1. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.These Terms and Conditions can be downloaded from
www.gatespromo.com.au2. Entry is only open to Repco Trade Account Customers who are operating in Australia and Repco & Appco Trade Account Customers who are operating in New Zealand (Eligible Businesses)
3. Eligible Businesses must be within the Promoters trading terms throughout the promotional period and must not have overdue monies owing as at the promotional closing date in order to be eligible to claim any prize.
4. Employees (and their immediate families) of the Promoter, participating Repco or Appco stores and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
5. The promotion commences at 8:00am (AEST/NZST, whichever is applicable) on 01/04/2013 and closes 5:00pm (AEST/NZST, whichever is applicable) on 31/05/2013(Promotional Period)
6. There will be one (1) major and one (1) minor prize draw for this promotion. The draws will each take place at Flow Marketing, 107/9 Claremont Street, South Yarra VIC Australia 3141.
7. To be eligible to enter:
-Register participation by May 31st 2013 via the dedicated website:
www.gatespromo.com.au and completing the entry form including business name, name, phone, email address and Repco / Appco trade account number.
-Purchase Gates Products through a current Repco account during the promotional period a minimum of $399 (ex GST) to qualify to participate in the promotion to receive 1 x entry. All subsequent purchases of any gates products within the promotional period receive 1 additional entry into the promotion sweepstakes for every $100 spent exclusive of GST.
-Bonus entries will be awarded to the trade customers that purchase during the promotional period:
-Gates Timing Component Kits: Every Gates Timing Component Kit purchased = 1 BONUS Entry (Example part number TCKXXXX)
-Gates Subaru Timing Component Kits: Including any Spacer Tool purchased = 2 BONUS Entries (Applicable Part Numbers: TCKHT304, TCKHT277B, TCKHT277, TCKHT277C, TCKHT172, TCKHT254, TCKWPT254 & TCKWP254)
-Gates Micro-V Belts: Every 5 x Gates Micro-V belt purchased = 1 BONUS Entry (Example part number XPKXXXX, XDPKXXXX)
8.Minor Prize Draw - Early registration incentive:
-There will be 10 x AU$100 Universal Visa Pre Paid gift cards available to be won by participants who register before 23:59 10th April 2013. (AEST/NZST, whichever is applicable).
9.The first ten (10) valid entries drawn will win an AUD$100 Universal Visa Pre Paid gift card drawn at Noon Friday 12th April 2013 AEDST. Any ancillary costs associated with redeeming the gift card are not included. Any unused balance of the gift card will not be awarded as cash. Redemption of the gift card is subject to any terms and conditions of the issuer including those specified on the gift card.
10.Major Prize Draw $40,000 Flight Centre Gift Cards
-There will be 8 x AUD$5,000Flight Centre Gift Cards available to be won.
11. The first eight (
valid entries drawn in the major prize draw will win a AUD$5,000 Flight Centre Gift Card drawn at Noon Friday 7th June 2013 AEDST. Any ancillary costs associated with redeeming the gift card are not included. Any unused balance of the gift card will not be awarded as cash. Redemption of the gift card is subject to any terms and conditions of the issuer including those specified on the gift card.
12. Winners will be notified by telephone and in writing. Major prize winner names will be published in the Australian Newspaper June 13, 2013.
13. Prizes will be awarded to the authorised representative of the respective winning business, as provided through the registration process.
14. Subject to the unclaimed prize draw clause, if for any reason the winning business does not redeem the prize, then the prize will be forfeited
15. If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
16. Total prize pool value in Australia and New Zealand is AUD$41,000.
17. Prizes are not transferable or exchangeable and cannot be taken as cash.
18. A draw for any unclaimed minor and major prizes may take place at 12 noon AEST on 7/09/2013 at Flow Marketing, 107/9 Claremont Street, South Yarra VIC 3141, subject to any directions from a regulatory authority. Winners of any second chance draw will be notified by telephone and in writing. Major prize winners (if any) of the second chance draw will be published in the Australian Newspaper on 12/09/2013.
19. Authorised representatives of Eligible Businesses consent to the Promoter using the business name, likeness and/or image in the event they are the winning business (including photograph, film and/or recording of the same) in any media for an unlimited period, without remuneration, for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
20.If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Eligible Businesses and/or its authorised representative; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
21. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia and in New Zealand (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion

Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoters control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by a winning business or Eligible Business (or its authorised representative); or (e)use of a prize
23. As a condition of accepting the prize, the authorised representative of the winning business must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
24. The Promoter collects personal information of authorised representatives of Eligible Businesses in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Eligible Business and/or its authorised representative. Authorised representatives of Eligible Businesses should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.
25. The laws of Australia apply to this promotion to the exclusion of any other law. Eligible Businesses submit to the exclusive jurisdiction of the courts of Australia.
