time of printing (inclusive of GST). The Promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.
28. Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.
29. Should an entrant's contact details change during the Promotion Period, it is the entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.
30. Major Prize Unclaimed Prize Draw: Subject to any direction given under relevant State legislation, an unclaimed Major Prize draw will take place at the same time and place as the original prize draw on 2nd August 2013. If any, winners will be notified in writing within 2 days of the draw and will have their details published in the Public Notices section of The Australian newspaper on 9th August 2013.
31. Minor Prize Unclaimed Prize Draw: Subject to any direction given under relevant State legislation, an unclaimed Minor Prize draw will take place at the same time and place as the original prize draw on 13th September 2013. If any, winners will be notified in writing within 2 days of the draw and will have their details published in the Public Notices section of The Australian newspaper on 17th September 2013.
32. The Promoter's decision is final and the Promoter will not enter into correspondence regarding the Promotion result.
33. It is a condition of accepting any prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
34. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter's ability to proceed with the Promotion on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any written directions given under State Regulation.
35. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law. Exego Pty Ltd, Oxygen Interactive Marketing and their associated agencies and companies assume no responsibility for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
36. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
37. If for any reason this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to any written direction given under State Regulation.
38. All entries become the property of the Promoter. The Promoter collects personal information about entrants to enable them to participate in this Promotion but no further use of this information will be made without prior consent.
39. Exego Pty Ltd is collecting the entrant's personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying winner). The entrant's personal information may be disclosed to Oxygen Interactive Marketing for this purpose. If an entrant is not willing for this to occur they cannot participate in the Promotion.
40. Entrants' personal information may be disclosed to State and Territory lottery departments and winners' names published as required under the relevant lottery legislation. For purposes of public statements and advertisements the Promoter will only publish the winner's surname, initial and state. A request to access, update or correct any information should be directed to the Promoter.
