Promoter of promotion

1. The promoter is Isuzu Australia Limited (ABN 97 006 962 572) of 66 Foundation Road, Truganina, Victoria 3029 (the Promoter).

Terms and Conditions of promotion

2. By entering the promotion, entrants accept and agree to be bound by these terms and conditions (Terms and Conditions).

3. Information regarding the prizes and how to enter the promotion is set out in and forms part of these Terms and Conditions.

Who can enter?

4. Entry is open to Australian residents who are 18 years of age or older, provided that employees of the Promoter and their immediate families and the suppliers and agencies associated with this promotion are ineligible to enter.

How to enter?

5. The promotion commences at 12:00am (AEDT) on 4 October 2022 and ends at 11:59pm (AEDT) on 21 October 2022 (Promotion Period).

6. To enter, during the Promotion Period an eligible entrant must complete the form located at the URL: https://isuzu50years.com.au/ and submit an entry in the manner indicated on that page. Entries will be deemed to be accepted at the time of receipt by the Promoter, and not at the time of transmission.

Conditions of submission of entry in promotion

7. Prior to accepting entry, all entries are appraised by Isuzu engineers to ensure any after-sale modifications meet warranty and safety standards. Vehicles that have included modifications that could affect safe operation and performance cannot be included.

8. The photo(s) submitted must be in colour and have high-resolution.

9. Photographs must be submitted online in JPEG or TIFF digital format. Other formats will not be accepted as a valid submission.

10. Company logo designs submitted to the Promoter will be reviewed by its design team to ensure the designs are adequate for large format out-of-home, as well as to meet any applicable legal and licensing requirements. Some designs will need to be altered to meet these requirements.

11. The final design will be shared with the competition winner before publication.

12. By submitting their entries to the Promoter, entrants agree to grant the Promoter free of charge the right to use the entry in any manner and media, including without limitation, the right to publish, adapt, distribute, copy, display or translate in printed or electronic media even if they are not the winning entries.

13. If any entry includes any trademark or other intellectual property of the entrant or any other party, by entering into this promotion the entrant grants to the Promoter the right to re-publish or use the trademark in Australia as contemplated by this promotion and these Terms and Conditions, and the entrant warrants that it has the full legal rights to grant such rights to the Promoter, and agrees to indemnify the Promoter from and against claims made against the Promoter by any third parties in respect of the use or publication of such trademarks or other intellectual property in the manner contemplated by the promotion and these Terms and Conditions.

14. Promoter reserves the right to use the text submissions of each entrant for social media content, billboard advertising and other promotional purposes and the entrant consents to such publication. Entrant agrees that submissions can be modified for publication purposes.

15. Participants may be asked to take part in publicity activities.

16. Once an entrant has submitted an entry, the entrant is ineligible to submit again.

Winning the promotion

17. There will be one (1) competition winner in each of the following states: New South Wales, Victoria, Queensland, South Australia, Western Australia and Tasmania.

18. A panel of Promoter judges will select the six (6) winners. The six (6) winners will be determined based on the following criteria:

a. Entry is consistent with the Isuzu Australia ‘reliability is everything’ theme and meets the stated Promoter specifications and requirements in these Terms and Conditions and at the page containing the competition entry form;

b. Originality, creativity and storytelling of the entry; and

c. Sincerity and credibility of responses.

How will the winner be notified?

19. Within 14 days of the competition finishing, the winners will be notified via email/mobile and his or her name will be published on the Isuzu Australia Facebook page: https://www.facebook.com/IsuzuAustralia

20. If the Promoter is unable to contact the winner within two (2) days, the next entrant in the relevant state who provided the most creative submission per the requirements listed in the competition entry form will be announced as the winner.

21. Entrants agree to the publication of their name and submission on the Isuzu Australia Facebook page for the purposes of this promotion.

Prizes

22. Prizes are not transferable, exchangeable or redeemable for cash. To the extent permitted by law, the Promoter makes no representations or warranties as to the quality, suitability, or merchantability of any prizes.

23. The prizes are as described on the page containing the competition entry form and include Billboard placements in the winner’s state and a $1,000 fuel voucher.

What happens to the winner?

24. A photoshoot will take place for the six (6) winners in order to gain high-quality imagery of the winner and their Isuzu truck for use in the billboard placements. Photos and all images remain the property of the Promoter and the winner agrees to grant the Promoter free of charge the right to use the same in any manner and media, including without limitation, the right to publish, adapt, distribute, copy, display or translate in printed or electronic media.

25. Should the winner be unavailable for any of the photoshoot dates, the next entrant in the relevant state the judges determine has provided a submission in accordance with the requirements listed in the competition entry form and/or Terms and Conditions will be announced as the winner.

26. The final form of the wording submitted for the promotion will be shared with the promotion winner before publication.

Promoter’s rights and limitation of liability

27. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age, and place of residence). Proof of identification, age, residency and entry considered suitable for verification is at the discretion of the Promoter.

28. The Promoter reserves the right in its sole discretion to disqualify any individual who it has reason to believe has breached any of these Terms and Conditions or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

29. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law, and subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate. To the extent permitted by law, notice of will not be provided to participants of such termination or cancellation.

30. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability arising in any way out of the promotion (including due to negligence, and included for personal injury, loss, or damage or tax liability of the winner), regardless of whether such liability is direct, indirect, special or consequential.

31. The Promoter reserves the right to film and share photos of the billboard experience and the winner agrees to grant the Promoter free of charge the right to use the same in any manner and media, including without limitation, the right to publish, adapt, distribute, copy, display or translate in printed or electronic media.

Promoter’s decision final and binding

32. The Promoter's decision in relation to any aspect of the promotion is final and binding on every person who enters and no correspondence will be entered into. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

Collection of personal information

33. The Promoter collects personal information about entrants to include entrants in the promotion and where appropriate award the prize. If the personal information requested is not provided, entrants that are winners cannot be awarded with a prize.

34. By participating in the promotion, each entrant consents to the Promoter using, and disclosing their personal information to the Promoter's related entities, agencies and other third parties engaged to provide services in connection with the promotion, for the purpose of contacting the entrant in relation to the promotion, promoting the winner, and otherwise for the purposes set out in the Promoter's privacy policy (available at https://www.isuzu.com.au/privacy-policy/).

35. The entrant provides this consent until such a time as he/she withdraws his/her consent by giving written notice to the Promoter.
