Terms and Conditions for: "Wippells Competition"
1. Method of entry: Entry into the competition is deemed acceptance of the terms and conditions. To enter, readers must collect an entry form published in The Chronicle (between Wednesday 13 November 2013 to Saturday 7 December 2013) and write in twenty five words or less why I ‘wish I had a BT50” and attach a photo of your current vehicle. The entry form must be original newsprint, no photocopies, scanned images, web prints, reproductions or other falsified artwork will be accepted. The completed entry form including the photo must be placed in an envelope marked "Wippells Competition" and then:
(a) sent by pre-paid post to "Wippells Competition", Po Box 3033, Village Fair Q 4350 (so it is received before the Closure Time); or
(b) delivered to Wippells, Herries St, Toowoomba Q 4350.
Contestants may submit more than one entry, but can only win any one of the four weekly prizes available.
2. Eligibility limitations: Contestants must be 25 years and over to enter. The following persons are ineligible to enter:
i. employees of, or contractors to, the Promoter and employees of or contractors to Wippells Mazda;
ii. the spouse, de facto spouse, parent, natural or adopted child, and sibling (whether natural or adopted by a parent), of such employees and contractors (whether or not they live in the same household);
iii. entrants who have used or attempted to use any more than one name in order to qualify to win any contest run by the Promoter except in the case of a legal change of name.
All entrants acknowledge that even if the Promoter only learns of a person’s ineligibility after the Promoter has appeared to award the prize to the ineligible person, it may require the return of the prize or payment of its value to the Promoter to be dealt with as an unclaimed prize.
3. Competition duration: The competition commences Wednesday 13 November, 2013 and closes at 5pm Wednesday 11 December, 2013 (“Closure Time”). Entries received after the Closure Time of 5pm will not be eligible. Weekly draws will close at the following times Week 1: 20 November 2013 at 5pm; Week 2: 27 November, 2013 at 5pm; Week 3: 4 December, 2013 at 5pm; Week 4: 11 December, 2013 at 5pm.
4. Prizes: There are 5 prizes in total to be won
There is a weekly prize of a $150 fuel voucher to be won for the entry that best describes and showcases the why I wish I had a BT50. (A fuel voucher will be given away each week for 4 weeks). Entries are not carried over to the next week.
There is a major prize to be given away at the end of the competition to the best entry overall selected from the four weekly winners. The prize includes a 3 night holiday at Kingfisher Bay Resort on Fraser Island. The package includes two interconnecting ocean view rooms and return passenger ferry transfers from River Heads for four people valued at $1671. The holiday must be used prior to 21 March 2014. The holiday cannot be used between 21 December 2013 and 6 January 2014. Food, beverages and other incidental expenses are not included and are at the winners expense. The winner is responsible for all other expenses including meals, beverages, other incidental expenses, transfers (unless specified), activities, incidentals, travel insurance, spending money, and all other ancillary costs.
The winner will also have the use of a Mazda BT50 for the trip to Fraser Island for the duration of the 3 night holiday provided by Wippells Mazda. This offer is available to the winner until 30 January, 2014. The driver must be 25 years and over and hold a current drivers licence. Additional fuel bought on the trip is at winner’s expense. A 1,000klm limit applies. No beach driving allowed. Insurance for the vehicle & occupants will be covered by Wippells/Mazda. The winners will be required to sign a Wippells Autos Loan Car sheet and insurance conditions form.
The value of all prizes is approximately $2271. All prizes are valued inclusive of GST and the Promoter takes no responsibility for any variation in item values.
Any taxes which may be payable as a consequence of a winner receiving the prize are the sole responsibility of that winner. Prizes are non-transferable and may not be redeemed for cash. If the specified prize becomes unavailable due to unforeseen circumstances, the Promoter may substitute a prize of similar nature and/or like or greater value. The Promoter takes no responsibility for any variation in item values.
5. Draw and notification: The winning contestants will be selected by a judging panel consisting of representatives from Wippells Mazda and representatives from The Chronicle at or around 9am on each Thursday for the following: Week 1: 21 November 2013; Week 2: 28 November 2013; Week 3: 5 December 2013; Week 4: 12 December 2013. The winners are selected on the criteria that best describes and showcases ‘why I wish I had a BT50. The overall winner will be selected at or around 11am on Thursday 12 December 2013 from the previous 4 weekly winners.
Judges decision is final and no correspondence will be entered into. Winner’s name will be published in The Chronicle on the following dates Week 1: 22 November 2013; Week 2: 29 November 2013; Week 3: 6 December 2013; Week 4 and overall winner: 13 December, 2013.
All Contestants acknowledge that the Promoter has the right to publicise and publish his / her name, character and likeness. All contest winners must avail themselves for a photo if required by the Promoter and acknowledge that the Promoter has the right to utilise publicity photos in any reasonable manner it sees fit without compensation to the Contestant.
6. Prize collection: Prizes must be claimed in person unless winner is otherwise advised and ID that includes a photograph may be required. Upon request by the Promoter a copy of these Terms and Conditions and/or a signed receipt and acknowledgement and/or legal release must be signed and endorsed by any winner to indicate his/her understanding and acceptance of these terms.
It is the sole responsibility of the winner to claim their prize. If the prize remains unclaimed after 2 January 2014, the prize will be awarded to second best entry overall on 3rd January 2014 at 10am at the same place as the original draw. In this event the winner, will be contacted directly on the phone number(s) provided.
In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.
7. Promoter's limitation of liability: The Promoter is not responsible for the loss of prizes due to incorrect or imprecise personal details or delivery details provided by a winner. The Promoter also takes no responsibility for prizes lost or stolen after they have been released for delivery via postage or courier. The Promoter makes no representations or warranties as to the quality/suitability/merchantability of any of the goods/services offered as prizes. To the extent permitted by law, the Promoter is not liable for any loss suffered or sustained by any person including, but not limited to consequential (including economic) loss by reason of any act or omission, deliberate or negligent, by the Promoter, or its servants or agents, in connection with the arrangement for supply, or the supply, of any goods or services by any person to the prize winner(s) and, where applicable, to any persons accompanying the winners.
The Promoter makes no representation as to the safety conditions or other issues that may exist.
8. Entries and privacy: All entries become and remain the property of the Promoter subject to the limits contained in the Privacy Statement and as set out in these terms and conditions. The Promoter also collects personal information in order to conduct the Promotion and may use and disclose such information in accordance with its privacy policy
