TERMS AND CONDITIONS:

1.              The Promoter

The Trustee for CW Media Trust ACN 606 548 298, ABN 43 913 252 975, 6 Albert Street Preston, Vic 3072, on behalf of the Chemist Warehouse and e-Pharmacy group.

2.              Terms of Entry

(a)            Competition entries can be made from 12.01am AEST on Thursday 22 June 2023 until 11.59pm AEST on Wednesday 5 July 2023 (“Competition Period”) through the following websites:

(b)            Entries received outside the Competition Period will not be eligible or accepted. Entries are deemed to be received at the time of receipt by the Promoter and not at the time of transmission or deposit by the entrant. Records of the Promoter and its agencies are final and conclusive as to the time of receipt.

(c)            Valid and eligible entries will be accepted during the Competition Period.

(d)            Entries that are incomplete, illegible or indecipherable will not be valid and will be deemed void.

(e)            Entry is conditional upon entrants spending at least $20 across the Garnier range in a single transaction at any Chemist Warehouse, My Chemist or E-Pharmacy store within Australia (including their online stores) (“Qualifying Transaction”) and entering online via the above website (based on store of purchase) with the requested details including providing proof of the qualifying transaction in the form of a valid purchase receipt number.

(f)             Entrants must retain their original purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the store of purchase and that the purchase was made during the Competition Period but prior to entry.

(g)            Maximum of one (1) entry per Qualifying Transaction. Each entry must be submitted separately and in accordance with entry requirements outlined in these terms.

(h)            The Promoter takes no responsibility for entries that are lost, stolen, illegible, misdirected or damaged however caused.

(i)             Submitting an entry constitutes acceptance of these terms and conditions.

(j)             Multiple entries by eligible entrants are accepted, subject to entrants holding multiple proofs of purchase with different valid purchase receipt numbers.

3.              Who May Enter

(a)            The Competition is open to Australian permanent residents aged 18 years of age or over.

(b)            The Competition is not open to:

(i)             Employees of the Promoter;

(ii)            Parties to whom the Promoter has contracted work in relation to this Competition;

(iii)           Parties who are otherwise directly involved with this Competition; and

(iv)           Any immediate family members or any of the abovementioned parties.

4.              Prize

(a)            The prize is a Splendour in the Grass 2023 experience for the winner and a friend (18+) valued at AUD$5,000.

(b)            The prize includes:

·       Splendour in the Grass 2023 VIP Village 3-day tickets for 2 people to attend the Splendour in the Grass Music and Arts Festival at North Byron Parklands from Friday 21 July to Sunday 23 July 2023
·       Twin-share accommodation for 3 days for 2 people at The Bower Byron Bay, NSW (check in: 20/07/23[NA1] ; and check-out: 23/07/23)
·       A $2500 Visa Gift Card to be used towards return flights from the winner’s closest major domestic airport to Byron Bay (if required) and may also be used towards transfers, and spending money etc depending on flight costs.
 
Prize Conditions:
·       Both the winner and their guest for the prize must be aged 18 years or over.
·       This prize is for or relates to Splendour in the Grass Music and Arts Festival at North Byron Parklands from Friday 21 July to Sunday 23 July 2023 (the “Event”). If the winner is unwilling or unable to attend at the designated time for the Event, they forfeit the prize and the Promoter is not obliged to substitute the prize.
·       The Splendour in the Grass Music and Arts Festival tickets are subject to the Event venue and ticket terms and conditions, including any applicable age restrictions. The Promoter and Event organisers hereby expressly reserve the right to eject any winner and/or his/her companion for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize.
·       Prize is subject to the standard terms and conditions of individual prize and service providers.
·       The winner may be required to present their credit card at accommodation check in.
·       All other costs associated with the trip, including but limited to travel insurance and transfers are at the expense and responsibility of the winner and their guest for the prize.
·       The Promoter makes no representation as to the safety, conditions or other issues that may exist at any of the destinations or events forming part of the prize. It is the sole responsibility of winner to check government advisories and/or conditions regarding the safety and situation of any such destinations.
·       If the prize cannot be provided as intended due to any COVID 19 related restrictions or guidelines, the Promoter reserves the right to award an alternative prize in lieu.
 
 
 
5.              Selecting the Winner

(a)            The Competition winner will be selected at 10.00am AEST on Thursday 6 July 2023.

(b)            The Competition winner will be randomly selected using automated competition drawing software (the first valid entry drawn will win the prize outlined below). The Competition winner will be drawn at 6 Albert Street, Preston VIC 3072.

(c)            The draw conductor may draw additional reserve entries in case an invalid entry or entrant is drawn.

(d)            If a draw is scheduled on the weekend or a public holiday, the draw will be conducted at the same time and location on the following business day. The Promoter will ensure each draw is open for public scrutiny and anyone may witness the draw on request. The winner of a drawn prize is determined by chance.

(e)            The Competition winner will be notified by SMS or email by 2.00pm AEST Thursday 6 July 2023. Whilst the Promoter will use its best endeavours to contact the winner within the abovementioned time, the decision not to award an entrant who cannot be contacted a prize is at the sole and absolute discretion of the Promoter, and can be made at any time after the Competition winner has been selected.

(f)             Prize must be claimed by 12 July 2023 at 9.00am AEST . If the prize is unclaimed, the Promoter will redraw on Wednesday 12 July 2023 at 10.00am AEST and publish these details on the below sites on Wednesday 12 July by 5.00pm AEST. The winner will also be notified by SMS or email within 24 hours of the redraw. The quick turnaround is due to the prize needing to be taken on July 20, 2023.

(g)            A person purporting to be a prize winner may be required to provide proof of identity and to verify any other eligibility requirements.

6.              Total Prize Pool

The total prize pool for the Competition is up to AUD$5,000.

7.              Publication of winner’s details

The Promoter will publish the Competition winner (from the original draw) on the following websites on Thursday 6 July 2023 by 5.00pm AEST and that information shall remain posted there for at least 28 days. If an unclaimed prize draw is required, the winner of the re-draw will also be published on the below mentioned websites for at least 28 days from 13 July 2023.

Privacy and use of personal information

(a)            In accordance with the Privacy Act (1988) (Cth), the Promoter notifies entrants that entry to the Competition involves the collection of personal information about entrants, such as their name, address, mobile phone number and email address.  This is collected for the purpose of establishing eligibility, carrying out the Competition and notifying the winner.  If the information is not provided, the entrant may not participate in the Competition.  Entrants’ personal information may be disclosed to third parties including the Promoter’s contractors and agents, prize suppliers and service providers to assist in conducting this Competition, State Lottery agencies and winner’s name published as required under the relevant lottery legislation.

(b)            For the purposes of public statements and advertisements, the Promoter may only publish the winner's surname, initial and State/Territory or postcode of residence.

(c)            The Promoter is bound by its privacy policy which is located at https://www.chemistwarehouse.com.au/aboutus/privacy. The Promoter's privacy policy contains information about how the entrant may access, update and seek correction of the personal information the Promoter holds about them and how the entrant may complain about any potential breach by the Promoter of the Australian Privacy Principles or any other Australian privacy laws and how such complaints will be dealt with.

(d)            Each entrant consents to the Promoter using their personal information provided in connection with their entry, for the purposes of undertaking any investigation in connection with verifying the identity of an entry or any suspected tampering.

(e)            Each entrant consents to the Promoter and its authorised licensees using the entrant’s name, likeness, image and/or photograph and voice in the event that they are the winner, in any media for an unlimited period of time, without remuneration or compensation, for the purposes of promoting the outcome of this Competition.

8.              Discontinuation of the Competition or Disqualification of an Entrant

(a)            Subject to State legislation; The Promoter reserves the right to discontinue the Competition at any time and in its sole and absolute discretion may cancel, terminate or modify the Competition without the need to provide compensation to entrants or attempted entrants.

(b)            The Promoter reserves the right, in its sole and absolute discretion to verify the validity of entries and entrants and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with (or whom the Promoter reasonably suspects has tampered with) the entry process or the winner selection process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Competition. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

9.              Exclusion of Liability

(a)            The Promoter makes no representation nor provides any warranties as to the quality or suitability of the prizes offered.

(b)            The Promoter is not responsible for any losses associated with any change to the value of any prizes.

(c)            To the extent permitted by law, the Promoter is not liable for any loss suffered or sustained by any person or to personal property including, but not limited to, consequential (including economic) loss by reason of any act or omission, deliberate or negligent, by the Promoter or its servants or agents, in connection with the arrangements for the supply of any goods or services by any person to the prize winner and where applicable, to any person or persons accompanying the prize winner.

(d)            The Promoter’s decision on all matters relating to this Competition will be final.

(e)            The Promoter is under no obligation to provide reasons for any of its decisions.

(f)             The Promoter is under no obligation to engage in any form of correspondence whatsoever with entrants or purported entrants, or their representatives, in any matters relating to the Competition.

(g)            L'Oreal is the prize supplier of this Competition only and takes no responsibility and accepts no liability for the conduct of the Competition. L’Oreal Australia and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person's negligence or wilful misconduct) in connection with this Promotion or accepting or using any prize (or recommendation), except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law.

10.           Further Conditions:

(a)            Where entry is allowed by purchase or subscription, the cost of the product or service is no greater than the cost would be without the opportunity to participate in the Competition.

(b)            The value of the prizes is accurate and based upon the recommended retail value of the prizes (inclusive of GST) at the date of printing. The Promoter accepts no responsibility for any variation in the value of the prizes after that date.

(c)            No part of a prize is exchangeable, redeemable for cash or any other prize or transferable, unless otherwise specified in writing by the Promoter.

(d)            If a prize (or portion of a prize) is unavailable the Promoter reserves the right to substitute the prize (or that portion of the prize) to a prize of equal or greater value and/or specification, subject to any written directions of a regulatory authority.

(e)            No entry fee is charged by the Promoter to enter the Competition. Where entry is allowed online, there is no additional cost to enter the Competition other than any cost paid by the entrant to access the website or social media platform of entry via their Internet service provider.

(f)             Each prize will be awarded to the person named in the entry and any entry that is made on behalf of an entrant or by a third party will be invalid. If there is a dispute as to the identity of an entrant or winner, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant or winner.

(g)            If a prize is provided to the Promoter by a third party, the prize is subject to the terms and conditions of the third party prize supplier and the provision of the prize is the sole responsibility of the third party and not the Promoter. The terms and conditions which apply to the prize at the time it is issued to the winner will prevail over these Terms and Conditions, to the extent of any inconsistency. The Promoter accepts no responsibility or liability for any delay or failure by the third party to deliver the prize, any delay or failure relating to the prize itself or failure by the third party to meet any of its obligations in these Terms and Conditions or otherwise.

(h)            Any guarantee or warranty given is in addition to any relevant statutory guarantees and warranties and nothing in these Terms and Conditions restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth).

(i)             The Promoter reserves the right to disqualify entries in the event of non-compliance with these Terms and Conditions. In the event that there is a dispute concerning the conduct of the Competition, the decision of the Promoter is final and binding on each entrant and no correspondence will be entered into.

(j)             The entrant will participate in and co-operate as required with all reasonable marketing and editorial activities relating to the Competition, including (but not limited to) being recorded, photographed, filmed or interviewed and acknowledges that the Promoter may use any such marketing and editorial material without further reference or compensation to them.

(k)            Unless otherwise specified, a prize is a single event for the winner (and where relevant their guest) and cannot be separated into separate events or components.

(l)             The Promoter accepts no responsibility for any tax implications and the entrant must seek their own independent financial advice in regards to the tax implications relating to the prize or acceptance of the prize.

(m)          Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of these rights.
