Terms and Conditions:
Information on how to enter and on the prize(s) form part of these Terms and Conditions, which are governed by the laws of the state of Victoria, Australia, the courts of which shall have non-exclusive jurisdiction. Participation in this promotion is deemed acceptance of these Terms and Conditions.
Entry is only open to residents of the Australian states of Western Australia, South Australia, Queensland, New South Wales or Victoria, aged 18 years and over. Employees (and their Immediate Family members) of the Promoter and any partners or parties directly associated or affiliated with the Promoter are ineligible to enter. Immediate Family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
Promotion commences on September 1 2016 and closes at 5:00pm AEST on 30 November 2016 (“Promotional Period”) but is subject to change by the Promoter.
To enter the promotion, entrants must publically post an image of a farm, paddock or crop, with the authority of the owner or lease of that farm, paddock or crop, using the entrant’s personal Twitter account during the Promotional Period. Entrants must include within their tweet the phrase ‘#paddockpride’.
The tweet will be deemed an entry if it complies with these Terms and Conditions and is visible to the public during, and until the end of, the promotional period and may be tracked by the hashtag #paddockpride in Sprout Social.
The Promoter reserves the right, at any time, to verify the validity of entries and the eligibility of entrants and to disqualify any entrant whose entry is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
Incomplete, indecipherable or illegible entries will be deemed invalid.
Entries containing profanity or otherwise offensive material will be disqualified.
Entries depicting plant varieties other than those distributed by Nuseed Australia Pty Ltd are not ineligible, however, entries promoting competitive products to those of Nuseed Australia Pty Ltd will be disqualified.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
The winning entries will be judged by the Promoter according to the post considered in the Promoter’s sole discretion to be the most interesting, engaging or inspirational in accordance with the competition terms.
The Promoter will determine the winner at the Promoter’s head office on 1 December 2016 at 9:00am AEST. The winner will be notified via Twitter message (“Direct Message”) within two (2) business days of the draw. The Promoter’s decision is final. The Promoter will publish the names of prize winner via the @NuseedAustralia Twitter account on 1 December 2016.
There will be 1 winner determined for this promotion . (Entries from Northern Territory, ACT and Tasmania are ineligible). If the Promoter is unable to determine which state an entrant resides in, the entry will be deemed invalid.
If this promotion is interfered with in any way or is not capable of being conducted as anticipated due to any event beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised interference or suspected fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
The winner of the competition will receive $5000 worth of seed (based on RRP, to the nearest bag). The winner may choose from, subject to availability, the following varieties: GT-53, GT-50, GT-42, Nuseed Diamond, ATR Mako, ATR Bonito, ATR Wahoo , Monola G11, Monola 416TT, Monola 515TT, Tiger, Dominator, Liberty, Lush, BMR Revolution, Nudan, Hunnigreen, Ausigold 62 or Ausistripe 14.
If the winner selects a Monola variety they will be required to sign a Monola Grower’s Contract prior to delivery of the seed.
Delivery will be arranged by the Promoter and the exact method will depend on the location of the winner. The winner may be required to travel to a distribution centre to accept delivery.
Delivery will occur before the next growing season for the chosen seed crop, in consultation with the winner.
Subject to these Terms and Conditions, the Promoter’s liability in all respects is limited to the value of the prize. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury, or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the promotion.
As a condition of accepting a prize, a winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
Original winning entrant will be given 2 weeks from 1 December 2016 to supply their postal address, PO Boxes excluded, for the delivery of their prize. If a secondary judgement is required it will be carried out at Promoter’s head office at 9am AEST on 1 March 2017 and the winner will be notified by Twitter direct message within two (2) business days of the judgement.
Each entrant hereby provides Promoter with an irrevocable worldwide non-exclusive royalty-free licence to use the entrant’s entry for marketing or promotional purposes, and hereby consents to alterations of the entry, non-attribution, and other uses of the entry that may infringe the entrant’s moral rights as defined in the Copyright Act 1968 (Cth).
