TERMS AND CONDITIONS Win a Hyundai A-League Club Membership by picking the score
1. Information on how to enter form part of these terms and conditions. 2. The competition commences at 9am on Tuesday, 16 July 2013 and closes at 7.30pm
Saturday, 20 July 2013 (the Promotional Period).
3. Entry is only open to all Australian and New Zealand residents who have registered, been accepted as, and continues to be, a member of Facebook. Employees and the immediate families of the Promoter and agencies associated with this promotion are ineligible to enter. This includes contractors, agents and their immediate families and other party if applicable.
4. To enter participants must complete the following steps:
(A)   visit and ‘Like’ the Hyundai A-League Facebook Page (www.facebook.com/aleague); (B) open the A-League All Stars Pick Score Application (the Application) and read ,
acknowledge and agree to these Terms and Conditions; (C)   complete the entry form in the Application as required, including:
(i)   picking the correct score in the Foxtel A-League All Stars v Manchester United match to be played on 20 July 2013 (the Match); and
(ii)   explaining in 25 words or less why you think the Match will end in that score.
5. This is a game of skill and chance plays no part in determining the winner. Each valid entry will be individually judged a panel of judges (made up of representatives of the Promoter) based on literary and creative merit, brevity and originality as determined by the panel of judges. The Promoter's decision in this matter is final and no correspondence will be entered into it.
6. Entries must be received during the Promotional Period. Entries that are, or include, obscene, offensive, defamatory, inappropriate, unsuitable, or infringing content as determined by the Promoter at its sole discretion will be deemed invalid and are not eligible to win. Incomplete or incomprehensible entries will also be deemed invalid.
7. Judging will take place at Level 22, 1 Oxford Street, Darlinghurst NSW 2010 on Monday, 22 July 2013 at 10am (AEST).
8. The Winner will be notified via phone and/or email and winners name will be published on the Football Federation Australia website www.footballaustralia.com.au for a two (2) week period from the date of the prize draw.
9. If the winner is under the age of 18 years, the prize will be awarded to the winner’s parent or guardian.
10.If the winner cannot be contacted by the Promoter within two weeks of the judging date, the relevant winner/s entry will be deemed invalid and the Promoter reserves the right to distribute the prize to the next best valid entry.
11.There will only be one (1) major prize winner and ten (10) runners up prizes awarded to the best answer from each A-League Club (as nominated by the entrant). The major prize winner will win two (2) Hyundai A-League 2013/14 adult ticketed membership packages for the club of their choice and one (1) poster signed by the A-League All-Stars. The runners up will receive one (1) poster signed by the A-League All-Starts. All prizes include delivery to one Australian address as nominated by the winner.
12.The prize winner is responsible for all costs not expressly listed in paragraph 11 including without limitation, entertainment, gratuities, other travel, other ground transportation to activities outside set competition activities, visas, passports, travel insurance excesses, extra meals and drinks, items of a personal nature, hotel incidentals such as telephone, internet, mini bar, laundry, fax and room service, freights, excess baggage, government taxes, any tax liabilities, airline and airport charges, any applicable surcharges and any other related costs.
13.If for any reason the winner does not take a prize or an element of a prize at the time stipulated by the Promoter, then the prize or that element of the prize will be forfeited and will not be redeemable for cash. The winner cannot on sell the Major Prize. The Promoter’s decision is final and binding – no correspondence will be entered into. The Promoter accepts no responsibility for lost or misdirected entries. Incomplete or indecipherable entries will be deemed invalid.
14.If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
15.Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash. Stated prize values are the recommended retail value (including GST) in Australian dollars as provided by the supplier and are correct at the time of printing.
16.It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the Promoters reasonable requirements. The winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
17.In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion, subject to any written directions from a relevant regulatory authority.
18.The Promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if the Promoter determines, in their absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize.
19.In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner. The prize is not redeemable for cash and is not transferable.
20.If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
21.Entrants must only enter in their own name. The Promoter reserves the right to request the winners to produce appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm their identity, age, eligibility to enter and claim a prize and any information submitted by the entrant in entering the promotion before issuing a prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or the winning entrant has not been verified or validated to the Promoter’s satisfaction within the time requested, that winner’s entry will become invalid. The prizes will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion.
22.All entries become the property of the Promoter. As a condition of entering into this promotion, entrants agree to assign all of their rights, title and interest (including copyright) in and to their entry and any other material submitted as part of or in connection with an entry (“Material”) to the Promoter and consents to the Promoter using the entry and Material in any manner the Promoter wishes (including modifying, adapting or publishing the entry and Material in whole or in part or not at all), by way of all media, including, without limitation, posting their entry and Material (whether in original form or a modified or adapted by the Promoter as permitted under this paragraph) on the Promoter’s website without payment to the entrant (of royalties, compensation or otherwise). Each entrant warrants to the Promoter that each entry submitted is an original creative work of the entrant, which does not infringe the rights of any third party. Entrants agree to indemnify the Promoter against all costs and claims by third parties arising from a breach of this warranty and consents to any use of their entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).
23.Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or
any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the Prize. The entrant agrees not to bring any claim or proceeding against Promoter (including its officers, employees and agents) for any damage, loss, injury or liability you may suffer in participating in this competition or otherwise connected with you accepting and performing the prize.
24.Entrants consent to the Promoter using their name, likeness, image and/or voice in the event that they are a winner in any media for an unlimited period of time without remuneration for the purpose of promoting this promotion (including any outcome) and/or promoting any products, services or events supplied or conducted by the Promoter.
25.The Promoter collects personal information about entrants to include entrants in the promotion and where appropriate award prizes. If the personal information requested is not provided, the entrant may not participate in the promotion. By participating in the promotion, each entrant also acknowledges that a further primary purpose for collection of entrants’ personal information by the Promoter is to enable the Promoter to use the information to assist the Promoter in improving goods and services and to contact entrants in the future with information on special offers or provide entrants with marketing materials via any medium including mail, telephone and commercial electronic messages. By entering this competition, the entrant further acknowledges and agrees that the Promoter may share information with its Australian related companies and promotional partners who may contact entrants with special offers in this way. 26.Participation in this Promotion is considered acceptance of the following:
(A)   a complete release of Facebook by any entrant or participant; (B) an acknowledgement that this Promotion is in no way sponsored, endorsed or
administered by, or associated with Facebook; and (C) that the information provided by each entrant is provided to the Promoter (as detailed in
these Terms and Conditions) and not to Facebook.
27.Participation and entry in this Promotion is conditional upon the entrant complying with all rules, regulations and guidelines set down by Facebook.
28.Entrants acknowledge that their Facebook profile photograph may be featured on the Application and/or any associated Facebook page for public viewing. Facebook membership and the use of Facebook generally are subject to the Facebook prevailing terms and conditions of use available at www.facebook.com. Entrants understand that they are providing their information to the Promoter and not to Facebook. Entrants are solely responsible and liable for the content of their entries and any other information they transmit to other internet users via Facebook. To the extent permitted by law, each Entrant agrees to indemnify, defend and forever hold harmless, Facebook and its associated agencies and companies, against any and all losses, actions, claims, costs, expenses and damages (of any nature) which may be incurred by an Entrant in respect of the Entrant’s participation in the Promotion. Any questions, comments or complaints about this Promotion must be directed to the Promoter and not to Facebook.
29.Any term in these Terms and Conditions that is either wholly or partly unenforceable will be severed to the extent necessary to make the remaining terms of these Terms and Conditions enforceable.
