For your chance to win your spend back in Wintergarden gift cards
Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
Entry is only open to QLD residents. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter.
Promotion commences 9am (local time) on 15/04/2013 and closes 4pm (local time) on 28/04/2013 (“Promotional Period”).
To enter, eligible entrants must, during the Promotional Period, spend $50 in a single transaction at a participating Wintergarden retailer and submit a completed entry form in one of the entry boxes provided. Entry boxes will be located in participating retailers. One (1) entry can be made for each $50 spent at Wintergarden. Transactions must be a minimum of $50 and only one entry permitted per $50 spend. Entry forms are issued at the point of purchase.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including but not limited to the entrant’s identity and place of residence) and to disqualify any entrant who submits an entry form that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
If requested, winners must provide the receipt used to enter the promotion.
Prize draws will occur at 2pm on 01/05/13 at Wintergarden Centre Management, Level 2, Broadway on the Mall, 170 Queen Street, Brisbane QLD 4000. Prize winners will be drawn from a pool of all entries and winners will be drawn until the prize pool value of $15,000 has been reached. The Promoter reserves the right to draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.
The value of the prize cards awarded to the winners will be rounded up to the nearest available prize card denomination as per the recorded spend on the competition entry form.
Winners will be notified by email and phone dependant on details provided on entry form.
The Promoter’s decision is final and no correspondence will be entered into.
In the event that the last entry drawn causes the prize pool amount to total greater than $15,100 this entry will be discounted and redrawn until a winner is drawn that will bring the total prize pool within $15,100.
Any ancillary costs associated with redeeming any prize / voucher is not included. Any unused balance of any prize / voucher will not be awarded as cash. Redemption of any voucher is subject to any terms and conditions of the issuer including those specified on the voucher.
Winners will be responsible for liaising with Wintergarden Centre Management to arrange redemption of their prize. Wintergarden Centre Management Office operates standard business hours only. Centre Management can be contacted on (07) 3229 9755. Proof of identity to match the entry form must be provided to Wintergarden Centre Management before the prize will be awarded.
If any prize is unavailable, the Promoter, in its discretion reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
Total prize pool value is a maximum of AUD $15,100. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash unless otherwise specified.
The Promoter does not guarantee participating retailers to remain the same throughout the duration of the Promotion.
A draw for unclaimed prizes may take place on 15/06/2013 at 2pm at the same place as the original draw, subject to any directions from a regulatory authority. Winners, if any, will be notified by email and phone dependant in the details provided on the entry form.
Entrants consent to the Promoter using the entrant’s name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the promoter.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant, or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. By opting in, entrants agree to join the Wintergarden database and the Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
The laws of the State of Queensland, Australia apply to this promotion to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of Queensland, Australia.
