Terms and Conditions
By entering the RETURN TO RACING “Promotion”, you are agreeing to the following terms and conditions:
1. STANDARD TERMS
1.1 Information on how to enter forms part of the terms of entry.
2. WHO CAN ENTER?
2.1 Subject to clause 2.2, entry is open only to all residents of Cairns & surrounding areas. All entrants must be able to show proof of residency upon request e.g. Drivers Licence.
2.2 Employees and their immediate families of The Cairns Post Pty Ltd and their associated agencies and companies are not eligible to enter. Immediate family means any of the following: Spouse, ex-spouse, de-facto spouse, child or step-child (whether by natural or by adoption), parent, step-parent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
3. HOW TO ENTER
3.1 The competition commences on Saturday, 27th April at 00:01 (AEST) and concludes on Friday, 10th May at 23:59 (“the Competition Period”).
3.2 To enter the competition, entrants must log on to
www.cairns.com.au during the competition period & enter their details, including their full name, address, postcode, daytime phone, mobile, age and Return to Racing Question correctly.
3.3 Entrants under the age of 18 years are not eligible to enter the competition.
4. PRIZE PACKAGE
• Return Economy flights for two people from Cairns to Brisbane courtesy of Qantas departing Friday 7th June returning Sunday 9th June
• Return limo Airport transfers
• Two Nights’ Accommodation at the Pullman King George Square in a Pullman Deluxe Room including full breakfast
• Two tickets to the Stradbroke Day Lawn Party on the 8th June at the Brisbane Racing Club including;
Racecourse admission, Admission to the Lawn Party precinct, Race program, A buffet lunch, Beverage package, Live entertainment, Tote (TAB) facilities and bookmakers, Superscreen and plasma screens, Lawn tables and chairs and high bars and stools throughout the precinct.
• Return Limo transfers from Hotel to the Races
• Two tickets to the Cairns Cup Luncheon on Friday 9th August including a seafood buffet, one hour drinks package, live entertainment and special guest speakers.
• Two tickets to the Cairns Cup Myer Fashionable Fillies on Saturday 10th August including gate entry, a three course lunch and welcome bubbles while watching the hottest racewear fashion.
• A Cairns Jockey Club Membership including Gate admission to all Cairns Jockey Club race meetings and admission to the exclusive Member’s Bar during all race meetings for you and a guest
TOTAL PRIZE POOL VALUE: $4,000.00
4.1 The winner must be available to travel on the date specified as per clause 4.
4.2 The full complement of the prize must be taken as offered and is not redeemable for cash or any other services.
4.3 The prize will be forfeited if the winner does not redeem or take the prize at the time and place stipulated by the Promoter.
4.4 In the event that any prize item is unavailable, the Promoter may, but is not required to, provide a substitute prize item of equal or greater value at the publishing date.
4.5 Any taxes (other than GST, if any) which may be payable as a consequence of a winner receiving the prize, or any element of the prize, are the sole responsibility of the winner.
4.6 The winner agrees not to sell or lease the prize, because profiteering from the prize, in part or full, is a breach of supply and action will be taken if misused.
4.7 The winner consents to the use of his or her name, photograph and entry for promotional purposes.
5. HOW TO WIN
5.1 Each entrant who has entered the competition over the Competition Period and registered all details in accordance with clause 3 will be entered into the prize draw. All draws will take place at The Cairns Post, 22-24 Abbott Street, QLD, 4870 from 11:00am on Saturday, May 11th, 2013. The winner will be announced on Saturday, May 11th at the Return to Racing Race Day at Cannon Park.
5.2 All prizes must be claimed by Friday, May 17th, 2013 by the winner. In the event that for any reason whatsoever a winner does not claim their prize by this date, then that element of the prize will be forfeited by the winner.
5.3 The winner/s will be announced on
www.cairns.com.au/competitions. The prize winner/s will be notified by mail/phone on Saturday, May 11th.
5.4 The Promoter’s decision is final and the Promoter will not enter into correspondence regarding the result.
5.5 If an entrant marks the “opt-in” box on the entry form, the entrant consents to storage of their personal information on the specified companies’ databases and the specified companies may use this information at any time in the future for promotional and marketing purposes regarding their respective products or services including contacting the entrant via electronic messaging.
6. NO LIABILITY
6.1 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to State Legislation.
6.2 The Cairns Post Pty Ltd and The Cairns Jockey Club and their associated agencies and companies will take no responsibility for prizes damaged or lost in transit, or late, lost or misdirected mail.
6.3 The Promoter does not exclude any rights and remedies in respect of goods or services under the Competition and Consumer Act or equivalent State or Territory legislation which cannot be excluded, restricted or modified. However, the Promoter excludes all rights, remedies, conditions and warranties in respect of goods or services from your entry into this competition or your participation in or enjoyment of the prize whether based in statute, common law or otherwise, to the extent permitted by law. To the fullest extent possible the Promoter will have no liability in relation to the following:
6.3.1 the draw;
6.3.2 participation in or enjoyment of any prize;
6.3.3 as a consequence of late, lost or misdirected mail;
6.3.4 due to the broadcast of any program relating to the competition or the publication of any material, including any statements made by any compere, staff member, journalist, other entrants or any other person;
6.3.5 arising from or related to any problem or technical malfunction of any telephone network or lines or mobile communications network related to or resulting from participation in this promotion;
6.3.6 due to circumstances outside the Promoter’s reasonable control.
6.4 The Cairns Post Pty Ltd and its affiliates assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission; communications line failure, theft or destruction or unauthorised access to, or alteration of, entries, and reserves the right to take any action that may be available.
6.5 If, for any reason, this competition is not capable of being conducted as planned, including, but not limited, due to tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to State Legislation.
