Terms and Conditions
1. Definitions
a. Business Day means a business day as gazetted in the City of Rockhampton, Queensland.
b. Ruby Caravan Prize means the prize comprising:
i. 1 x registered homemade caravan (aggregate trailer mass up to 1.02 tonne)
ii. 2 x fridges
iii. 2 x generators
iv. 1 x coffee Grinder
v. 1 x coffee machine
vi. 4 x stools with crocheted covers
vii. 2 x wooden small tables
viii. 1 x large umbrella/ with stand
ix. 1 x small display table
x. 1 x tea box with 5 glass jars
xi. 2 x crocheted hand made table covers
xii. 1 x Coffee flag sign
xiii. 1x coffee board
xiv. Cake tray/and cover
xv. 1x shade cloth
xvi. Ruby phone
xvii. 4 x milk jugs
xviii. 7 x containers
xix. Vintage books for displays/decor
xx. Ruby Caravan souvenir tea towels and badges stock
xxi. Ruby Caravan personalised coffee cups
valued at AUD$115,000.00 (inclusive of all taxes and duties). For clarity, the value is calculated by the Promoter’s nominated licensed valuer, and is inclusive of all applicable taxes, duties, estimated maximum transfer and adjustment costs.
c. Trade Promotion Expiry Date means the date that the trade promotion ends according to clause 4 of these terms and conditions.
2. Status
a. Information on how to enter and the prize form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
b. The Promoter is Rachael Michelle Willson trading as Ruby Caravan ABN 29 471 173 915 of Yeppoon, QLD, 4700.
3. Eligibility
a. Entry is only open to Australian residents (excluding South Australia, Tasmania, Western Australia, ACT, Northern Territory,) aged 18 years or older.
b. The Promoter and their immediate families are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
4. Promotional Period
a. Promotion commences 01/12/2018 and closes on the earlier of:
i. The time when 2000 entries into the Trade Promotion are received by the Promoter;
ii. 11:59pm on 30/11/2019,
(“Promotional Period”).
5. Entry
a. To enter, Eligible Entrants must undertake the following steps during the Promotional Period:
i. Visit
www.rubycaravan.com and purchase a Ruby Caravan Artwork Print for $50 via <
www.rubycaravan.com>. The entrant will be issued with a voucher for the Ruby Caravan Artwork Print which can only be redeemed instore at Ruby Caravan located at Mer Anderson Park, Yeppoon Queensland. For clarity, residents of South Australia, Tasmania, Western Australia, ACT, Northern Territory may purchase a Ruby Caravan Artwork Print however they will not be eligible for entry into the draw; and
ii. Once the purchase is confirmed, the entrant will be presented with a Ruby Caravan Prize Entry Application. The entrant must then input the requested details into the Entry Application (including their full name, telephone, address and email) and submit the fully completed entry form online.
OR
iii. Purchase a voucher instore at any of the Ruby Caravan locations or partner locations for $50. The entrant will be issued with a voucher for the Ruby Caravan Artwork Print which can only be redeemed instore at Ruby Caravan located at Mer Anderson Park, Yeppoon Queensland. For clarity, residents of South Australia, Tasmania, Western Australia, ACT, Northern Territory, may purchase a Ruby Caravan Artwork Print however they will not be eligible for entry into the draw; and
iv. Once the purchase is confirmed, the entrant must complete the requested details on the entry form on the Entry Application (including their full name, telephone, address and email) and submit the fully completed entry form to the box provided instore at the purchase location.
b. The Promoter will donate $2 from every sale of a Ruby Caravan Artwork Print to its nominated charity, up to a maximum of $100,000. The Promoter will tally all sales at the end of the Promotional Period and donate the funds as a lump sum to the nominated charity.
c. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
d. Incomplete or indecipherable entries will be deemed invalid.
e. Multiple entries are permitted, subject to the following:
i. only (1) entry permitted per specified purchase requirement; and
ii. each entry must be submitted in accordance with these Terms and Conditions.
f. Entrants must retain their original or a copy of their purchase receipt as proof of purchase. Failure to produce the proof of purchase for their entry when requested may, in the absolute discretion of the Promoter, result in invalidation of an entrant’s entry and forfeiture of any right to a prize. Purchase receipt must clearly specify the store of purchase and that the purchase was made during the Promotional Period but prior to entry.
g. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
6. Draw & Notification of Winner
a. All entries received during the Promotional Period will be entered into a single draw. The draw will take place at Swanwick Murray Roche, 4/74 Victoria Parade, Rockhampton, Queensland, Australia at 10am AEDST on the next Business Day following the Trade Promotion Expiry Date (“Draw Date”). The Promoter may draw additional reserve entries and record them in order, in case of an invalid entry or ineligible entrant.
b. The winners will be notified in writing within two (2) Business Days of the Draw Date. The name of the winner will be published online at
www.rubycaravan.com from the next Business Day following the Draw Date.
c. The first valid entry drawn will win the Ruby Caravan Prize.
d. The total prize pool value is $115,000.00.
e. The Promoter’s decision is final and no correspondence will be entered into.
f. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
g. The winner of the Ruby Caravan Prize will be notified by telephone and in writing within two (2) Business Days of the Draw Date and the name of the prize winner will be published on the Promoter’s website located
www.rubycaravan.com . Prizes will be delivered within 28 days from the Draw Date or any other period mutually agreed between the Prize Winner and the Promoter.
h. If necessary and subject to the direction of any regulatory authority, the Promoter may conduct an unclaimed prize draw at the same time and place as the original draw with an independent scrutineer present on the first Business Day after the date that is at least 3 months after the date of the Draw Date) in order to distribute any unclaimed prize. All non-winning entries will be included in the unclaimed prize draw. In the event of any winners in the unclaimed prize draw, the winners will be notified by phone and in writing within two (2) working days of the draw and their names published on the Promotors website on
www.rubycaravan.com within two business days following the Draw Date.
7. Transfer of Prize
a. The Ruby Caravan Prize will be provided to the winner free of any encumbrance. The Promoter will bear the cost of any official duties on assignment of the Ruby Caravan Prize, any costs related to the transfer of the Business Name and Business Caravan Registration, and all other government and transfer costs associated with assigning the Business to the winner.
b. As a condition of accepting the Business, the winner must sign any legal documentation as and in the form required by the Promoter or their nominated agent in their absolute discretion, including but not limited to a registration transfer, and all necessary documentation to give effect to the assignment of the Business.
8. General
a. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
b. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
c. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its discretion, to the fullest extent permitted by law:
i. to disqualify any entrant; or
ii. to modify, suspend, terminate or cancel the promotion, as appropriate, subject to any directions from a regulatory authority.
d. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
e. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) the prize.
f. Any cost associated with accessing <
www.rubycaravan.com>, Facebook or Instagram is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
g. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants understand that they are providing their information to the Promoter and not to Facebook. The information an entrant provides will only be used for the purposes outlined in these Terms and Conditions. Any questions, comments or complaints about this promotion must be directed to the Promoter and not to Facebook. Facebook will not be liable for any loss or damage or personal injury which is suffered or sustained by an entrant, as a result of participating in the promotion (including taking/use of a prize), except for any liability which cannot be excluded by law.
