Terms and Conditions
1. Information on how to enter and prizes form part of these conditions. By participating, entrants agree to be bound by these conditions. Entries must comply with these conditions to be valid.
2. Entry is open to residents of Australia who are 16 years and over. Employees and their immediate families of the Promoter, its agencies and outlets associated with this promotion are ineligible to enter.
3. To enter upload a photo of your school, club or community football team along with the required details in the entry form at http\\:www.facebook.com/AussieApples.
4. The promotion will commence at 10:00EST on 10/02/2014 and close at 23:59EST on 07/03/2014 (“Promotional Period”).
5. The Prize draw will take place each weekday during the promotional period at 10:00EST at Horticulture Australia Limited, Level 7, 179 Elizabeth St, Sydney NSW 2000. Each day the best photo for both Australia rules and NRL will be judged. Each daily winner for Australian Rules and NRL will receive 45 Aussie Apples footballs.
6. Each daily winner for Australian Rules and NRL will receive 45 Aussie Apples footballs valued at $10 each. Total prize pool value RRP$18,000.00. All taxes (excluding GST) which may be payable as a consequence of receiving a prize are the sole responsibility of the winner. Prizes will be delivered to winners by mail before 28/03/14. Winners will be notified by mail and posted on the Aussie Apples facebook page.
7. If necessary, a second chance draw will be held at 15:00ESTon 11/04/14 at Horticulture Australia Limited (Level 7, 179 Elizabeth St, Sydney NSW 2000) in order to distribute any unclaimed prizes. Any second chance draw winners will be notified by telephone and mail within 2 days of the draw, and their names will be published on the Aussie Apples Facebook page.
8. Prizes are not transferable and are not redeemable for cash. The Promoter’s decision is final and binding - no correspondence will be entered into. The Promoter assumes no responsibility for any failure to receive an entry or for inaccurate information or for any loss, damage or injury as a result of technical or telecommunications problems, including security breaches. If such problems arise, then the Promoter may (where necessary with the approval of the relevant lottery authority) modify, cancel, terminate or suspend the promotion. If necessary and for any reason, the Promoter in its absolute and unilateral discretion modify, cancel, terminate or suspend the promotion the Promoter, employees, agents etc shall not be liable for any loss, damage or injury suffered by any Entrant.
9. If any prize becomes unavailable for reasons beyond the Promoter’s control, the Promoter may substitute a prize of equal or greater value, subject to any written directions from the lottery authorities.
10. The Promoter reserves the right to request verification of age, identity, residential address of and any other information from entrants relevant to entry into or participation in this promotion. Verification is at the discretion of the Promoter whose decision is final. The Promoter reserves the right to disqualify any individual who provides false information, fails to provide information, conspires with others to gain an unfair advantage or who is otherwise involved in any way in manipulating, interfering or tampering with this promotion.
11. The prize is subject to the terms and conditions of Horticulture Australia Limited Pty Ltd (ABN 19 095 566 108 ). The Promoter is not responsible or liable for any loss, damage or injury suffered by any winner as a result of the conduct of Horticulture Australia Llimited) or otherwise as a result of the winner accepting and/or using a prize except for any loss,
damage or injury which is due to the negligence or wilful misconduct of the Promoter or which otherwise cannot be excluded by law.
12. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event that they are a winner in any media for an unlimited period of time without remuneration for the purpose of promoting this promotion (including any outcome) and/or promoting any products manufactured, distributed and/or supplied by the Promoter.
13. The Promoter will own all entries. Details from entries will be collected and used for the purpose of conducting this promotion (which may include disclosure to third parties, including local lottery authorities, for the purpose of processing and conducting the promotion) and for promotional purposes surrounding this promotion. By entering this promotion entrants consent to the use of their information as described and agree that the Promoter may use this information, or disclose it to other organisations that may use it, in any media for future promotional, marketing and publicity purposes without any further reference or payment to the entrant.
