WIN A TRIP WITH ROXY AND MY ADVENTURE STORE
TERMS AND CONDITIONS OF ENTRY
1.By entering the “WIN A TRIP WITH ROXY AND INTREPID MY ADVENTURE STORE” (“Competition”), entrants accept these terms and conditions.
2.The promoter of the Competition is Ug Manufacturing Co Pty Ltd (ABN 63 005 047 941) of 27 Baines Crescent, Torquay VIC 3228, in conjunction with Intrepid Retail Pty Ltd (Trading as “Intrepid My Adventure Store” (ABN 811 301 480 24) of Level 2, 436 St Kilda Road, Melbourne ("the Promoter").
3.Entry is open only to legal residents of Australia (excluding South Australia). Entrants under 18 years of age must have a parent or guardian’s permission before providing personal information. Directors, officers, management, employees and other staff (and the immediate families of directors, officers, management, employees and other staff) of the Promoter and of its related bodies corporate, and of the agencies and companies associated with this Competition are ineligible to enter.
4.The Competition will commence at 0.01am AEST on 1 August, 2013 and entries close at 11.59pm AEST on 30 September, 2013 ("the Competition Period").
5.To enter, each entrant must, during the Competition Period subscribe to receive e-newsletters from The Promoter by completing an entry/subscription form ONLINE at roxy.com or INSTORE at a ROXY store in Australia (see roxy.com for a list of ROXY stores) or an INTREPID MY ADVENTURE store (see www.myadventurestore.com for a list of INTREPID MY ADVENTURE stores) and selecting one of five (5) incredible Adventures, as specified below (“Entry” / “Entries”). Each Entry can only nominate one Adventure.
6.Entries must be received by the Promoter during the Competition Period. Each entrant may only register one (1) entry into the Competition and can only enter in their own name. 7.The Promoter accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise. Online entries are deemed to be received at the time of receipt into the Promoter’s database NOT time of transmission by the entrant. Any form of automated entry using any device or software is invalid. All inaccurate and/or incomplete entries will be deemed invalid.
8.The draw will take place at 10am AEST on 14 October, 2013 at 27 Baines Crescent, Torquay VIC 3228 Australia. All eligible entries received during the Competition Period will be entered into the draw. The first valid and eligible entry drawn will win the Intrepid Adventure selected on his/her entry form (as specified below). ONLY ONE ADVENTURE / PRIZE WILL BE AWARDED.

The Inca Trail closes in February for cleaning and restoration works. If the trek portion of the Prize starts in February the alternate Inca Quarry Trail route will be taken. If Winner is unwilling or unable to hike the Inca Trail or Inca Quarry Trail they have the option of taking a train to Machu Pichu, subject to the payment of additional fees. Total Prize value up to: AUD $12,970.
PRIZE CONDITIONS
• The Promoter accepts no responsibility for any variation in the Prize value.
• The Prize must be taken during the periods specified by the Promoter. Extensions or variation to the nominated travel dates will be at the absolute discretion of the Promoter. All components of the Prize must be taken together. Any element of the Prize not taken will be deemed to be forfeited. For the avoidance of doubt, if the Winner (for whatever reason) is unable to travel on the dates stipulated by the Promoter then the Prize will be forfeited by the Winner.
• Prize travel must be booked by 31 December, 2013 and is subject to Tour and Flight availability. Once booked, any changes made to the booking may incur a cancellation or amendment fee, at the cost of the Winner and their travel companion. For further booking conditions see
www.myadventurestore.com/company/policies/booking-conditions • Flights will generally be from Adelaide (‘ADL’), Brisbane (‘BNE’, Melbourne (‘MEL’), Perth (‘PER’) or Sydney (‘SYD’) however routing will be subject to the departure date chosen by the Winner, location of the Winner’s place of residence and best available flights at the time of booking. If the cost of flights for the Winner and their companion exceeds the maximum value specified then the Winner (and their companion) will be required to pay the difference. If the cost of flights for the Winner and their companion is less than the maximum value specified then the Winner will not receive the difference. The Prize does not cover regional flights or any flights/accommodation or other costs associated with travel to/from the Winner’s place of residence to point of departure. Any costs associated with returning to the Winner’s place of residence and all other ancillary costs are at the expense of the Winner.
• Unless expressly stated, all other expenses associated with the Prize are the responsibility of the Winner (and their companion) including but not limited to pre and post tour accommodation (due to flight schedules), optional activities, spending money, meals and beverages, incidentals, laundry, room service, telephone calls, taxes (excluding departure taxes), gratuities, services charges, medical expenses, transfers and all other ancillary costs. Travel insurance is mandatory and is the responsibility of the Winner and their companion. The Winner is responsible for ensuring that he/she (and their travel companion) has the necessary documents to travel (including a current passport). A credit card imprint or cash deposit may be required from the Winner at accommodation check-in for incidental charges.
• The Promoter makes no representation as to the safety, conditions or other issues that may exist at any Prize destination.
• The Promoter is not responsible for any cancellation, delay or rescheduling of flights and any costs incurred as a result (including, without limitation, accommodation costs) will be the sole responsibility of the Winner.
• Taking the Prize is subject to any prevailing terms and conditions of the applicable airline operator and tour, accommodation, transport, services, transfers, travel insurance or tour providers, and in particular, health, behaviour, age and safety requirements. No compensation will be payable if the Winner and/or their travel companion are unable to use any element of the Prize as stated for whatever reason, including refusal of entry or point of departure or participation in certain activities for health, age, behaviour or safety reasons. Any part of a prize that is not taken for any reason is forfeited.
• In the event that the Winner is under eighteen (18) years of age, the Prize will be awarded to the Winner’s parent/s or legal guardian and a responsible adult must accompany the Winner during all Prize travel.
9.The Winner will be notified via e-mail and telephone (and in writing where required by the relevant authority). The Winner’s name and locality will also be announced on the ROXY website at
www.roxy.com for a period of 28 days (from 16.10.2013).
10.In the event that the Prize remains unclaimed by close of business on 02.12.2013, an unclaimed Prize draw will take place at 27 Baines Crescent, Torquay VIC 3228 on 03.12.2013 at 10am. In the event that there is a winner of the unclaimed Prize draw, s/he will be notified via email and telephone (and in writing where required by the relevant authority) following the unclaimed Prize draw, and shall have their name published on the ROXY website at
www.roxy.com for a period of 28 days.
11.The Promoter reserves the right to request that an entrant produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the entrant’s identity, age, residential address, eligibility to enter the Competition and claim the Prize and any information submitted by the entrant in entering the promotion, before issuing the Prize. If the documentation required by the Promoter is not received by the Promoter or the entrant or entry has not been verified or validated to the Promoter’s satisfaction within the time requested, that entry will be deemed invalid. The Prize will only be awarded following any validation and verification that the Promoter requires in its sole discretion.
12.The Winner must confirm their eligibility to be awarded the prize within fourteen (14) days of being successfully notified by the Promoter that they have been drawn, otherwise their entry will be deemed invalid. If their entry is deemed invalid, the Promoter will draw another Winner at the same time and place as the original draw and repeat this process until an eligible Winner is drawn.
13.It is a condition of accepting a Prize that the Winner (and their travel companion) sign a legal release in a form determined by the Promoter in its absolute discretion. If the Winner does not sign the release provided by the Promoter within the time requested by the Promoter, the Winner's entry or claim will be deemed invalid and the Promoter reserves the right to determine a new Winner in accordance with these terms and conditions.
14.Winner acknowledges that acceptance of the Prize may involve participating in dangerous activities. By accepting the Prize, the Winner accepts that risk. In order to participate in the activities that form part of the Prize, the Winner and their travel companion must comply with applicable health, fitness, skill, balance, dexterity and any other requirements normally associated with the particular activity. It is the entrant's responsibility to ensure that they are sufficiently healthy and fit so as to safely undertake the Prize activities.
15.The Promoter and its related bodies corporate will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person's negligence) in connection with this Competition or accepting the Prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
16.The Winner and their travel companion must, at the Promoter’s request, participate in all promotional activity (such as publicity and photography) surrounding the Competition or the winning of the Prize, free of charge, and they consent to the Promoter and its related bodies corporate using their name and image in promotional material. The Winner and their travel companion must sign a deed of release for the use of their name and image if required by the Promoter. If the Winner does not sign a deed of release provided by the Promoter within the time requested by the Promoter, the Winner's entry or claim will be deemed invalid. Where a Winner's entry or claim is deemed invalid, the Promoter reserves the right to determine a new winner in accordance with these terms and conditions.
17.The Prize is not transferable or exchangeable, nor can it be redeemed for cash. In the event for any reason the Winner does not take an element of the Prize at the time stipulated by the Promoter then that element of the Prize will be forfeited by the Winner and cash will not be supplied in lieu of that element of the Prize. The Promoter accepts no responsibility for any variation in Prize value. If the Prize or any element of the Prize becomes unavailable for any reason beyond Promoter’s control then a similar Prize or Prize element of equal or greater value will be awarded to the Winner in lieu, subject to the approval of the relevant authorities in the Australia, if required. Without limiting the foregoing, the Promoter may, at its absolute discretion, substitute cash for any prize (the amount of cash being equal to the prize value specified in these terms and conditions).
18.If for any reason any aspect of this Competition is not capable of running as planned, including by reason of war, terrorism, state of emergency, disaster, infection by computer virus, telephone network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify or suspend the Competition, or invalidate any affected entries, subject to the approval of the relevant authorities in Australia, if required.
19.Without limiting any other paragraph, the Promoter may at its discretion amend any aspect of this Competition or of these terms, subject to applicable laws and subject to the approval of the relevant authorities in Australian, if required. All decisions by the Promoter are final and no correspondence will be entered into. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
20.The information entrants provide will be used by the Promoter for the purpose of conducting this Competition. By entering this Competition, entrants consent to the storage of their personal information on the databases of the Promoter, its related bodies corporate and promotional partners (including Intrepid My Adventure Store) and the Promoter, its related bodies corporate and promotional partners (including Intrepid My Adventure Store) may use this information for future promotional and marketing purposes regarding their products and services including contacting entrants via any contact details provided by the entrant. The Promoter may also disclose entrants' personal information to its contractors and agents to assist in conducting this Competition or communicating with entrants.
