Terms and Conditions:

These terms and conditions of entry, including information on how to participate and prize details (Terms), apply to the Promotion and entry into the Promotion is deemed acceptance of these Terms.

The Promoter is Coca-Cola Amatil (Aust) Pty Ltd (ABN 68 076 594 119) of 40 Mount Street, North Sydney, New South Wales 2060 (Promoter).

The outlets participating in the Promotion are Caltex stores nationally (Participating Outlets) which are listed at http://www.caltex.com.au/HelpCentre/Pages/CaltexFinder.aspx

The Promotion will commence at 12:01am Australian Eastern Daylight Savings Time (AEDT) on 18/03/2015 and conclude at 11:59pm Australian Eastern Standard Time (AEST) on 14/04/2015 (Promotion Period).

WHO CAN ENTER

Entry in the Promotion is only open to Australian residents aged 18 years and over, excluding:

(a)management, employees, directors and contractors of the Promoter, its related bodies corporate, the Participating Outlets and other agencies, firms or companies associated with the Promotion (including suppliers of the prizes);

(b)a spouse, de-facto spouse, parent, guardian, child or sibling of a person referred to in paragraph 5(a) of these Terms;

(c)persons who have won a prize or prizes valued either individually or collectively at more than $5,000 (including GST) in any Promotion run by or on behalf of the Promoter, within the 12 months prior to the commencement of the Promotion Period;

(d)persons who have used or attempted to use any more than one name in order to qualify to win a promotion run by or on behalf of the Promoter (except in the case of a legal change of name); and

(e)persons who have breached the terms and conditions of any promotion run by or on behalf of the Promoter,

(Eligible Entrants). The persons referred to in paragraph 5(b) of these Terms includes natural and non-natural relations (in the opinion of the Promoter) and the Promoter is responsible for determining whether a person is an Eligible Entrant in its absolute discretion.

HOW TO ENTER

To enter and be eligible to win, Eligible Entrants must, during the Promotion Period:

(a)purchase any 1.25L bottle of the following eligible Coca-Cola products (Eligible Product) from a Participating Outlet:

(i)'Coca-Cola';

(ii)'Coca-Cola Zero';

(iii)'Diet Coca-Cola';

(iv)‘Fanta’;

(v)‘Sprite’; and

(vii)‘Lift’,

(Qualifying Purchase); and

(b)complete their entry in accordance with these Terms (Eligible Entry).

Eligible Entrants can complete their Eligible Entry during the Promotion Period by sending an SMS to 1999 5005, containing:

(a)the last five (5) digits of their Eligible Product barcode;

(b)their first name;

(c)their surname;

(d)their postcode; and

(e)their choice of AFL football club (either Adelaide, Brisbane, Carlton, Collingwood, Essendon, Fremantle, Geelong, Gold Coast, Greater Western Sydney, Hawthorn, Melbourne, North Melbourne, Port Adelaide, Richmond, St Kilda, Sydney, West Coast or Western Bulldogs) (Club),

(SMS Entry).

For an SMS Entry to be valid:

(a)it must be sent from an SMS enabled mobile handset (SMS entries sent via the internet are ineligible) that is connected to a service provider and service plan (if applicable) that permits the Eligible Entrant to send SMS to premium SMS numbers (some handsets are incompatible and some service providers and/or some service plans do not permit premium SMS);

(b)it must be identifiable by a MSISDN (unique mobile SIM number);

(c)the Eligible Entrant submitting the SMS Entry must have the bill payer's permission to enter the Promotion prior to submitting their SMS Entry; and

(d)it must be in the following format (Required Format):
E.g. last five (5) digits of Eligible Product barcode + First Name + Space + Surname + Space + Postcode + Space + Club

Maximum cost of each SMS Entry is 55 cents (including GST).

If an Eligible Entrant submits a valid SMS Entry which complies with the Required Format they will receive an SMS response confirming that their SMS Entry is valid and has been received (SMS Response).

If an Eligible Entrant submits an SMS Entry which does not comply with the Required Format and/or otherwise does not comply with these Terms, they will receive an SMS response informing them of the error in their SMS Entry (Error SMS Response).

SMS Response and/or Error SMS Response (as applicable) receipt times may vary and are subject to network coverage and availability, the number of entries received by the Promoter, the available memory on the entrant's mobile SIM card and other technical factors.

If the Eligible Entrant receives an Error SMS and chooses to submit a new SMS Entry in the Required Format, they will be charged an additional 55 cents (including GST).

Eligible Entrants can also complete their Eligible Entry during the Promotion Period by:

(a)Visiting www.CaltexFootyPromo.com and following the links to the Promotion entry page (Online Entry Site);

(b)fully completing and submitting the online Promotion entry on the Online Entry Site (Online Entry Form), including:

(i)all personal details required on the Online Entry Form, including but not limited to their first name, surname, email address, state, postcode and phone number;

(ii)their choice of Club;

(iii)the last five (5) digits of their Eligible Product barcode;

(iv)the last three (3) digits of the receipt number corresponding to the Qualifying Purchase; and

(v)indicating their acceptance of these Terms,

(Web Entry).
If an Eligible Entrant submits a Web Entry:

(a)which complies with these Terms, they will receive an onscreen notification confirming that their Web Entry is valid and has been received; or

(b)which does not comply with these Terms, they will receive an onscreen notification that their Web Entry is invalid,

whichever is applicable in the circumstances.

PRIZE DRAWS AND PRIZE INFORMATION

All random electronic prize draws will be conducted at Prime Focus, 403/62 Beach Street, Port Melbourne VIC 3207 (Draw Location) by a representative of the Promoter at 12 noon AEST on 15/04/2015 (Prize Draws).

There will be one (1) Prize Draw conducted for each of the 18 Clubs. Entries into each Prize Draw will be allocated into their respective club draw depending on the club chosen as part of each Eligible Entry.

The first Eligible Entrant with a valid Eligible Entry drawn in each Prize Draw will win an exclusive AFL Club experience with the Club indicated in their winning Eligible Entry valued at $5,200 (including GST) (Club Prize).

Each Club Prize includes:

(a)Chance to attend one (1) of the Club’s home games (Game), to be determined by the Promoter in its absolute discretion, and a chance to meet selected team members valued at $4,000 (including GST);

(b)Club jumper (number zero) to wear on the day of the Game valued at $100 (including GST);

(c)Two (2) tickets to watch the Game valued at $100 (including GST); and

(d)Signed/framed Club jumper valued at $1,000 (including GST).

Depending on which AFL Football Clubs make the 2015 AFL Grand Final at the Melbourne Cricket Ground on 03/10/2015, an additional prize will be awarded to the two (2) respective Club Prize winners whose Clubs make the 2015 AFL Grand Final, each comprising of two (2) General Admission tickets to the 2015 AFL Grand Final valued at $2,000 (including GST).

No flights, transport or accommodation are included in the prizes. Winners must make their own way to and from the Game, and 2015 AFL Grand Final (if applicable), locations as specified by the Promoter, at their own expense, in order to participate in their prize.

The Game will occur on a date and time, as selected by the Promoter in its absolute discretion, within 2015.

Each prize winner may elect to take a person under 18 years of age to accompany them at the Game, however in such instance they agree to act as their companion’s guardian for the duration of the event.

Any part of a prize that is not taken for any reason is forfeited.

Participation in a prize is subject to such other terms and conditions as may be imposed by those involved in providing other goods or services included in the prize (Third Party Terms).

The Promoter, prize providers and activity operators, in their absolute discretion, at all times reserve the right to: (a) prevent a Prize winner and/or their companion from participating in the Prize activity if, at any time, they reasonably believe that they pose a safety risk or for any other reason; and/or (b) cancel the prize activity if the conditions are deemed dangerous; and/or (c) vary and/or substitute the prize (or part thereof) without notice with a prize to the equal value and/or specification, subject to any written directions from a State and/or Territory regulatory authority.

As a condition of accepting a prize, the winner and companion must sign any legal documentation as and in the form required by the Promoter and/or prize providers in their absolute discretion, including but not limited to a legal release and indemnity form.

Prize winners acknowledge that elements of the prize are dangerous and may result in injury or death, and participate at their own risk. To the fullest extent permitted by law neither the Promoter, and/or any of its employees, contractors and agents or employees of its contractors and agents, and/or companies providing prizes for the Promotion, will be liable for any liability/cost/loss/damage/expense/death/personal injury suffered or incurred or any dispute (including, but not limited to, direct/indirect/consequential loss) arising out of, or in connection with this Promotion.

The prize winners and nominated companions participating in the relevant prize are responsible for compliance with all applicable Third Party Terms and bear all risks associated with failure to comply with any of them. They will be required to maintain an acceptable standard of behaviour while a participant in their prize. The Promoter assumes no liability (and will provide no compensation) to the prize winner and/or nominated companion who, as a result of any failure to comply with any Third Party Terms:

(a)are unable to participate in the relevant prize (or any part of it); or

(b)suffers any other loss or damage.

The total value of the prize pool available to be won in the Promotion is AU$97,600 (including GST).

WINNER NOTIFICATION

Prize winners will be notified by telephone and in writing will also be published in The Australian on 30/04/2015.

UNCLAIMED PRIZE DRAW (IF ANY)

If a prize is won an Eligible Entrant and they do not claim their prize by 12 noon AEST on 08/05/2015, a random electronic re-draw will be conducted on that date and time at the Draw Location by a representative of the Promoter from all remaining Eligible Entries received in the relevant Prize Draw/s, subject to any directions from State and/or Territory Gaming Departments (Unclaimed Prize Draw/s).

NOTIFICATION OF UNCLAIMED PRIZE DRAW WINNER/S (IF ANY)

Winner/s of the Unclaimed Prize Draw/s, if any, will be notified by telephone and in writing and will also be published in The Australian on 21/05/2015.

VERIFICATION

Eligible Entrants must retain the original purchase receipt from their Qualifying Purchase (Proof of Purchase) which corresponds to all entries they submit in the Promotion in order to claim any prize won.

If requested by the Promoter, provisional prize winners must produce, within the time requested by the Promoter at its absolute discretion:

(a)appropriate photo identification or other documentation, required by the Promoter to verify their identity, age, eligibility to enter the Promotion and claim a Prize and compliance with these Terms; and

(b)their Proof of Purchase that corresponds to all entries they have submitted in the Promotion,

before the Promoter issues their Prize. If the items required by the Promoter are not received or a provisional winning entry has not been verified to the satisfaction of the Promoter within the time period required by the Promoter, the provisional winner's entry will be invalid and, at the Promoter's absolute discretion, all of the provisional winner's remaining entries will be invalid. Prizes will only be awarded following all validation and verification requirements of the Promoter being met to its satisfaction.

If more than one person attempts to claim a particular Prize, the Promoter has sole and absolute discretion to determine which of those persons is the winning Eligible Entrant.

GENERAL

Each Qualifying Purchase counts towards one (1) Eligible Entry only.

A maximum of two (2) Eligible Entry may be received:

(a)per mobile phone number per day in the case of SMS Entries; and

(b)per household per day in the case of Web Entries,

subject to a limit of 20 Eligible Entries per mobile phone number and/or per household during the Promotion Period.

Eligible Entrants who are not residents of South Australia may win a maximum of one (1) prize in the Promotion only.

The Promoter is not responsible for technical difficulties with the entry mechanisms and does not warrant that any entry mechanism will be available at all times. Entrants acknowledge that SMS is not a guaranteed delivery communication tool.

Incomplete, illegible or incorrect entries, entries which are not in the Required Form (in the case of SMS Entries) or which contain offensive or defamatory comments, or which breach any law or infringe any third part rights, including intellectual property rights, are not eligible to win.

The use of any automated entry software of any other mechanical or electronic means that allows an entrant to automatically enter the Promotion repeatedly is prohibited and will render entries submitted using such means invalid.

All costs associated or arising in connection with the prizes are the responsibility of the prize winners.

Eligible Entrants can only enter the Promotion in their own name.

Prizes are not transferable, exchangeable or redeemable for cash. Prizes must be taken as offered and may not be varied.

Acceptance and use of the prizes is subject to terms and conditions imposed by those involved in providing goods and/or services as part of or in connection with the prizes.

The Promoter shall not be liable for the prizes or components of the Prizes being lost, stolen, damaged or tampered with in any way before they reach the winners.

The Promoter accepts no responsibility for any variation in the value of the prizes.

If the Promoter is unable to provide a winner with a nominated prize, the Promoter reserves the right to supply an alternative prize of similar monetary value to the nominated prize, subject to any directions given by State and/or Territory Gaming Departments.

The Promoter accepts no responsibility for any entries not received for any reason during the Promotion Period. No responsibility will be taken for lost, late or misdirected entries. The Promoter does not warrant that the entry mechanisms will be available, or the Participating Outlets will be open, at all times during the Promotion Period.

If, for any reason, the Promotion is not capable of being run as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud or any other causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, the Promoter reserves the right in its absolute discretion to take any action that may be available to it, subject to State and Territory regulations, including cancelling, terminating, modifying or suspending the Promotion.

Any entrant who, in the opinion of the Promoter, tampers or interferes with the entry mechanism or draws in any way, engages in any unlawful or improper conduct which jeopardises or is likely to jeopardise the fair or proper conduct of the Promotion, or who does not properly comply with the entry process, will be ineligible to win.

The Promoter reserves the right to disqualify entries in the event of non-compliance with these Terms. The Promoter's decisions in relation to all aspects of the Promotion are final and binding on each entrant and no correspondence will be entered into.

The Promoter collects personal information about entrants to include entrants in the Promotion and where appropriate award prizes. If the personal information requested is not provided, the entrant cannot participate in the Promotion. By participating in the Promotion, each Eligible Entrant consents to the Promoter using, and disclosing their personal information to the Promoter's related entities, the Promoter's agencies and other third parties engaged to provide services in connection with the Promotion (including suppliers of prizes) for use for the following purposes:

(a)contacting the entrant in relation to the Promotion;

(b)improving the Promoter's or the Promoter's related entities' goods and services; and

(c)in the Promoter's and its agencies case, the purposes set out in the Promoter's privacy policy (available by writing to the Promoter at the address set out in paragraph 2 of these Terms).

The Eligible Entrant provides this consent until such a time as they withdraw their consent by giving notice to the Promoter. Eligible Entrants can gain access to, update or correct any personal information held by the Promoter by contacting the Promoter at the address set out in paragraph 2 of these Terms. All personal information will be stored at the office of the Promoter.

By entering the Promotion, entrants agree and acknowledge:
(a)that the Promoter (or an agent of the Promoter) and/or, with the Promoter's consent (including consent subject to any conditions), the Participating Outlets (or an agent of the Participating Outlets), may:

(i)obtain comments from them about the Promotion and take photos or recordings of them (and contacting them for those purposes);

(ii)use any of the comments, photos or recordings obtained from them, their name, and/or likeness (the Materials) for the Promoter's and/or, with the Promoter's consent (including consent subject to any conditions), the Participating Outlets', future promotional and marketing purposes without further reference or compensation to them;

(iii)may duplicate, alter, adapt and utilise the Materials in any manner at any time, anywhere, and by any means (including communicating them to the public in any media, including media not yet in existence); and

(iv)may license, authorise or otherwise transfer the rights in the Materials to others to do the things outlined in paragraph 56(a)(iii) of these Terms;

(b)on creation of the Materials, they:

(i)grant to the Promoter a royalty free, perpetual, non-exclusive and irrevocable licence to use the Materials for whatever purpose the Promoter determines; and

(ii)where the Promoter consents, they grant to the Participating Outlets a royalty free, perpetual, non-exclusive and irrevocable licence to use the Materials for whatever purpose the Promoter consents to;

(c)they unconditionally and irrevocably:

(i)consent to any act or omission that would otherwise infringe any of their moral rights in the Materials (as defined in Part IX of the Copyright Act 1968 (Cth)) and present and future rights of a similar nature conferred by statute anywhere in the world whether occurring before or after this consent is given (Moral Rights); and

(ii)waive all Moral Rights in the Materials that arise outside Australia; and

(d)they agree not to institute, maintain or support any claim or proceeding for infringement of their Moral Rights in the Materials.

Eligible Entrants who submit a Web Entry, at the time of entering the Promotion, may consent to receive commercial electronic messages and CCA Marketing Communications (as defined in this clause) by checking the tick box on the Online Entry Form next to the following message: "I would like to sign up to receive information on special offers, exclusive competitions, new products and more from the Coca-Cola Amatil group of companies and its related entities" (Express Consent). Where an Eligible Entrant provides Express Consent, the Promoter will use the information provided by the Eligible Entrant on the Entry Form to send the Eligible Entrant further communications in relation to special offers, exclusive competitions, news and event information in relation to the Promoter's product range (CCA Marketing Communications). Eligible Entrants who do not provide Express Consent will not receive CCA Marketing Communications. Eligible Entrants may unsubscribe from the CCA Marketing Communications at any time. For the avoidance of doubt, an Eligible Entrant does have to provide Express Consent in order to enter the Promotion through a Web Entry.

Eligible Entrants who submit an SMS Entry may consent to receive commercial electronic messages and CCA Marketing Communications from the Promoter by visiting www.ccaclubhouse.com, completing the details required and checking the tick box next to the following message: "I would like to sign up to receive information on special offers, exclusive competitions, new products and more from the Coca-Cola Amatil group of companies and its related entities" (Express Consent). Where an Eligible Entrant provides Express Consent, the Promoter will use the information provided by the Eligible Entrant to send the Eligible Entrant CCA Marketing Communications. For the avoidance of doubt, an Eligible Entrant does not have to provide Express Consent in order to enter the Promotion by SMS.

The:

(a)Promoter, the Promoter's related entities, the Participating Outlets, and all agencies associated with the Promotion; and

(b)the employees, agents, directors and contractors, of all entities referred to in paragraph 59(a),

shall not be liable for any loss or claim, action, demand, liability, damage, cost, expense or personal injury whatsoever (including but not limited to any direct, indirect or consequential loss), incurred, suffered or sustained by any person or entity (without limitation) in connection with, or arising from, the Promotion or the acceptance or use of, or participation in, prizes, except that which cannot be excluded by law (in which case that liability is limited to the maximum extent allowable by law).

The Promoter accepts no responsibility for any tax liabilities that may arise from winning or receiving the benefit of a prize.

Eligible Entrants agree and acknowledge that all entries and any intellectual property rights subsisting in their entries become and remain the property of the Promoter.
