“Mother’s Day Scenic Tours Surprise” Terms and Conditions
By entering the “Mother’s Day Scenic Tours Surprise” (“the Competition”), you are agreeing to the following terms and conditions:
1. STANDARD TERMS
1.1 Information on how to enter forms part of the terms of entry.
2. WHO CAN ENTER?
2.1 Subject to clause 2.2, entry is open to all residents of Australia 18 years of age or older where the Channel Seven signal and its affiliated networks (“Affiliates”) signals are received.
2.2 Employees and their immediate families of the Seven Network (Operations) Limited, Scenic Tours Pty Ltd, MNet Mobile Pty Ltd and their associated agencies and companies are not eligible to enter.
3. HOW TO ENTER
3.1 The Competition commences on Sunday 28 April 2013 at 09:01 (AEST) and concludes on Friday 10 May 2013
at 09:00 (AEST) (“the Competition Period”).
3.2 For entry details, viewers must watch the Seven Network (“the Network”) and affiliates during the
Competition Period. There will be a competition segment aired from time to time, which will display
information on how to enter.
3.3 In order to enter the draw, viewers must either:
a) Send a text message/SMS to 1977 7677 and register the prize codeword, their full name, suburb and state;
or
b) Telephone 1902 55 77 06, and register the prize codeword, their name, address (including postcode) and contact daytime telephone number (including STD area code).
or
c) Enter via
www.yahoo7.com.au/scenictours to register for the Competition. Online entrants will be required to register their details including their full name, full address, postcode, state, daytime phone number and email address.
3.4 All text/sms or telephone entrants in the Competition may enter as many times as they like, however, online entrants are limited to one (1) entry per day, entrants can win only one prize throughout the Competition Period (except entrants from South Australia who are entitled to win more than one prize).
3.5 No scripting is allowed for online and SMS entries (which will be deemed invalid). If scripting is detected, the promoter may deem all entries invalid and conduct a re-draw in accordance with clause 5.1
3.6 Entries must be received by Friday 10 May 2013 at 09:00 (AEST). The time of entry will in each case be the time the SMS message, 1902 telephone call is received by the MNet Mobile Pty Ltd database or online entry though the Yahoo!7 database.
3.7 For SMS entrants, each entry must be charged to a mobile account and SMS entries via the internet (distinct from online entries submitted in accordance with clause 3.3(c) above), computer generation or “scripting” are invalid and will not be accepted. Online entrants will be presented with a confirmation page once the completed email entry is submitted by the entrant.
3.8 SMS entrants will receive a reply message to their entry.
3.9 Each SMS entry will be charged at premium rate, namely $0.55 (including GST), which covers the entry and
the reply message.
3.10 The maximum 1902 call cost is $0.55 (including GST). 1902 call costs will be higher from mobile phones.
3.11 Entrants under the age of 18 must obtain the permission of a parent or guardian to enter the Competition.
3.12 Entries remain the property of the Promoter and will not be returned to the entrant. Entrants agree to grant
the Promoter a perpetual and non-exclusive licence to use their entries in all media worldwide and acknowledge that they will not be entitled to any fee for such use.
4. PRIZES
4.1 There will be two (2) prize winners who will each receive the prize package detailed in clause 4.2.

CONDITIONS
Certain conditions are applicable to the prize and are listed as follows:
Prize does not include travel insurance, items of a personal nature, meals (other than featured in the itinerary), laundry, telephone calls, additional nights or upgrades etc.
The Prize is neither non-transferable nor redeemable for cash.
The Prize is valid for two adults and travel is valid for up to 12 months from the 1st January 2014 to December 31st 2014 and is limited to availability on set departures. Blackout period may apply.
Prize is subject to availability at time of booking and can only be taken on dates already scheduled for this tour.
Prize is valid ex major capital cities of SYD/MEL/BNE/ADL/PER/; prize does not cover regional flights.
Prize includes two return economy class airfares flying on airline of Scenic Tours choice ex SYD/MEL/BNE/ADL/PER. Any costs associated with returning to place of residence are at winners own expense. Airfares are subject to availability on specific class.

Winner and their companion must have appropriate and valid passport
before travelling (cost of which is the winner’s responsibility).
The major prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize or any element of the prize as
stated. If the prize is not utilised by 1 December 2014 it will be fortified.
As the major prize airfares and accommodation are subject to availability at the time of booking the major prize winner must confirm their travel dates
and times no later than 90 days before departure.
Any changes made to the booking by the prize winners or their travel
companions, including extending the trip, are at the winner’s expense and
must be arranged by the winner.
Unless expressly stated in these terms and conditions all other expenses
related to the prize become the responsibility of the prize winners and their nominated travel companions. Subject to the prize stipulated in clause 4.2, the prize winners and their travel companions are responsible for all expenses including but not limited to spending money, transfers, meals, room amenity charges, drinks, incidentals, mini-bar, in-room video, laundry, room service, telephone calls, activities, insurance, energy surcharges, gratuities, services charges, passports and all other ancillary costs. A credit card imprint or cash deposit may be required from the prize winner at check- in to the hotel, for all incidental charges.
The prize winner is responsible for ensuring that all those travelling have valid passports and applicable visas. The Promoter will not be held responsible for any loss or delay that may occur as a result of any passport or visa not being produced in time for travel. The Promoter does not accept any responsibility if the major prize winner’s nominated travel companions cannot travel because of non-compliance with any passport, visa or immigration requirements.

4.3 In accepting the prize the winners and their nominated travel companions agree to participate in and co- operate with all reasonable media editorial requests, including but not limited to, being interviewed and photographed, and the winners grant the Promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide and the winners will not be entitled to any fee for such use.
4.4 The prize winners and their nominated travel companions agree they will not sell or otherwise provide their story and/or photographs to any media or other organisation except Scenic Tours.
4.5 It is a condition of accepting the prize that the winners and their nominated travel companions must comply with all the conditions of use of the prize and the Promoter’s requirements.
4.6 Prizes cannot be redeemed for cash and are not transferable or exchangeable. The travel companions nominated by the major prize winner, once nominated are not transferable.
4.8 Prize winners and nominated companions must provide valid identification to the Prize Provider.
4.9 The prize winner and their travel companions must commence and complete their travel between the following dates; 1st January 2014 until 31st December 2014 (inclusive). The major prize winner and their nominated travel companions must travel together on the same flights on all sectors. There can be no changes made to travel arrangements once itineraries or tickets are issued, including no name changes. The Prize provider will inform the major prize winners of their flight times and dates no later than 90 Days before scheduled departure. Prize is subject to availability at time of booking and can only be taken on dates already
scheduled for this tour.
4.10 The major prize must be taken as stated and no compensation will be payable if a winner is unable to use the

4.13 The winners and their travelling companion must travel on the same flight, at the same time, must depart
from the same capital city and are responsible for transport from their residence to their nearest capital city (Adelaide, Brisbane, Melbourne, Perth, Sydney) for flight departure to Amsterdam or Budapest. The Promoter will not be liable for any cost arising from or otherwise related to delays or cancellations to the connecting flight(s) booked by the winner, either to or from the nominated capital city and their residence. All booking and costs related to obtaining, amending or otherwise concerning the connecting flight(s) to/from their residence and the nominated capital city are the responsibility of the winner.
4.14 The Prize includes all meals as specified in the tour package and the Prize also includes port charges. Unless expressly stated in these terms and conditions all other expenses related to the prize become the responsibility of the prize winners and their nominated travel companions. 4.18 Compliance with any health or other government requirements is the responsibility of the prize winners and their nominated travel companions.
4.19 Prize does not include travel insurance, items of a personal nature, meals (other than featured in the itinerary), laundry, telephone calls, additional nights or upgrades etc. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances.
4.20 The Promoter may require the prize winners and their nominated travel companions to sign a waiver of liability and indemnity in the form determined by the Promoter in its absolute discretion.
4.21 Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.
4.22 The promoter may vary these terms and conditions at its discretion, subject to state government legislation.

5. HOW TO WIN
5.1 There will be two (2) prize winners drawn from the national pool of 1902, SMS and online entrants who will
each win the prize package detailed in clause 4.2.
Each entrant who has entered the Competition in accordance with these terms and conditions and registered all necessary registration information via the method(s) set out in Clause 3.3 (“Qualifying Entrant”) will be entered into the draw. Entries that do not comply with any of the terms and conditions, may be deemed invalid and a further draw(s) will be conducted in its place. Each entrant who has entered the Competition in accordance with these terms and conditions during the Competition Period using a mobile phone with a reply path and whose SMS message has passed through the Telco carriers network to MNet Mobile Pty Ltd database or phoned the 1902 number registered all details required by Friday 10 May 2013 at 09:00 (AEST) (“Qualifying Entrant”) will be entered into the draw. Entries that do not comply with any of the terms and conditions, may be deemed invalid and a further draw will be conducted in its place. The draw will take place at MNet Mobile Pty Ltd, Level 1, 16 Anster Street, Adelaide, South Australia 5000 on Friday 10 May 2013 at 10:30 (AEST).
5.2 The winners will be notified by a phone call on the day of the draw, and a letter advising the winner of their prize will also be express posted. The winners’ entry details will be published in the Public Notes section of The Australian newspaper on the dates Monday 20 May 2013.
5.3 The Promoter’s decision is final and the Promoter will not enter into correspondence regarding the result.
5.4 The Promoter may in its absolute discretion deem entries invalid subsequently to a winner being notified or a winner’s name being announced if it is discovered that the winner did not enter the Competition in
accordance with these terms and conditions. In these circumstances, an additional draw will be conducted.
5.5 It is a condition of accepting the prize that the winner (and any companions) may be required to sign a legal
release in a form determined by the Promoter in its absolute discretion.
5.6 Subject to state government legislation winners must accept their prize by Tuesday 13th August 2013
10:00am (AEST) an unclaimed prize draw will take place at MNet Mobile Pty Ltd, Level 1, 16 Anster Street, Adelaide, South Australia 5000 on Tuesday 13th August 2013 at 10:30 (AEST) and winner(s) will be notified by a phone call and mail, their details published in the Public Notes section of The Australian newspaper on Monday 19 August 2013 if required.
6. NO LIABILITY
6.1 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the Competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Competition and recommence it from the start on the same conditions, subject to state government legislation.
6.2 Seven Network (Operations) Limited, MNet Mobile Pty Ltd, Yahoo!7 and their associated agencies and companies will take no responsibility for prizes damaged or lost in transit, or late, lost or misdirected mail.
6.3 Seven Network (Operations) Limited, MNet Mobile Pty Ltd, Yahoo!7 and their associated agencies and companies will not be liable for any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur:
a) whilst undertaking any travel won on or connected with their entry into the Competition; or
b) in the acceptance or participation in any prize;
c) as a consequence of late, lost or misdirected mail;
d) due to the broadcast of any program relating to the Competition or the publication of any material,
including any statements made by any compere, staff mem
e) in relation to failure of an SMS entry message to be received by the Promoter on account of technical problems or traffic congestion; or
f) in relation to any damage or loss to Entrant's or any other person's computer software, computer equipment or internet connection resulting from or related to participation in this Promotion;
g) any variation in Prize value to that stated in these Terms and Conditions;
h) any technical difficulties, technical error or equipment malfunction (whether or not under the
Promoter’s control); or any error, omission, interruption, deletion, delay, defect, theft, unauthorised
access or third party interference.
6.4 Seven Network (Operations) Limited and Yahoo!7 assumes no responsibility for any error, omission,
interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of entries, and reserves the right to take any action that may be available, subject to state government legislation.
6.5 If for any reason the Competition is not capable of running as planned, due to causes including but not limited to tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of the Competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the Competition, subject to state government legislation.
