TERMS & CONDITIONS

GENERAL

1. The Promoter is News Limited (ABN 47 007 871 178) of 2 Holt Street, Surry Hills NSW 2010. Telephone number +61 2 9288 3000.

2. The Joint Partner is LiteracyPlanet (ABN 44 128 896980) of 3/23 Main Street, Varsity Lakes QLD 4227. Telephone number +61 7 5656 9696.

3. Information on how to enter and prizes forms part of the terms of entry. Entry into the competition is deemed acceptance of these terms and conditions.

4. To the extent of any inconsistency between these Terms and Conditions and any other reference to this competition, these Terms and Conditions prevail.

WHO CAN ENTER

5. Entry is open to all residents of NSW, VIC, QLD, SA & WA except employees and immediate families of the Promoter, their Joint Partner LiteracyPlanet and both their associated companies and agencies and participating outlets. Immediate family means any of the following: spouse, ex-spouse, defacto spouse, child or step child (whether natural or by adoption), parent, step parent, grandparent, step grandparent, uncle, aunt, niece, nephew, brother, sister, step brother, step sister or 1st cousin.

6. All entrants under the age of 18 must obtain the prior permission of their legal parent or guardian over the age of 18 to enter. The parent or guardian of the entrant must read and consent to all Terms and Conditions. The parent or guardian may be called to verify consent and may be required to sign a release at the discretion of the Promoter. The release will require the winner’s parent or guardian to accept responsibility for the acts and forbearances of the winner. The release will include the full name, address and telephone number of the winner’s legal guardian. Failure to provide such proof, particulars or releases will immediately invalidate the winner’s entitlement to the prize, subject to State and Territory legislation. If the competition winner is under 18 years of age, the prize will be awarded to the winner’s parent or legal guardian.

7. The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity or proof of registration ownership in order to claim a prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.

WHEN TO ENTER

8. The competition commences on Saturday 13/02/16 at 00:01am AEDT and concludes on Saturday 27/02/16 at 23:59pm AEDT. Entries must be received by the Promoter prior to the competition close date and time.

9. The time of entry will in each case be the time the online entry is received by the Promoter’s databases, not at the time of transmission by the entrant.

10. The Promoter accepts no responsibility for any late, lost or misdirected entries including online messages not received by the Promoter or delays in the delivery of the message due to technical disruptions, network congestionsor for any other reason. Entries via automatic computer generation and not attributable to a valid individual is invalid and will not be accepted.

HOW TO ENTER

11. Entrants may enter the competition by submitting their original entry by logging onto:

WA: perthnow.com.au/competitions

Then registering their details including (but not limited to) full name, address, post code, telephone number, e-mail address, and answer the entry question in the online entry form to complete their entry. The cost of accessing the promotional website will be dependent on the entrant’s individual Internet Service Provider.

12. Entrants are required to take full responsibility for the content of their entry and for ensuring that their entry complies with these Conditions of Entry. For the purposes of these content requirements, “entry content” includes any content (including text, photos, videos and email messages) that entrants submit, upload, transmit, publish, communicate or use in connection with their entry into the promotion. Entries must be the entrant’s original work. The Promoter reserves the right to verify, or to require the entrant to verify, that the entry is the entrant’s original work. If an entry cannot be verified to the Promoter’s satisfaction, the entry will be deemed invalid. The Promoter may, in its absolute discretion, edit, modify, delete, remove or take-down any part of an entrant’s entry. An entrant’s entry must not include:

(a) any image or voice of any other person without that person’s express consent. Entrants warrant that if any such content is included, they have obtained the express consent of the relevant person;

(b) any content that contravenes any law, infringes the rights of any person or is potentially insulting, inflammatory, defamatory, obscene, offensive, discriminatory, indecent or otherwise objectionable or inappropriate (which includes, without limitation, any content involving nudity, malice, excessive violence or swearing); and

(c) any literary, dramatic, musical or artistic work, any audio-visual or sound recording, or any other item in which copyright subsists, unless the entrant is entitled to do so. If an entrant has any doubts about whether they have the right to include any content (for example, recorded music) they must not include it. By including any such content in their entry, the entrant warrants that they have the permission of the relevant copyright owner to do so and that this permission allows the Promoter to use the entry in accordance with these Conditions of Entry.

The Promoter reserves the right to disqualify a winner if Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.

13. Any entry that is made on behalf of an entrant by a third party will be invalid, unless the entrant requires the assistance of a third partyto enter due to a disability.

14. The Promoter reserves the right to disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the promotion and/or Promoter. This includes, but not limited, to entrants and households using multiple email addresses, postal addresses, PO Box addresses or SIM cards to register single or multiple purchases.

NUMBER OF ENTRIES PERMITTED

15. Entrants may enter as many times as they like. Only one minor prize will be awarded per person. Minor prize winners are also eligible to go in the draw for their chance to win the major prize.

DRAW AND NOTIFICATION OF WINNER

16. The winner(s) will be the first valid entry submitted in accordance with these terms drawn by random computer selection at 11:00am AEDST on Monday 29/02/16 at 2 Holt St, Surry Hills NSW 2010.

This competition is a game of chance. Skill plays no part in determining the winner.

17. If any particular determination is scheduled on a weekend or public holiday, the determination will be take place on the following business day.

18. The Promoter’s decision is final and the Promoter will not enter into correspondence regarding the competition result or any other decisions the Promoter makes in connection with the promotion.

19. The winner(s) will be notified by telephone or email within two days of being determined. Winner will then be advised how to redeem their prize by the Promoter and Joint Partner. Winner(s) of prizes will be published on the competition winners page on thedailytelegraph.com.au/promotions, heraldsun.com.au/competitions, couriermail.com.au/competitions, advertiser.com.au/competitions and perthnow.com.au/competituions upon completion of the competition period or by 01/03/16.

20. Prize(s) will be awarded to person named in the entry. However, in a dispute, will be awarded to the account holder of the entry mechanism used to submit their entry (i.e. mobile phone account holder or land line account holder).

21. Should an entrant’s contact details change during the promotional period, it is the entrant’s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.

22. Subject to State Regulation, an unclaimed prize draw will take place at 2 Holt Street, Surry Hills, NSW 2010 at 11:00am AEDST on 30/05/16. The winner of the unclaimed prize will be notified by telephone or email on the date in which they are judged to be the unclaimed prize winner. Winner(s) will be published on the competition winners page on thedailytelegraph.com.au/promotions, heraldsun.com.au/competitions, couriermail.com.au/competitions, advertiser.com.au/competitions and perthnow.com.au/competituions.

PRIZE ON OFFER

23. MAJOR PRIZE:

One (1) major prize winner will receive a cash prize of $10,000 incl GST.

Major prize pool value: $10,000.00 incl GST

RUNNERS UP DAILY PRIZES:

Seventy (70) runners up in total.

One (1) runner up prize will be awarded per state (5), per day (14) for the length of the competition. Each runner up will receive a prize pack consisting of:

a) One (1) Dr Seuss book RRP $2.60 incl GST

b )One (1) 12 month subscription to Literacy Planet RRP $142.50 incl GST

Total runners up prize pool is valued at $10,157.00 incl GST

TOTAL PRIZE POOL IS VALUED AT $20.157 incl GST

PRIZE CONDITIONS: For parents it is a condition of accepting the overall cash prize that the winner be willing to be photographed by the Joint Partner. For teachers it is a condition of accepting the overall cash prize that they accept the prize at their school and be willing to be photographed by the Joint Partner.

24. Unless otherwise expressly stated, prize values are based upon the recommended retail prices at the time of first publication of these Terms and Conditions (inclusive of GST). The Promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.

25. Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.

26. In order to receive any cash prizes the name provided by the entrant in his or her entry must be the same as the name of an eligible bank account into which a cheque can be deposited. If a winning entrydoes not contain this information then the Promoter may not be able to distribute the prize to the winner.
