1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in “The $45,000 Toyriffic Giveaway” Promotion (“Promotion”) is deemed acceptance of these Terms and Conditions. All times stipulated in these Terms and Conditions are expressed in Sydney local time.
2. Subject to condition 3, this Promotion is only open to ACT, NSW, Victoria, and Queensland residents. Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to all terms and conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to this Promotion.
3. The following are ineligible: (i) employees of the Promoter, the Mirvac Group or any of the tenants or retailers in the Participating Centres or any of the Promoter’s agencies that are associated with the Promotion; (ii) the spouse, defacto spouse, parent, child or sibling (whether natural or by adoption) of an excluded employee; and (iii) any person who the Promoter has previously notified is not permitted to enter the Promoter’s promotions.
4. This Promotion commences at 12.01am on Monday 31ST October 2016 and ends at 11.59pm on Sunday 27th November 2016 (“Promotion Period”).
5. The Promotion will be conducted for the following shopping centres: NSW: Birkenhead Point (www.birkenheadpoint.com.au & facebook.com/birkenheadpoint);
Broadway (www.broadway.com.au & facebook.com/broadway); East Village (www.eastvillage.com.au & facebook.com/eastvillage); Cherrybrook Village (www.cherrybrookvillage.com.au & facebook.com/cherrybrookvillage);

St Marys Village (www.stmarysvillage.com.au & facebook.com/stmarysvillage);
Stanhope Village (www.stanhopevillage.com.au & facebook.com/stanhopevillage);
VIC: Moonee Ponds Centre (www.mooneepondscentral.com.au & facebook.com/mooneepondscentre);

There are two (2) components for this Promotion, namely “Component One” and “Component Two”. Eligible individuals can enter both components.
Component One
7. To receive an entry in Component One of this Promotion, eligible individuals must, during the Promotion Period, undertake the following steps:
i. Visit any of the websites listed in clause 5 (“Websites”) and follow the
prompts to the online entry form;
ii. Fully complete the official online entry form, including their full name, contact telephone number, valid email address and their post code of residence and submit the entry form online.
8. There is a limit of one (1) entry per person, per day (based on Sydney local time) during the Promotion Period for Component One. Each entry must be submitted separately and in accordance with the entry requirements. For every individual entrant in the competition (identified by an original email address), Mirvac will donate $1 to the Smith Family’s Toy and Book Appeal up to an amount of $20,000 (or equivalent to 20,000 individual entries). The final tally is to be calculated at the end of the promotional period. Entrants who make multiple entries in the competition with the same email address will only have the one (dollar) amount donated on their behalf.
9. The draw for Component One will take place at the Mirvac Head Office at 200 George Street, Sydney NSW 2000 at 12.00pm on Monday 28th November 2016. The Promoter reserves the right to draw reserves in case of an invalid entry or invalid entrant. The provisional winners will be notified by phone and email within 2 business days of the draw. Any provisional winners will only be deemed a winner once verified by the Promoter. All provisional winners will have their name and postcode published on each Participating Centre’s Website (see clause 5) on Tuesday 29th November 2016.
10. For the purpose of determining the major prize winners, all entries from all Websites will be combined. The first five (5) valid entries drawn in Component One will each receive the major prize of a Hasbro Toy Pack consisting of toys listed in ‘Schedule A’ with the RRP of $2011.69. The five (5) major prizes are valued at a combined total of $10,058.45.
11. There are also four (4) runners up Hasbro prize packs in ‘Schedule B’ to be drawn per Participating Centre. After selecting the major prize winners, entries received in Component One will be divided according to which Website the entrant entered by. Then the four (4) valid entries drawn from entries received at each Website (excluding those entries already drawn to receive the major prizes) will each win the runner up prize of a Hasbro prize pack as listed in Schedule B. Runner up prizes will be awarded in descending order of value with the most expensive awarded to the first entrant drawn. The total runners up prize pool per Participating Centre is
2019.54. There are 12 Participating Centres and a total of 48 runners up prizes. The total value of the runners up prizes is $24,140.28.
12. Total prize pool value of Component One is $34,198.73.
Component Two
13. Each Participating Centre will offer a daily facebook prize via their respective facebook page (as per clause 5) during the Promotion Period, as outlined in ‘Schedule C’ on offer for each Participating Centre.
14 For the chance to win a particular daily prize as listed in Schedule C, an individual must visit a Participating Centre’s facebook page during that particular day and comment on the promotional post for that day.
15. The public profile of the Facebook account used to enter must contain sufficient personally identifiable information to adequately identify the entrant.
16. The daily draws for Component Two will take place at the Mirvac Head Office at 200 George Street, Sydney NSW 2000 at 10.00am on the dates listed in Schedule C. The Promoter reserves the right to draw reserves in case of an invalid entry or invalid entrant. Provisional winners will be notified by direct message to the provisional winners via Facebook within 2 business days of the relevant draw. Any provisional winners will only be deemed a winner once verified by the Promoter. Each winner will be required to collect the prize from the centre management office of the centre.
17. There is a limit of one (1) entry per person, per day (based on Sydney local time) during the Promotion Period for Component Two. Each entry must be submitted separately and in accordance with the entry requirements. Entries received for a particular daily prize draw will not rollover to subsequent draws.
18. The total prize pool of all daily prizes at each Participating Centre as outlined in Schedule C is $957.52. With 12 Participating Centres, the total prize pool value of all daily prizes is $11,492.64
General
19. The total prize pool of both campaigns is $45,785.57.
20. It is a requirement of entry into the Promotion that the entrant agrees that their personal information can be used in accordance with these Terms and Conditions, including for the purposes set out in clause 36.
21. Any prize that has been won but remains unclaimed will be entered into the unclaimed prize draw. The unclaimed prize draw will take place at the same time and place as the original draw on 28 February 2017, subject to any directions from a regulatory authority. For the purpose of the unclaimed prize draw the Promoter will use entries received for Component One. The
winners, if any, will be notified by email within 2 business days of the draw by email and phone. All winners will have their name and postcode published on each Participating Centre’s website on 01 March 2017.
22. Incomplete, indecipherable or illegible entries will be deemed invalid.
23. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
24. Prize is subject to the standard terms and conditions of individual prize and service providers. If for any reason a winner does not take the prize or an element of the prize at the time stipulated, then the prize or that element of the prize will be forfeited and will not be redeemable for cash.
25. If any prize (or part of any prize) is unavailable due to reasons beyond the control of the Promoter, the Promoter its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
26. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
27. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
28. The Promoter reserves the right, at any time, to verify the validity of entries) and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
29. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority to modify, suspend, terminate or cancel the Promotion, as appropriate.
30. The Promoter’s decision is final and no correspondence will be entered into.
31. Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied
warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non- Excludable Guarantees, the Promoter and the Mirvac Group of companies (including their respective officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
32. Except for any liability that cannot by law be excluded, including the Non- Excludable Guarantees, the Promoter and the Mirvac Group of companies (including their respective officers, employees and agents) are not responsible for and exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or correspondence that is late, lost, altered, damaged or misdirected (whether received by the Promoter or not) due to any reason beyond the reasonable control of the Promoter; (d) any variation in the prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by an entrant or winner; or (f) use of the prize.
33. It is a condition of taking the prize, that the winner (or if under 18, their parent or guardian) sign a deed of release and indemnity in the form required by the Promoter or any prize supplier.
34. When applicable, entry and continued participation in the promotion is dependent on entrants following and acting in accordance with the Facebook Statement of Rights and Responsibilities (which can be viewed at www.facebook.com/terms.php).
35. This promotion is in no way sponsored, endorsed or administered by, or associated with Facebook. The information an entrant provides will only be used for the purposes outlined in these Terms and Conditions. Any questions, comments or complaints about this promotion must be directed to the Promoter and not to Facebook. 33. It is a condition of taking the prize, that the winner (or if under 18, their
parent or guardian) sign a deed of release and indemnity in the form
required by the Promoter or any prize supplier.
34. When applicable, entry and continued participation in the promotion is
dependent on entrants following and acting in accordance with the
Facebook Statement of Rights and Responsibilities (which can be viewed
at www.facebook.com/terms.php).
35. This promotion is in no way sponsored, endorsed or administered by, or
associated with Facebook. The information an entrant provides will only be used
for the purposes outlined in these Terms and Conditions. Any questions,
comments or complaints about this promotion must be directed to the Promoter
and not to Facebook. Facebook will not be liable for any loss or damage or
personal injury which is suffered or sustained by an entrant, as a result of
