By entering the Cirque Du Soleil Opening Night competition (“Competition”), you agree to the following terms and conditions:
1. STANDARD TERMS
1.1 Information on how to enter forms part of the terms of entry.
2. WHO CAN ENTER?
2.1 Subject to clause 2.2 and 2.3, entry is open to residents of Australia aged 18 years and above.
2.2 Employees and their immediate family members of TEG Live Pty Ltd (Operations) (“Promoter”) their associated agencies and companies and any prize suppliers are not eligible to enter. Reference to “Immediate Family Member” includes a spouse, defacto spouse, parent, natural or adopted child or sibling.
2.3 If the Prize Winner (“Winner”) is unable to attend the Opening Night in the city they reside Sydney: 3 August 2023 they will be deemed invalid, and therefore will forfeit the prize in full and a re-judging will take place as specified in clause 5.4 of these terms and conditions.
3. HOW TO ENTER
3.1
The competition commences on Sunday 6th November 2022 at 06:00am (AEDT) and concludes on Sunday 12th November 2022 at 12:00pm (AEDT) (“the Competition Period”).3.2 In order to enter, viewers must:
• Visit the promotion microsite and register their full name, address (including state and postcode), email address on the Cirque du Soleil Competition page [https://cirque-du-soleil-crystal-promotion.mailchimpsites.com/]; and
• Submit an answer to the Competition question, “In 25 words or less tell us why you would like to join us for opening night?”.
3.3 Entries must be received by Sunday 12th November 2022 12:00pm (AEDT). Entries will be deemed to be accepted at the time of receipt and not the time of transmission.
3.4 Entries are limited to one entry per person per day. However, each entry must be significantly different to any previous entry.
3.5 The entry must be:
(a) the original independent creation of the entrant;
(b) written in English; and
(c) free from any claims, including but not restricted to copyright or trademark claims, by other parties.
3.6 Entry details remain the property of the Promoter and will not be returned to the entrant. The prize winner agrees to grant the Promoter a perpetual and non-exclusive license to use their entries in all media worldwide and the prize winner will not be entitled to any fee for such use.
3.7 Any entry that contains content that the Promoter, in its sole discretion, considers to be offensive or inappropriate in any way or that the Promoter considers, in its sole discretion, to infringe any intellectual property rights or other rights of any person, corporation or entity, will be considered ineligible. The decision to accept or reject an entry is at the Promoter’s sole discretion and no correspondence will be entered into.
3.8 Neither the Promoter or Sponsor are responsible for any data or other information related to this Competition that may be lost, damaged as a result of any computer software or hardware malfunction. Any issues occurring as a result of computer / server/ software problems will be rectified as quickly as possible.
3.9 Entrants must provide accurate and complete information when submitting entries, or the entry will be deemed invalid.
4. PRIZES
4.1 There will be twenty five (25) prize winners (“Winner”) of the Competition. Each Winner will be awarded Two (2) x tickets to Opening Night in the Sydney on 3 August 2023
4.2 Prizes cannot be exchanged, transferred or traded for an alternative prize or transferred to another performance date or city.
4.3 The Winners’ companions can be under 18 years of age as long as they are accompanied by an adult.
4.4 Allocated seats will be A reserve.
4.5 Prize redemption may be rescheduled or cancelled if the performance or performances are rescheduled or cancelled for any reason directly or indirectly related to coronavirus (Covid-19) or variants of coronavirus, and is subject to the following terms and conditions:

4.6 If for any reason the Winner does not take and/or participate in the prize (or any part of the prize) at or by the time stipulated by the Promoter in its absolute discretion (as applicable), then the prize (or that component of the prize) will be forfeited.
4.7 If a prize (or part of a prize) is unavailable, the Promoter, in its absolute discretion, reserves the right to substitute the prize (or that part of the prize) with a prize of equal or greater value in lieu, subject to any written directions from a regulatory authority.
4.8 Winners and their companions must abide by all conditions of entry to the venue (including any applicable age restriction)
4.9 Any and all components of the prize(s) must be taken together and when offered or are forfeited.
4.10 Prize inclusions and details are correct as of Wednesday 2 November 2022 however subject to change without advance notice.
4.11 Unless specified, the Winner and their companions are responsible for all other expenses incurred, including but not limited to transport, meals, beverages. Items of a personal nature are the sole responsibility of the Winner and their companions.
4.12 The Promoter, and their associated agencies and companies or any organization or individual associated with the provision of the Prize(s) make no representation as to the safety conditions or other issues that may exist at any destination.
4.13 By participating in the Competition, the Winner and companions agree to participate and co-operate as required in all editorial activities relating to the Competition, including but not limited to being interviewed and photographed. The Winner grants the Promoter a perpetual and non-exclusive license to use such footage and photographs in all media worldwide and the Winner will not be entitled to any fee for such use.
4.14 The Winner agrees that they will not sell or otherwise make available their story and/or photographs to any media or other organization.
4.15 The Winner must provide valid identification to the Promoter upon the Promoter’s request. Failure to do so will result in the forfeiture of the Prize at the Promoter’s sole discretion.
4.16 Subject to state permit authority restrictions, the Promoter may reasonably amend these terms and conditions, orally or in writing, in its absolute discretion.
5. HOW TO WIN
5.1 There will be twenty five (25) prize winners (“Winners”) of the Competition.
5.2 Each entrant who has entered the Competition over the Competition Period and registered all details in accordance with clause 3 (“Qualifying Entrant”) will be entered into the Competition.
5.3 The Winner will be the best valid entry as judged by a panel of representatives appointed by the Promoter having regard to suitability, worthiness and creativity at TEG Level 3, 175 Liverpool St, Sydney NSW 2000 by Friday 18th November 2022 at 12:00pm (AEDT). The Competition is a game of skill and chance plays no part in determining the Winner.
5.4 The Winners will be contacted by email within three (3) business days of the selection. All necessary efforts will be taken to contact the Winner. If the Prize remains unclaimed or forfeited through ineligibility or otherwise, the Promoter will conduct a re-judging, as required, at the same time and place as the original judging, on Monday 13 February 2023. The alternative Winner, if any, will be notified in writing and by phone within two (2) business days of the re-judging and their name published on the Sunrise website within three (3) business days of re-judging.
5.5 The judges’ decision is final, and the Promoter will not enter into correspondence regarding the result.
5.6 Incomprehensible and illegible entries will be deemed invalid.
5.7 It is a condition of accepting the Prize that the Winner must comply with all the conditions of use of the Prize and Sponsors requirements. Prizes are subject to Sponsor and prize suppliers Terms and Conditions.
5.8 It is a condition of accepting the Prize that the Winner may be required to sign a legal release in a form determined by the Promoter or the Sponsor in their absolute discretion.
6. NO LIABILITY
6.1 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the Competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, pandemic, COVID-19, epidemic, government restraint, or act of terrorism, the Promoter may in its absolute discretion cancel, modify or suspend the competition. If, due to circumstances beyond the Promoter’s control, the Promoter is unable to provide the stated prize, the Promoter reserves the right to award a substitute prize.
6.2 TEG Live Pty Ltd and their associated agencies and companies will not take any responsibility for prizes damaged or lost in transit, or late, lost or misdirected mail.
6.3 Promoter, Sponsor and prize suppliers are not responsible for any costs associated with Prize collection.
6.4 TEG Live Pty Ltd and their associated agencies and companies will not be liable for any misadventure, accident, injury, loss (including but not limited to consequential loss), expenses, damages or claim that may occur:
• during the judging;
• whilst undertaking any travel won on or connected with their entry into the Competition; or
• in the participation in any prize;
• as a consequence of late, lost or misdirected mail;
• due to the broadcast of any program relating to the Competition or the publication of any material, including any statements made by any compere, staff member, journalist, other entrants or any other person;
• in relation to failure of an entry to be received by the Promoter on account of technical problems or traffic congestion; and
• arising from or related to any problem or technical malfunction of any computer equipment, software, internet connection, any injury or damage to entrant's or any other person's computer software related to or resulting from participation in this promotion.
6.5 If for any reason the Competition is not capable of running as planned, due to causes including but not limited to computer virus, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of the Competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the Competition, subject to state government legislation.
6.6 The Promoter reserves the right to reasonably amend or vary these terms and conditions at its sole discretion, orally or in writing.
6.7 The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s and the Sponsor’s legal rights to recover damages or other compensation from such an offender are reserved.
6.8 TEG Live Pty Ltd assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries, and reserves the right to take any action that may be available.
6.9 By entering the Competition, and by collecting the Prize, the Winner acknowledges and accepts that driving, travel and any other activities comprising the Prize, are inherently dangerous and may result in death, injury, incapacity, damage to property or other losses. Neither the Promoter nor the Sponsor or prize supplier are responsible for any acts of god, such as adverse weather conditions or industrial action or civil commotion that may occur whilst a Winner is travelling. It is the responsibility of the Winner to enquire about local issues and conditions at destinations prior to travel.
7. PROMOTER’S DETAILS
7.1 The Promoter is TEG Live Pty Ltd (ABN 25 150 055 100) of Level 3, 175 Liverpool St, Sydney NSW 2000.
7.2 With your express consent to do so, by opting in via the competition entry form, the Sponsor will handle entrant’s personal information (e.g., first name, last name, address, suburb, state, postcode, phone number, email address, date of birth) in accordance with their privacy policy, which can be accessed at
https://www.cirquedusoleil.com/legal/privacy-policy. The Sponsor’s Privacy Policy may be updated from time to time, and it will be the entrant’s responsibility to keep up to date with any changes to the Privacy Policy. The entrant may at any time, opt out of receiving contact from the Sponsor by e-mailing
privacy@cirquedusoleil.com.
7.3 Entry details remain the property of the Promoter. TEG Live Pty Ltd (ABN 25 150 055 100) and its related entities is collecting your personal information for the purpose of conducting and promoting this Competition, including for the purpose of identifying and notifying the Winner, prize fulfilment and understanding our audiences
