“TIGER – GET YOUR NAME ON A PLANE” PROMOTION
TERMS AND CONDITIONS
1. Information on how to enter, vote and the prizes form part of these Terms and Conditions.
Participation in this promotion is deemed acceptance of these Terms and Conditions.
Eligibility to Enter & Vote

2. Entry and voting is only open to Australian residents aged 18 years or over who are available to
travel from 7 to 8 September 2013, with flight departure/return from Melbourne, Victoria
.

3. Employees (and their immediate families) of the Promoter and agencies associated with this
promotion are ineligible to enter/vote. Immediate family means any of the following: spouse, exspouse,
de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent,
grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, stepsister
or 1st cousin.

Eligibility to Win a Prize
4. To be eligible to win a prize, an eligible individual must:
(a) visit the TigerAir Australia Facebook Page at www.facebook.com/tigerairaustralia (“TigerAir
Facebook Page”);
(b) select the ‘like’ button on the TigerAir Facebook Page (if not done so already); and
(c) click the ‘allow’ button as prompted, to permit the Promoter access to their basic information
.

5. It is not mandatory for entrants to nominate a Plane Name in Round 1, or vote for a Plane Name in
Round 2 or 3 to be eligible to win a prize. However, the entrant’s ‘first’ name, ‘middle’ name, ‘last’
name, ‘display’ name, or ‘alternative’ name listed in their General Account Settings on their
Facebook profile must be the SAME as one of the ‘Finalists Names’ (as outlined in details of
Round 2 and 3 below), for the chance to win a prize. All winners are determined by skill. Entrants
should campaign for Facebook friends to vote for the ‘Finalist Name’ applicable to their Facebook
profile name, and allocate the vote to them at the time of voting, to increase their chance of
winning. Further details of the prize and the determination of the ten (10) winners are outlined
below.

Round 1 (Nomination of Plane Names by Entrants)
6. Round 1 commences on 8 July 2013 and ends at 11.59pm AEST on 12 July 2013
(“Period 1”).
7. To enter Round 1, eligible individuals must complete the following steps during the Period 1:
(d) visit the TigerAir Australia Facebook Page at www.facebook.com/tigerairaustralia (“TigerAir
Facebook Page”);
(e) select the ‘like’ button on the TigerAir Facebook Page (if not done so already);
(f) click the ‘allow’ button as prompted, to permit the Promoter access to their basic information;
(g) input the requested details including their suggested name for the plane (“Plane Name”), and
their valid email address;
(h) read and consent to these Terms and Conditions by clicking the relevant tick-box; and
(i) select the ‘submit’ button.
8. For an entrant to be eligible to receive vote/s for their suggested Plane Name in Round 3
(outlined below), their Plane Name must be their own name or nickname, and this
name/nickname must be listed as their ‘first’ name, ‘middle’ name, ‘last’ name, ‘display’
name, or ‘alternative’ name in their General Account Settings on their Facebook profile. The
Promoter encourages entrants to input their own name or nickname for the suggested Plane
Name. However, an entrant may input a name that is not their own name or nickname on entry.
Any suggested Plane Name by an entrant must not use explicit or derogatory language and must
adhere to the requirements under clause 11 of these Terms and Conditions.
9. Entrants have the option of receiving email updates regarding this promotion by selecting the
relevant tick-box on entry. Selecting this tick-box is not mandatory for entry into the promotion.
10. Only one (1) entry permitted per person and Facebook account for each day of Period 1.
11. When an entrant submits any information/materials via the promotion including but not limited to a
Plane Name (“Content”), the entrant, unless the Promoter advises otherwise, licenses and grants
the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide,
irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display such
Content for any purpose in any media, without compensation, restriction on use, attribution or
liability. Entrants agree not to assert any moral rights in relation to such use and warrant that they
have the full authority to grant these rights.
Entrants agree that they are fully responsible for the Content they submit. The Promoter shall not
be liable in any way for such Content to the full extent permitted by law. The Promoter may
remove any Content without notice for any reason whatsoever. Entrants warrant and agree that:
(a) they will not submit any Content that is unlawful or fraudulent, or that the Promoter may deem
in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene,
derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening,
objectionable with respect to race, religion, origin or gender, not suitable for children aged under
15, or otherwise unsuitable for publication; (b) they will obtain full prior consent from any person
who has jointly created or has any rights in the Content, to the uses and terms herein; (c) their
Content shall not contain viruses or cause injury or harm to any person or entity; and (d) they will
comply with all applicable laws and regulations, including without limitation, those governing
copyright, content, defamation, privacy, publicity and the access or use of others' computer or
communication systems.
Without limiting any other terms herein, the entrant agrees to indemnify the Promoter for any
breach of the above terms.

Round 2 (Top 5 Plane Names)
12. Round 2 commences on 15 July 2013 and ends at 11.59pm AEST on 26 July 2013
(“Period 2”).
13. All valid names nominated in Period 1 will be uploaded onto the promotional application of the
TigerAir Facebook Page, for voting by the public. Entrants are encouraged to campaign for their
Facebook friends to vote for their nominated Plane Name/s.
14. To submit a vote for Round 2, eligible voters must complete the following steps during Period 2:
(a) visit the TigerAir Facebook Page;
(b) select the ‘like’ button on the TigerAir Facebook Page (if not done so already);
(c) click the ‘allow’ button as prompted, to permit the Promoter access to their basic information;
(d) input the Plane Name they would like to vote for by inputting the name into the requested
field, and selecting the relevant name from the drop-down menu for that field. Only Plane
Names validly nominated during Period 1 may be selected to receive a vote; and
(e) select the ‘vote’ button.
15. The voting page allows each voter to vote for up to three (3) Plane Names before selecting the
‘vote’ button. Once a person selects the ‘vote’ button he/she is not permitted to complete the
above Round 2 voting process again. For the sake of clarity, a maximum of three (3) votes are
permitted per person and Facebook account.
16. Plane Names will be listed according to the number of valid votes received, from highest to lowest.
The five (5) top ranked Plane Names will be deemed a “Finalist Name”. In the event of a tie for one
of the five (5) top ranked Plane Names (e.g. two (2) Plane Names receive the highest votes overall
but are both tied at 1,000 votes each), all Plane Names tied within the top five (5) ranked positions
will be deemed a ‘Finalist Name’.

Round 3 (Winning Plane Name)
17. Round 3 commences on 29 July 2013 and ends at 11.59pm AEST on 9 August 2013 (“Period 3”).

18. Each Finalist Name will be listed in the promotional application on the TigerAir Facebook Page for
voting by the public.
19. To submit a vote for Round 3, eligible voters must complete the following steps during Period 3:
(a) visit the TigerAir Facebook Page;
(b) select the ‘like’ button on the TigerAir Facebook Page (if not done so already);
(c) click the ‘allow’ button as prompted, to permit the Promoter access to their basic information;
and
(d) select the ‘vote’ button corresponding to the Finalist Name they would like to submit a vote
for.
A pop-up box will appear immediately following the selection of the ‘vote’ button specified above.
The pop-up box will contain a list of the voter’s Facebook friends that have the voted Plane Name
as either their ‘first’ name, ‘middle’ name, ‘last’ name, ‘display’ name, or ‘alternative’ name in their
General Account Settings on their Facebook profile. To allocate their vote above to one of these
Facebook Friends for the purposes of them having a chance to win a prize, the voter must select
the tick-box next to the relevant Facebook Friend listed and click the secondary ‘vote’ button which
is featured in the pop-up box. Only one (1) Facebook Friend may be selected in this process. For
the sake of clarity, selection of a Facebook Friend does not result in two (2) votes for the Plane
Name voted for, it will only result in one (1) vote for the selected Plane Name, with that vote also
being allocated to the selected Facebook Friend for the purposes of determining the winners (as
detailed below).
20. Only one (1) vote permitted per person and Facebook account for Round 3.
Determination of Winners (10 Winners total)
21. The Plane Name that obtains the highest votes overall at the end of Round 3 will be deemed the
“Winning Name”. All entrants who submitted that Winning Name for Round 1 will be ranked based
on the number of valid votes they obtained in Round 3 as specified above, from highest to lowest.
The ten (10) top ranked entrants from this group will each be deemed a winner for the promotion.
22. Tie-break mechanic: In the event of a tie affecting the determination of the top ten (10) ranked
entrants, all relevant tied entrants will be contacted by the Promoter and asked to provide an
answer to a 25-words or less skill based question, stipulated by the Promoter. The tied entrants
will then be ranked according to their answer to the 25-words or less question (with the Promoter
judging based on originality and creative merit), from best to worst answer, in order to determine
the final list of ten (10) winners. In the event that a tied entrant does not provide an answer in the
time frame required by the Promoter, he/she will automatically be disqualified.

Prizes
23. Each winner will receive the following prize:
 their “Winning Name” will be printed onto the side an a320 TigerAir aeroplane (the first
TigerAir re-branded plane to be flown in Australia);
 return flights for the winner and fifteen (15) travel companions from Melbourne to a location
yet to be determined on the abovementioned plane (departing Melbourne on 7 September
2013, with the return flight departing on 8 September 2013); and
 one (1) night twin-share accommodation at the destination location for the flight (with the exact
accommodation venue determined by the Promoter in its absolute discretion).
All ten (10) winners and their respective travel companions will depart and return on the same
flight, as listed in the prize details above. The exact destination location for the above listed flight
will be provided to the winner at the time of notification of winning a prize, and may be published
before this on the TigerAir Facebook Page. The winner and/or one (1) of their travel companions
may be required to share a room with another winner or a travel companion of another winner.
24. The winners will be notified by email.
25. All costs associated with travel to and from the departure point of Melbourne Tullamarine Airport,
Victoria will be the responsibility of each winner and their respective travel companions. In the
event that a winner is unavailable to take the prize or is unwilling to take the prize from Melbourne
on the set dates/times outlined above, he/she will forfeit their right to the prize and the prize will be
awarded to the next highest ranked entrant for that Winning Name, based on votes.
26. Spending money, meals, insurance, transport to and from departure point, transfers, items of a
personal nature, in-room charges and all other ancillary costs are not included.
27. During the entire duration of the prize, a nominated parent/guardian must accompany any person
under 18 years of age.
28. Each winner and his/her travel companions are responsible for ensuring that they have valid travel
documentation (including any required identity documents). Each winner (and his/her travel
companions) must depart from and return to the same departure point and travel together. Trip
itinerary to be determined by the Promoter in its absolute discretion. Frequent flyer points will not
form part of the prize. Prize is subject to the standard terms and conditions of individual prize and
service providers. Each winner may be required to present their credit card at time of
accommodation check in.
29. If for any reason a winner does not take a prize (or an element of a prize) at the time stipulated by
the Promoter, then the prize (or that element of the prize) will be forfeited and will not be
redeemable for cash.
30. Subject to the terms and conditions of the participating prize provider(s), if for any reason a winner
does not, once the prize has been booked, take the prize (or an element of the prize) at the time
stipulated, then the prize (or that element of the prize) will be forfeited and will not be redeemable
for cash.
31. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to
cancel, terminate, modify or suspend the promotion, or suspend or modify a prize.

General
32. This is a game of skill and chance plays no part in determining the winners.
33. The Promoter reserves the right, at any time, to verify the validity of entries/votes and
entrants/voters (including an entrant’s/voter’s identity, age and place of residence) and to
disqualify any entrant/voter who submits an entry/vote that is not in accordance with these Terms
and Conditions or who tampers with the entry/voting process. Errors and omissions will be
accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any
stage does not constitute a waiver of those rights.
34. The Promoter reserves the right, at any time: (a) to invalidate any votes which it reasonably
suspects have been submitted using false, incorrect, fraudulent or misleading information,
including but not limited to personal details and contact information and/or entries/votes that have
been submitted through the use of multiple identities, email addresses or accounts, including but
not limited to social networking accounts; and/or (b) to disqualify any entrant/voter (or invalidate
his/her entry, entries and/or votes) that the Promoter reasonably suspects has paid, bartered or
offered payment or other consideration to another person in exchange for votes or has
otherwise encouraged or procured any person to submit votes contrary to these Terms and
Conditions.
35. Incomplete or indecipherable entries/votes will be deemed invalid.
36. If there is a dispute as to the identity of an entrant/voter, the Promoter reserves the right, in its sole
discretion, to determine the identity of the entrant/voter.
37. The Promoter’s decision is final and no correspondence will be entered into.
38. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to
substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.
39. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken
as cash.
40. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they
are a winner (including photograph, film and/or recording of the same) in any media for an
unlimited period without remuneration for the purpose of promoting this promotion (including any
outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
41. If this promotion is interfered with in any way or is not capable of being conducted as reasonably
anticipated due to any reason beyond the reasonable control of the Promoter, including but not
limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right,
in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant/voter; or (b)
to modify, suspend, terminate or cancel the promotion, as appropriate.
42. Any cost associated with accessing the TigerAir Facebook Page is the entrant’s/voter’s
responsibility and is dependent on the Internet service provider used.
43. The use of any automated entry or voting software or any other mechanical or electronic means
that allows an entrant/voter to automatically enter or vote repeatedly is prohibited and will render
all entries/votes submitted by that entrant/voter invalid.
44. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or
modify the statutory consumer guarantees as provided under the Competition and Consumer Act,
as well as any other implied warranties under the ASIC Act or similar consumer protection laws in
the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that
cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its
respective officers, employees and agents) excludes all liability (including negligence), for any
personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect,
special or consequential, arising in any way out of the promotion.
45. Except for any liability that cannot by law be excluded, including the Non-Excludable
Guarantees, the Promoter (including its respective officers, employees and agents) is not
responsible for and excludes all liability (including negligence), for any personal injury; or any loss
or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising
in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the
Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or
prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by
the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation
in prize value to that stated in these Terms and Conditions; (e) if prize flight trip is postponed,
delayed, or cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax
liability incurred by a winner, voter or entrant; or (g) participation in the prize event and/or taking of
the prize.
46. As a condition of accepting a prize, each winner (and his/her respective travel companions) must
sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in
their absolute discretion, including but not limited to a legal release and indemnity form. In the
event that a winner’s travel companion is under the age of 18, the parent/guardian of the travel
companion must sign the required forms as outlined in this clause on behalf of the respective
traveller.
47. The Promoter collects personal information in order to conduct the promotion and may, for this
purpose, disclose such information to third parties, including but not limited to agents, contractors,
service providers and prize suppliers. Entry/submitting a vote is conditional on providing this
information. If an entrant selects the option of receiving email updates regarding this promotion at
the time of entry, the Promoter will send the entrant these updates to the email address provided
on entry. All entrants also consent to their name being published on the TigerAir Facebook Page,
in the event they are a winner. Entrants/voters should direct any request to access, update or
correct information to the Promoter. All entries become the property of the Promoter.
48. Entry/voting and continued participation in the promotion is dependent on entrants/voters following
and acting in accordance with the Facebook Statement of Rights and Responsibilities, which can
be viewed at www.facebook.com/terms.php.
49. This promotion is in no way sponsored, endorsed or administered by, or associated with,
Facebook. Entrants/voters understand that they are providing their information to the Promoter
and not to Facebook. The information an entrant/voter provides will only be used for the purposes
outlined in these Terms and Conditions. Any questions, comments or complaints about this
promotion must be directed to the Promoter and not to Facebook. Facebook will not be liable for
any loss or damage or personal injury which is suffered or sustained by an entrant/voter, as a
result of participating in the promotion (including taking/use of a prize), except for any liability
which cannot be excluded by law.
