HOW TO ENTER:
To be eligible to enter, consumers must, undertake the following steps, during the period commencing at 9.00am AEST on 8/7/13 and ending at 11.59pm AEST on 4/8/13:
purchase, in one (1) transaction, any three (3) Cup a Soup products from any Foodland, IGA, Super IGA, IGA Express or Foodworks store within Australia ("Qualifying Transaction"); and
visit
www.cupasoup.com.au, and enter their personal details along with the three (3) product barcodes and the full store receipt number from the Qualifying Transaction.
Entrants must retain a photocopy of their store receipt(s) and original product barcodes for all entries as proof of purchase. The Promoter may request a photocopy of the store receipt(s) and original product barcodes from the entrant to verify the validity of an entry and reserves the right to declare any entry invalid if a photocopy of their store receipt(s) and/or original product barcodes cannot be provided.
TERMS AND CONDITIONS
Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
Employees of the Promoter, employees of participating Foodland, IGA, Super IGA, IGA Express and Foodworks stores, the Promoter's associated companies, the agencies associated with this promotion and the immediate families of any such persons listed above, are ineligible to enter. Entrants under the age of eighteen (18) years must obtain the consent of their parent or legal guardian to enter and the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion.
Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per specified purchase requirement; (b) each entry must be submitted separately and in accordance with entry requirements; and (c) unrecognised barcode/store receipt numbers will be deemed invalid.
There will be five (5) prize draws conducted for this promotion. Four (4) weekly prize draws and one (1) major prize draw. Entries close for each weekly prize draw at 11.59pm AEST on the Sunday preceding the weekly prize draw and final entries close at 11.59pm AEST on 04/08/13. The major prize draw will take place on 06/08/13 at 5.00pm and the weekly prize draws will take place each Monday at 5.00pm AEST commencing on 15/07/13 and ending on the 05/08/13. Non-winning entries in each weekly prize draw will be entered into any subsequent weekly prize draws and all entries (including winners in a weekly prize draw) will be entered into the major prize draw. All prize draws will be conducted at 30 thirty, Level 2, 50 Yeo Street, Neutral Bay, NSW 2089. All winners will be notified in writing and by phone within two (2) business days of the relevant prize draw and their names will be published on
www.cupasoup.com.au on 19/08/13. The Promoter's decision is final and no correspondence will be entered into.
The first five (5) valid entries drawn, in each weekly prize draw will each win one (1) x $500 HRG Australia travel voucher. A total of twenty (20) weekly prizes will be awarded for the promotion.
Any ancillary costs associated with redeeming a HRG Australia voucher are not included. Any unused balance of a HRG Australia voucher will not be awarded as cash. Redemption of a HRG Australia voucher is subject to any terms and conditions of the issuer including those specified on the HRG Australia voucher.
HRG travel voucher conditions. A voucher can only be used for travel booked through HRG Australia and is not redeemable as travellers cheques or cash. The original voucher must be returned and is treated like a cash receipt; no document release without the original voucher. Vouchers are not transferrable and travellers will not have access to HRG Emergency Afterhours Service. Voucher is valid from the date of issue. Voucher can only be used for Prepaid Travel Arrangements.
The first valid entry drawn, in the major prize draw, will win their choice of a luxury holiday to either, Jamaica, Mauritius, Costa Rica or Moorea (as outlined below), valued at up to $20,000 AUD, depending on date and point of departure. The major prize winner must book their holiday prize within two (2) months (60 days) of being drawn and must take the holiday prize, in its entirety, within twelve (12) months of booking the holiday prize.
Spending money, meals (unless specified above), taxes (excluding airline and airport taxes), additional insurance, transport to and from departure point, additional transfers, items of a personal nature, in-room charges and all other ancillary costs are not included.
The major prize winner and their companion are responsible for ensuring that they have valid passports, and any requisite visas, vaccinations and travel documentation.
During the entire duration of the major prize, a nominated parent/guardian must accompany any person under eighteen (18) years of age.
Frequent flyer points will not form part of the major prize. Major prize is subject to the standard terms and conditions of individual prize and service providers. The major prize winner may be required to present their credit card at time of accommodation check in.
Total prize pool is valued at up to $30,000 AUD.
If the winner of a prize is under the age of eighteen (18) years, the prize will be awarded to the winner's nominated parent or guardian on the winner's behalf.
The Promoter reserves the right to verify the validity of entries and entrants, at any time during or after the promotion, and reserves the right to disqualify any entrant (and ALL entries submitted by that entrant) for tampering with the entry process, or for submitting an entry which is not in accordance with these Terms and Conditions. Failure of the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
The Promoter may conduct a draw for any prizes that remain unclaimed at the same place as the original draw on 06/12/13 at 5.00pm AEDST. Winners of the unclaimed prize draw will be notified in writing and by phone within two (2) business days of the draw and their names will be published on
www.cupasoup.com.au on 20/12/13.
The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted from that source and by those entrants invalid.
The Promoter accepts no responsibility for tax implications that may arise from acceptance of the prize. Independent financial advice should be sought.
Any costs associated with accessing the promotional website are the entrant's responsibility and are dependent on the Internet service provider used. Any contact details entered incorrectly shall invalidate the entry. The Promoter is not responsible for receipt of incomplete, indecipherable or incomprehensible entries. All such inaccurate entries will be deemed invalid. No responsibility is accepted for late, lost or misdirected entries. Any entry that does not comply with these Terms and Conditions will be invalid.
Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
Subject to the unclaimed prize draw clause, if for any reason a winner does not redeem their prize (or an element of their prize), by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia ("Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) taking of a prize/use of a prize.
It is a condition of entry that the major prize winner (or if the major prize winner is under 18 years of age, their parent/guardian) may be required to execute a Deed of Acknowledgement and/or a Release and Indemnity in a form prescribed by the Promoter in its discretion.
In the event of war, terrorism, state of emergency or disaster the Promoter reserves the right to cancel, terminate, modify or suspend the promotion subject to any written directions from a relevant regulatory authority.
To the extent permitted under law, the Promoter is not responsible for any incorrect or inaccurate information, either caused by the telephone or internet user or for any of the equipment or programming associated with or utilised in this promotion, or for any technical error, or any combination thereof that may occur in the course of the administration of this promotion including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, technical problems or traffic congestion on the internet or website, software failure, theft or destruction or unauthorised access to or alteration of entries and any injury or damage to entrants or any other person's computer related to or resulting from entering or downloading any materials in the promotion. If for any reason this promotion is not capable of running as planned, including but not limited to technical failures, unauthorised intervention, fraud or any other cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and, subject to any written directions given by a relevant regulatory authority, to cancel, terminate, modify or suspend the promotion.
All entries become the property of the Promoter. The Promoter collects entrants' personal information in order to conduct the promotion. If the information requested is not provided, the entrant may not enter the promotion. By entering this promotion, unless otherwise advised, each entrant also agrees that the Promoter may use this information, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant, including sending the entrant electronic messages. Entrants' personal information may be disclosed to State and Territory lottery departments. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
The Promoter reserves the right to request winners to provide proof of age, identity and residency at the nominated prize delivery address. Identification considered suitable for verification is at the discretion of the Promoter.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
