IMPORTANT: PLEASE READ THESE TERMS AND CONDITIONS (THESE "TERMS AND CONDITIONS") BEFORE ENTERING THE CONTEST. THIS IS A LEGALLY BINDING AGREEMENT BETWEEN YOU AND INTEL ESTABLISHING THE TERMS AND CONDITIONS UNDER WHICH YOU ARE ENTITLED TO PARTICIPATE IN THE CONTEST. BY ENTERING THE CONTEST, YOU CONFIRM THAT YOU HAVE READ AND UNDERSTOOD, AND AGREE TO ABIDE BY, THESE TERMS AND CONDITIONS.

Organiser

The "Intel SMB What Year Are You Doing Business" Contest ("Contest") is organized by Intel Australia Pty Ltd (ABN 59 001 798 214) of Level 17/111 Pacific Highway, North Sydney NSW 2060, telephone (02) 9937 5800 ("Intel").

Eligibility

General eligibility requirements
This Contest will consist of two parts: (a) a Voting Component; and (b) a Draw Component. The Voting Component is open to all interested participants 18 years old and above, and resident in Australia. The Draw Component is only open to small to medium businesses operating in Australia with less than 200 employees and an Australian Business Number ("Eligible Business"). All entries and votes (where relevant) must be submitted within the Contest Period. Entries and votes submitted outside of the Contest Period will be disqualified from the Contest.

Not eligible:
The following are not eligible to participate in the Contest:

    Employees of Intel and their immediate family members.
    Employees of any party which is directly involved in organizing, promoting or conducting the Contest.
    Employees of external auditors who are directly involved in the Contest.

Contest Period

The Contest will commence on 29/05/2013 and will end on 02/07/2013 ("Contest Period").

Contest Specifics And Entry Instructions

All recording, transportation, accommodation, personal costs and/or any other costs, fees and/or other expenses that are incurred to participate in this Contest and/or to redeem a prize is the sole responsibility of each respective entrant/winner.

By entering the Contest and entering the information/contact details required, you agree that Intel may use the information/contact details that you provide for purposes of administering the Contest and to contact the prize winners, as well as other purposes outlined in the Privacy section below.

To enter the Contest, eligible individuals must visit http://businessyear.intel.com and follow the prompts. As part of the entry process, individuals will be required to undergo a diagnosis test to find out what year they're ‘doing business in' based on the technology they currently use. Individuals must have javascript enabled in their browser in order to complete the diagnosis process and enter the Contest. This information will be served up as a light-hearted infographic. Upon perfoming the diagnosis, individuals will need to submit their infographic by following the prompts on screen to fully fill out and submit the entry form. Once an individual submits their infographic and entry form, a unique page will be created and published containing their infographic and their selected details ("Page") and the individual will be issued with a unique URL to access the Page ("Unique Page URL"). To attract votes (as part of the Voting Component), individuals must ‘share' their Unique Page URL via Facebook, Twitter or LinkedIn (by following the prompts on screen) and/or by copying and then pasting the Unique Page URL into their personal email and sending the Unique Page URL to individuals that they would like to invite to vote for their Page. Depending on the ‘share' method chosen, a promotional message containing the Unique Page URL will be published on the entrant's Facebook, Twitter or LinkedIn profile/feed inviting their friends/followers/connections to vote for their Page. If an individual sends their Unique Page URL via email, they will be able to tailor their email as they wish (as the email will simply need to be sent in accordance with the standard instructions of their email provider), however they must ensure that they include the Unique Page URL into the email and direct individuals to visit it. Each Page can only be accessed via the Unique Page URL.

Intel is not a sponsor of or affiliated with any of the individuals, entities or brands listed as part of the historical chronology shown in the infographics, unless indicated. Any third party trademarks shown in infographics are the property of their respective owners. The Contest and in particular the infographic activity is intended to be light hearted and entertaining. We hope that you will have fun with the activity. Intel does not warrant the accuracy or completeness of the information, text, graphics, links or other items ("Content") presented by the activity, and makes no representation whatsoever about the suitability of the Content for any purpose. You should not place any reliance on the completeness, accuracy or existence of any Content, and you should obtain your own independent advice on your computer system. To the extent permitted by law, Intel disclaims all warranties and conditions with regard to the Content, including all warranties and conditions of merchantability, whether express, implied or statutory, fitness for a particular purpose, title and non-infringement.

All individuals who submit the entry form will be eligible to participate in the Voting Component (regardless of whether they are entering on their own behalf or on behalf of an Eligible Business). In addition, if an individual has submitted the entry form on behalf of an Eligible Business, the Eligible Business will also receive an entry into the Draw Component. For the sake of clarity, entrants who are not entering on behalf of an Eligible Business or do not provide the required Eligible Business's details will not receive an entry into the Draw Component. Individuals must ensure that they have permission of the owner of the Eligible Business to enter the Eligible Business into this Contest.

Individuals can enter multiple times (on their own behalf or an behalf of an Eligible Business), however, they will be issued with a separate Page and Unique Page URL each time they enter and any votes they receive for their separate Pages will not be combined.

Voting Component
The Voting Component will be conducted across five (5) weeks ("Weekly Periods"). Each published Page will have a voting feature, whereby individuals will be able to submit a vote for the Page of the entrant whose Unique Page URL they followed during a Weekly Period. The two (2) entrants whose Pages receive the most valid votes in each Weekly Period will each win the prize outlined in the table below corresponding to that Weekly Period ("Weekly Prize"). In the event of a tie for any Weekly Prize between multiple entrants who receive the same highest number of votes (other than between the first and the second placed entrants, excluding Week 5), each tied entrant will need to provide a response to Intel as to why they deserve to win the relevant Weekly Prize. Intel will then rank the entrants based on how good their response is (based on originality and creativity) in order to award the relevant Weekly Prize(s). No chance will be involved in how the winners in the Voting Component are determined.

Entries and votes during each Weekly Period will open at 12:00am AEST and close at 11:59pm AEST on the dates outlined in the table below, with the exception of the first Weekly Period where entries will open at 2:00pm AEST. At the start of each Weekly Period, the votes received for each published Page will be reset to zero and each Page will be put up for voting in each Weekly Period occurring after the Page is first published (with the exception of any Page that belongs to a winner of a Weekly Prize in an earlier Weekly Period). Each entrant can win a maximum of one (1) Weekly Prize. Votes are limited to one (1) vote per person. No prizes will be awarded for the act of voting in this Contest. Total prize pool value of the Voting Component is $10,390.

Draw Component

A random draw for all entries placed into the Draw Component during the Contest Period will be conducted at Anisimoff Legal, Level 5, 492 St Kilda Rd, Melbourne VIC 3004, on 04/07/2013 at 10:00am AEST. The first valid entry drawn will win a $10,000 Harvey Norman voucher (that can be used toward an office makeover) and a HP Elitebook Revolve 810 Business Tablet valued at $2,199. Total prize pool value of the Draw Component is $12,199. Intel may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.

The Draw Component prize will be awarded to the owner of the respective winning Eligible Business. Any ancillary costs associated with redeeming the Harvey Norman voucher are not included. Any unused balance of the Harvey Norman voucher will not be awarded as cash. Redemption of the Harvey Norman voucher is subject to any terms and conditions of the issuer including those specified on the Harvey Norman voucher.

A redraw for the Draw Component prize, if unclaimed, may take place on 04/10/2013 at the same time and place as the original draw, subject to any directions from a regulatory authority.

How Prize Winners Will Be Notified; Total Prize Pool

The prize winners will be notified through email, and where necessary telephone, within two (2) business days of being determined. The Draw Component prize winner will have their name published in The Australian on 10/07/2013. Any winner in the unclaimed prize re-draw for the Draw Component prize will have their name published in The Australian on 09/10/2013.

Claiming A Prize

Each prize will be delivered to the winner's nominated address in Australia. If for any reason a winner does not take/redeem a prize (or an element of the prize) by the time stipulated by Intel, then the prize (or that element of the prize) will be forfeited.

Entry Forms

To the extent permitted by law, Intel is not responsible for printing or typographical errors in any Contest-related materials or for registrations, entry forms or submissions that are incomplete, lost or misdirected, fail to enter into the processing system, or are processed, reported, or transmitted late or incorrectly or are lost for any reason including electronic, computer, telephone, paper transfer, mail system, human or other error; including inability to access any website associated with the Contest. Proof of online submission shall not constitute proof of receipt by Intel.

If any information provided on an entry form is found to be misleading or inaccurate, that entry shall be deemed invalid.

Goods as prizes

Where the prizes under the Contest are items/goods, these shall not be exchangeable or transferable and may not be substituted for cash. The items/goods will be delivered as brand new and un-opened.

Taxes, etc.

Any taxes and other levies imposed by any relevant applicable government or tax authority, as well as any other incidental costs incurred in the course of taking or using a prize shall be fully borne by each relevant prize winner.

Your Submission's Fitness For Publication

By entering the Contest, you expressly agree that any entry submitted by you ("Submission") does not contain any content that is unlawful, libelous, slanderous, defamatory, is invasive of another person's right of privacy or right of publicity, or that Intel may reasonably deem harmful, infringing of other's intellectual property rights, vulgar, obscene, derogatory, sexually inappropriate, pornographic, abusive, harassing, violent, threatening, hateful, objectionable with respect to race, religion, creed, national origin or gender, or otherwise unfit for publication. Intel shall not be liable in any way for any Submission. Intel shall have no obligation to monitor your Submission, but may do so at its discretion. If, Intel, in its sole and absolute discretion, considers your Submission inappropriate or unsuitable for publication, Intel may remove your Submission from the Contest.

Representations And Warranties Relating To Your Entry

You represent and warrant to Intel that you are the sole and exclusive owner of your entry, or you have all right and authority to grant the rights in your entry to Intel, its affiliates and/or its agents and contractors. If you are submitting an entry on behalf of an Eligible Business, you represent and warrant that you are aged 18 years or over, are an authorised representative of that Eligible Business and that you have permission from the owner of the Eligible Business to enter this Contest on behalf of the Eligible Business.

Promotional Activities

By submitting an entry in the Contest, you agree to have your name (and the name of your Eligible Business where applicable) and photo used for promotional purposes at Intel's sole discretion. If you are a prize winner, except where prohibited by law, you consent to the use of your name, photo and/or likeness, biographical information, winning entry, Submission, infographic and statements attributed to you (if true) for advertising and promotional purposes in any medium without any compensation or notice to you.

Intel's Rights In Your Entry

Intel will not return any of your entries, and your entries become the property of Intel.

You grant to Intel and/or its affiliates a non-exclusive, fully transferable, perpetual, irrevocable, royalty free, fully paid-up right and license:

    to adapt, edit, modify, publish, promote, reproduce, distribute, publicly display your entry and make derivative works based on it in any and all media, including any compilation, as Intel and/or its affiliates see fit for any reason,
    to identify you as the author of the entry, and
    to authorize others to do any of the things described above without any obligation to notify or compensate you.

Without limiting the generality of the provisions above, Intel and/or any of its affiliates shall have an exclusive right to publish and use any winning entry(ies) in print and/or electronic form for advertising and promotion of Intel's products, for exhibition, and for both commercial and non-commercial products and publications, including without limitation, using, downloading, adapting, reformatting, editing and/or resizing the winning entry(ies) as may be necessary and to authorize others to do any of the above without any obligation to notify or compensate the prize winner(s). Entrants agree not to assert any moral rights in relation to such use and warrant that they have the full authority to grant these rights.

Limitation Of Liability; Indemnity

Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, Intel and its affiliates, related corporations, and subsidiaries (including each of their respective directors, officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Contest.

Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, Intel and its affiliates, related corporations, and subsidiaries (including each of their respective directors, officers, employees and agents) are not responsible for and exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under Intel's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by Intel) due to any reason beyond the reasonable control of Intel; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use/redemption of a prize.

You undertake to indemnify and keep Intel and its affiliates, related corporations, subsidiaries, directors, officers, employees and agents harmless and indemnified against any loss, damage, claims, costs and expenses which may be incurred or suffered by any or each of them arising out of or in connection with your breach of any of these Terms and Conditions and/or your participation in the Contest.

Continued participation in the Contest is dependent on individuals following and acting in accordance with the LinkedIn, Facebook and Twitter Terms of Use and user guidelines (to the extent necessary and relevant to this Contest). This Contest is in no way sponsored, endorsed or administered by, or associated with, LinkedIn, Facebook or Twitter. Individuals understand that they are providing their information to Intel and not to LinkedIn, Facebook or Twitter. The information an individual provides will only be used for the purposes outlined in these Terms and Conditions. Any questions, comments or complaints about this promotion must be directed to the Promoter and not to LinkedIn, Facebook or Twitter. LinkedIn, Facebook and Twitter will not be liable for any loss or damage or personal injury which is suffered or sustained by an individual, as a result of participating in the Contest (including taking/use of a prize), except for any liability which cannot be excluded by law.

Intel's Decision Final And Binding

All matters and disputes arising out of or in connection with the Contest and/or these Terms and Conditions shall be subject to the sole decision of Intel, and Intel's decision shall be final and binding on all parties. No correspondence will be entertained.

Privacy

Intel collects personal information in order to conduct the Contest and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. Intel may, until 31/10/2013 unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant (including but not limited to in relation to promotions/offers conducted by Intel or its partners/associates). Except as provided in these Terms and Conditions, the entrant's personal Information will only be used by Intel in accordance with applicable data protection laws and regulations and Intel's privacy policy referred to below, for the purposes of administering his/her participation in the Contest.  All personal information collected and used will be retained until 31/10/2013 and then permanently deleted.  Intel is committed to respecting your privacy. No Warranties

Intel and any agents or contractors (if any) that it may use in the execution and management of the Contest do not warrant or represent (either directly or indirectly):

    that participation in and/or access to the whole or any part of the Contest, Contest materials, content, information and/or functions contained in them will be provided on an uninterrupted, timely, secure and error-free basis; or
    that no computer viruses shall be transmitted or that no damage shall occur to your computer system as a result of any online activity of the Contest (if any).

Any material downloaded or otherwise obtained through the Internet is done at your own discretion and risk, and you will be solely responsible for any damage to your computer system or loss of data resulting from such download.

Intel does not warrant or make any representations regarding the use, validity, accuracy, or reliability of, or the results of the use of, or otherwise in respect of the materials on the Contest site or any sites linked to the Contest site.

Intel's IP Rights Not Affected

Nothing in the Contest shall affect any intellectual property rights of Intel in any product or service which may be the subject matter of the Contest. No license is granted under this Contest to any person to any of Intel's intellectual property rights, either expressly, by implication, inducement, estoppels or otherwise. Any such license shall always be express and in writing.

No Cheating Tolerated

You acknowledge and agree that no form of cheating will be tolerated. If you are found cheating, as determined in the sole and absolute discretion of Intel, you will immediately be disqualified from the Contest. Cheating includes, but is not limited to, using multiple identification numbers, tampering with, hacking of the Contest site, participating in the Contest without meeting the eligibility requirements, using any automated software or device to gain an advantage during the Contest or give another person advantage during the Contest (including to enter or vote), use of the Contest beyond the defined rules of the Contest, attempting to disable or overwhelm any of Intel's websites or the Contest site, attempting to disrupt any portion of the Contest, including but not limited to, allowing somebody else to use your Personal Information, or tampering with the entry process.

ANY ATTEMPT BY A PERSON TO DELIBERATELY DAMAGE ANY OF INTEL'S WEBSITES OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS; AND SHOULD SUCH AN ATTEMPT BE MADE, INTEL RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

Validation and Verification of Entries/Votes and No Waiver

Intel reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence and employment) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at Intel's discretion. Intel's failure to enforce any provision of these Terms and Conditions shall not constitute a waiver of that or of any other provision. Errors and omissions may be accepted at Intel's discretion.

Intel reserves the right, at any time: (a) to invalidate any votes which it reasonably suspects have been submitted using false, incorrect, fraudulent or misleading information, including but not limited to personal details and contact information and/or votes that have been submitted through the use of multiple identities, email addresses or accounts; and/or (b) to disqualify any entrant (or invalidate his/her entry) that Intel reasonably suspects has paid, bartered or offered payment or other consideration to another person in exchange for votes or has otherwise encouraged or procured any person to submit votes contrary to these Terms and Conditions.

Incomplete or indecipherable entries will be deemed invalid.

If there is a dispute as to the identity of an entrant, Intel reserves the right, in its sole discretion, to determine the identity of the entrant.

Modification Of These Terms And Conditions, Etc

If this Contest is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of Intel, including but not limited to technical difficulties, unauthorised intervention or fraud, Intel reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Contest and these Terms and Conditions, as appropriate.

Laws

The Contest shall be governed by and interpreted in accordance with the laws of Australia. The Contest is void where prohibited or restricted by law, and is subject to all applicable laws.

No Third Party Rights

A person who is not a party to this agreement shall not have any rights to enforce any of its terms. For the purposes of this paragraph, "person" shall mean a human being or a corporate entity (whether or not having a separate legal personality), as the case may be.
