MILO Can Guessing Competition

If you’re the first to guess the correct number of MILO cans then you’ll win the prize.

MILO Can Guessing Competition & Game of Chance for Facebook Fans Terms and Conditions
1.   Information on how to enter & prizes form part of these terms & conditions. Any entry not complying with these terms and conditions is invalid.
2.   Entry is open to residents of Australia who are fans of the MILO Australia & New Zealand Facebook Fan Page (“Eligible Entrant”). Any entrant under the age of 18 years must have their parent or guardian’s permission to enter the promotion. Employees of the Promoter, the Promoter’s associated companies, the Promoter’s agencies associated with this competition and their immediate families are ineligible to enter.
3.   The promotion starts at 11.59am Australian Eastern Standard Time (“AEST”) on Monday 15 July 2013 & closes at 4.59pm AEST on Monday 5 August 2013 (“Promotion Period”).
4.   Follow these steps to send an entry:

Visit www.facebook.com/miloausnz and find the “Guess to Win” tab; Like our MILO Australia & New Zealand Fan page to access the entry form; Complete the entry form details including your contact details and your guess for the correct number of MILO cans in the Ice Box featured on the Entry Page.
5.   Entry is limited to once per Eligible Entrant. In the event that an Eligible Entrant sends more than one entry, only the first entry sent will be accepted.
6.   The Promoter reserves the right to verify the validity of all entries and reserves the right to disqualify any individual entrant or group of entrants for tampering with the entry process, including but not limited to the utilisation of techniques to make multiple entries or for submitting an entry which is not otherwise in accordance with these conditions of entry.
7.   In the case that the Promoter finds evidence of tampering by the entrant in the entry process or the verification process, in addition to declaring any or all entries made by the entrant invalid, the Promoter may in its complete discretion preclude that entrant from participation in any or all future promotions of the Promoter.
8.   All valid entries received during the Promotion Period have a chance to guess the correct number of MILO cans in the Ice Box will win the prize.
9.   The prize winner will be determined as the entrant who correctly guesses the correct number of MILO cans in the Ice Box. In the event that more than one entrant correctly
guesses, then the prize will be awarded to the entry received into the Promoter’s database first. In the event that no entrant guesses the correct number, then the entrant who guesses the number closest to the correct number without going over that number will win. In the event that more than one entrant guesses the same number closest to the correct number without going over, then the prize will be awarded to the entry received into the Promoter’s database first.
10. The prize is valued at up to $575 recommended retail price (“RRP”) which includes a MILO branded Ice Box and the MILO cans inside.
11. The prize winner will be determined by 5pm AEST on Monday 12 August 2013 at 61-63 Great Buckingham Street, Redfern NSW 2016 Australia. The prize winner will be determined according to the description at point 9 above.
12. The winner will be notified in writing via an email to the address they supplied with their winning entry within 48 hours and their name and town will appear on MILO Australia Facebook page by Friday 16 August 2013 and their name and postcode will also be published in The Australian on that date.
13. Total prize pool is valued at up to $575 RRP.
14. Prize is not transferable & cannot be taken as cash.
12. Prize value is correct at time of printing but no responsibility is accepted for any variation in the value of the prize.
13. The Promoter is not liable for any loss or damage whatsoever which is suffered, including but not limited to indirect or consequential loss, or for personal injury suffered or sustained during the course of accepting or using the prize, except for any liability which cannot be excluded by law.
14. Each entry becomes the property of the Promoter. All details will be held in accordance with the Nestlé Privacy Policy which can be accessed in Australia by visiting www.nestle.com.au or calling 1800 005 510.
15. Promoter’s decision is final and no correspondence will be entered into.

16. If the prize remains unclaimed by 5pm AEST on Tuesday 12 November 2013, despite the Promoter’s best efforts to contact a winner, then subject to any written directions given by a relevant lotteries or gaming authority the Promoter may consider the prize has been forfeited and re-award the unclaimed prize to the entrant who was the next to either correctly guess or come closest to correctly guessing the number of MILO cans in the MILO Ice Box. Any winner of the unclaimed prize will be notified in writing via an email to the address they supplied with their entry within 48 hours. Their name and postcode will appear on MILO Australia Facebook page by Friday 22 November 2013 and will also be published in The Australian on that date.
17. The winner should look to the manufacturer of products and provider or services awarded as prizes for all warranties. However, these terms and conditions do not exclude or limit the application of any statutory provision (including a provision of the Competition and Consumer Act 2010) where to do so would contravene that statute or cause any part of these terms and conditions to be void.
18. Subject to the approval process required by any relevant gaming or lotteries authority, in the event that any prize item is unavailable despite the Promoter’s reasonable endeavours to procure within Australia, the Promoter reserves the right to substitute a different prize item of equal or greater value.
19. The prize will only be delivered in Australia and the winner should allow 28 days from the date they advise the Promoter of the delivery address details for their prize.
20. If for any reason this Promotion is not capable of running as planned, whether caused by infection by computer virus, mobile phone failure, line drop out, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupt or affect the administration, security, fairness or integrity of the Promotion, the Promoter reserves the right in its sole discretion, (subject to any written direction given by a relevant Regulatory Authority), to cancel, terminate, modify or suspend the Promotion. The Promoter may in its sole discretion disqualify any individual who tampers with the entry process.
21. Entries are deemed to be received at the time of receipt into the Promoter’s database. The Promoter is not responsible for receipt of incorrect, inaccurate or incomplete information caused by an entrant or occurring during transmission. The Promoter is not responsible for any problems or technical malfunction of any telephone, telephone or computer network, or lines, servers, or telephone or internet providers, traffic congestion

on any phone or computer network, or any combination thereof, including any injury or damage to participants or any other person’s handset or computer related to or resulting from participation or sending or receiving of any communication or of any materials in this Promotion.
22. Entrants release Facebook from all liability in relation to the Competition. Entrants acknowledge that this Competition is in no way sponsored, endorsed or administered by, or associated with Facebook and that any information provided by entrants is provided to the Promoter and not to Facebook.
