WIN A THERMOMIX COMPETITION Information on how to enter forms part of these conditions. Participation in this “Win a Thermomix” promotion constitutes the entrants’ acceptance of these Terms & Conditions.
Entry is only open to Australian residents 18 years and over. Employees (and their immediate families) of the Promoter, and agencies associated with the Promoter, are ineligible to enter. Extended family members of those persons are permitted to participate in the promotion.
Independent Consultants, Group Leaders, Branch Managers, Area Managers and Regional Managers of the Promoter, and their immediate families, are ineligible to enter. Extended family members are authorised to participate.
The promotion commences at 09:00 AWST on 2 November 2016
and closes at 23:59 AWST on 30 November 2016. The time of entry will in each case be the time the entry is received by the Promoter. The Promoter accepts no responsibility for any late, lost or misdirected entries not received by the Promoter or delays in the delivery due to technical disruptions, network congestion or for any other reason.
To be eligible to enter, an entrant must
Hold a Facebook account, being an account established on
www.facebook.com.
Fill out the entry form on the Thermomix in Australia competition app at
www.facebook.com/thermomixinaustralia by completing all entry form fields.
Limit of one entry per entrant. Any contact details entered incorrectly on the Promotional website shall be deemed invalid and will result in an ineligible entry.
By entering, the participant agrees that, without limitation;
the content submitted is their own, or they have consent to use the content for this submission
they will not submit material that is unlawful or fraudulent, that is a breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, politically incorrect, racist, sexist, objectionable with respect to race, religion, origin or gender, not suitable for children under 15 or otherwise unsuitable for publication in the context of this competition.
they have complied with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and access to or use of others’ computers or communication systems.
they have the full rights to grant to the Promoter the rights referred to in these Conditions of Entry
they will indemnify the Promotor against all costs and claims by third parties arising from a breach in these Conditions of Entry.
The judging will take place on 5 December 2016.
The winner will be contacted on 6 December 2016 via email and telephone and must respond by reply email to claim their prize. Once the winner has been contacted, their first name and initial will be published on the Thermomix in Australia Facebook page on or after 6 December 2016.
The winner may be asked to take part in promotional activity or advertising organised by the Promoter. This is optional to the winner and can be agreed to take part if so requested.
In the case of an invalid entry, ineligible entrant or a prize that remains unclaimed three (3) months from the date the winner was contacted, prizes may be awarded to the reserve entries, at the discretion of the judging panel.
The Promoter reserves the right to request each winner provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity in order to claim the prize pack. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.
The judges' decision is final and no correspondence will be entered into.

Additional conditions of entry
The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of the Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of entry or who has, in the opinion of the Promoter, engaged in conduct in entering the promotion which is fraudulent, misleading, deceptive or generally damaging the goodwill or reputation of the promotion and/or Promoter. The Promoter reserves the right to disqualify a winner if the Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.
The Promoter collects entrants’ personal information in order to conduct the promotion and uses and stores this personal information in accordance with Australian privacy laws. The Promoter’s Privacy Policy is available on our website
www.thermomix.com.au. Entry is conditional upon providing this personal information.
The Privacy Policy contains information about why we collect personal information, how entrants may opt out, access, update or correct their personal information, how entrants may complain about a breach of the Australian privacy laws and how those complaints will be dealt with.
In addition to any uses outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the information provided by entrants for promotional, marketing, publicity and research purposes without notice, or any compensation to the entrant.
The Promoter may disclose personal information to Vorwerk International KG in Germany.
By entering this promotion and providing personal information, you consent to the terms of our Privacy Policy and for the Promoter to use the personal information provided to contact you.
All entries become the property of the Promoter.
The Promoter shall not be liable for any loss or damage whatsoever that is suffered by any participant (including but not limited to indirect or consequential loss), or for any personal injury suffered or sustained as a result of accepting the prize, except for any liability that cannot be excluded by law. The Promoter shall not be responsible for any entries that are not received, or are otherwise interfered with, due to problems beyond the control of the Promoter.
Entrants agree that they are fully responsible for the entries they submit.
Without limiting any other terms herein, the entrant at all times indemnifies and holds harmless the Promoter for any breach of these Terms & Conditions.
In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders its determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes; the Promoter may in its absolute discretion cancel the promotion and recommence it from the start on the same conditions subject to applicable legislation.
This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants understand that they are providing their information to the Promoter and not to Facebook. The information an entrant provides will only be used for the purposes outlined in these Terms & Conditions. Any questions, comments or complaints about this promotion must be directed to the Promoter and not to Facebook. Facebook will not be liable for any loss or damage or personal injury, which is suffered or sustained by an entrant, as a result of participating in the promotion (including taking/use of a prize except for any liability), which cannot be excluded by law.
