Entry Restrictions
Entrants must be Australian residents, aged 13 years or over. Entrants under the age of 18 must obtain permission from their parent or legal guardian over the age of 18 to enter the Promotion.
Promotional Period
The Promotion is run monthly and opens each Month at the relevant dates set out in the Promotion Schedule below. Entries close each Month as per the relevant competition deadlines set out in the Promotion Schedule.
The total duration of the Promotion is from 00:00 AEST on Saturday 1 July 2023 until 23:59 AEDT on Sunday 31 December 2023.
Method of Entry
To enter, each eligible entrant must successfully register a valid Giant, Liv, or Momentum-branded bicycle during the Promotional Period. The registration must be completed online at giant-bicycles.com/au, liv-cycling.com/au, or momentum-biking.com/au.
Maximum Number of Entries
There is no maximum number of entries. Each eligible entrant will receive one (1) entry into the Promotion for each successful registration completed during the Promotional Period.
Prize Draw
There are six (6) monthly Prize Draws. Each Prize Draw is taken from all valid entries received during the relevant Promotional Period as set out in the Promotion Schedule. Each Prize Draw will take place at the date and time set out in the Promotion Schedule. Each Prize Draw will be drawn at Unit 7, 3-5 Gilda Crt Mulgrave VIC 3170. The first valid entry randomly drawn in each Prize Draw will win the Prize.
Prize Details
There is one (1) Prize to be won each Month as part of the Promotion (The Prize). Each Prize Winner will receive their choice of up to $1000 AUD RRP of Giant or Liv-branded apparel and/or gear (excluding bicycles). The Total Prize Pool value does not exceed $6,000 AUD.
Winner Notification
Each Prize Winner will be notified by e-mail and/or telephone by the Notification Deadline set out in the Promotion Schedule. The winner will be issued with instructions as to how to claim the Prize and establish his/her entitlement to it. Entrants grant the Promoter permission to communicate with them by e-mail and/or telephone for this purpose.
Winner Publication Details
Each Prize Winner’s name will be published on the Promoter’s Website(s) and brand Facebook pages (facebook.com/GiantBicyclesAustralia/, facebook.com/livcyclingaus/) within thirty (30) days of the date of the Prize Draw, and remain published for at least thirty (30) days thereafter.
Unclaimed Prize Redraw
If required, an unclaimed prize redraw from all remaining valid entries received during the relevant Promotional Period will take place at 10:00am AEST on Wednesday 10 April 2024 at Unit 7, 3-5 Gilda Crt Mulgrave VIC 3170. The first valid entry randomly drawn will win the unclaimed Prize.
Use of Personal Information
By entering the Promotion, entrants consent to the use of their Personal Information for promotional, publicity and marketing purposes of the Promoter (including for sending the entrant electronic marketing messages and direct marketing).

Other Conditions
To enter the Promotion, you must register a valid Giant, Liv, or Momentum-branded bicycle online. To complete a successful registration you must enter all requested information, including the unique bicycle frame number (which must not have been registered previously), as well as provide proof of purchase of the bicycle. Once you have completed the registration process, and the registration is confirmed, you will be automatically entered into the Promotion.

General Terms and Conditions
Introduction
By submitting an entry into this Promotion, entrants warrant that they have read, understand and agree to be bound by these Terms and Conditions and the Terms and Conditions Schedule (the Schedule), including any instructions relating to the Promotion on the Promoter’s Website.
Any capitalised terms used in these General Terms and Conditions have the meaning given in the Schedule unless stated otherwise. In the event of any inconsistency between the Schedule and these General Terms and Conditions, the Schedule will take precedence.
The Promoter may in its absolute discretion refuse to award any Prize to any entrant who fails to comply with these Terms and Conditions.
The Promotion is a game of random chance.
Entry into the Promotion is free (excluding internet connection charges).
Entry Restrictions
Eligibility to enter the Promotion is subject to the Entry Restrictions. Each entrant of the Promotion must be an individual and not a company or organisation. Directors, immediate family members, employees and contractors of the Promoter and any agencies, retailers and suppliers directly associated with the Promotion, or with the provision of the Prize, are not eligible to enter.
Promotional Period
The Promotion will be conducted during the Promotional Period. Any entry received after the expiry of the Promotional Period will be deemed invalid. No responsibility is accepted for late, lost, delayed or misdirected entries.
Method of Entry
To enter the Promotion, entrants must enter the Promotion in accordance with the Method of Entry, and any other entry details provided by the Promoter on the Website, during the Promotional Period.
Maximum Number of Entries
Entrants can enter the Promotion up to the Maximum Number of Entries. Entries must be submitted separately and each entry must individually meet the requirements in the Schedule and are subject to the Entry Restrictions.
Prize Draw
If a Prize is awarded by draw, all entries received in the Promotional Period will go into a random draw and the Prize Draw will be conducted in accordance with the details in Prize Draw of the Schedule. The first valid entry randomly drawn will win a Prize. If the winning entry is invalid, that entry will be disregarded and the Prize will be awarded by drawing the next valid entry in accordance with these Terms and Conditions.
Prize Details
The Prize will be awarded as specified in the Schedule. The Total Prize Pool value is specified in the Schedule. The Prize values are the recommended retail value as provided by the relevant supplier, are in Australian dollars and are correct as at the time of the commencement of the Promotional Period. The Promoter accepts no responsibility for any variation in the Prize value.
Prize Restrictions
Unless otherwise specified in the Schedule, the Promoter will not be responsible for any additional costs or expenses associated with the collection and/or use of the Prize. The Prize Winner is responsible for all costs associated with collecting and/or using the Prize including (if applicable) travel and/or transfers, expenses (including mechanical or workshop costs, parts or labour), medical and insurance costs.
Any tax payable as a result of a Prize being awarded or received will be the responsibility of the Winner. Winners should seek independent financial advice prior to accepting a prize if this is a concern.
No component of the Prize can be transferred, exchanged or redeemed for cash.
All Prizes are subject to availability. In the event that any of the Prizes or part of a Prize becomes unavailable due to circumstances beyond the Promoter’s reasonable control, the Promoter reserves the right to provide a similar product to the same or greater value as the original prize, subject to any applicable laws or written directions made under applicable legislation.
It is a condition of accepting the Prize that the Winner (and any guests participating in using the Prize) must comply with all the conditions of use of that Prize and the Prize supplier’s requirements.
As a condition of accepting the Prize, the winner must sign any legal documentation as and in the form required by the Promoter and/or Prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
Winner Notification:
Prize Winner(s) will be notified within seven (7) days of the Prize Draw by email and/or telephone, as well as any other means of communication set out in the Schedule. Please allow at least twenty-eight (28) days from the date of notification for the delivery of the Prize.
Unclaimed Prize Redraw
In the event that a Prize Winner is unable to be contacted, the Promoter will retain the Prize for three (3) months from the date of the Prize Draw. If the Prize is not claimed within three (3) months of the date of the Prize Draw, the Promoter will redraw another winner for the unclaimed Prize through an Unclaimed Prize Redraw.
The Unclaimed Prize Redraw will be conducted in accordance with the details as specified under Unclaimed Prize Redraw in the Schedule as well as set out under section 10. Prize Draw in these Terms and Conditions. Unclaimed Prize Redraw winner(s) will be notified as set out in Winner Notification.
Unclaimed Prizes
Prizes unclaimed after a period of three (3) months after the Unclaimed Prize Redraw will be forfeited subject to State Regulations and any express provisions contained in the Schedule.
Personal Information and Privacy
The Promoter will collect your Personal Information, including name, email and phone number, for the purposes of conducting the Promotion. In doing so, the Promoter may disclose your Personal Information to its contractors, agents, any partner or co-promoter and to State and Territory gaming departments. Prize Winners’ names may be published as set out in these Terms and Conditions.
By entering the Promotion, entrants consent to the use of their Personal Information for promotional, publicity and marketing purposes of the Promoter (including for direct marketing), and any other purposes as specified in the Schedule, without any further reference, payment or other compensation to the entrant.

Governing Law and Jurisdiction
This Promotion is governed by the laws of Victoria. Entrants submit to the jurisdiction of the courts of that State.
General
Any attempt to interfere with the normal functioning of the Website or to otherwise undermine the legitimate operation of this Promotion is prohibited and will render all entries submitted by that entrant invalid.
The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions or engaged in any unlawful or other improper misconduct calculated to jeopardize the fair and proper conduct of the Promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
You warrant that:
all details provided with your entry are true and accurate;
you have all necessary rights to grant the Promoter the rights granted under these Terms and Conditions;
use of your entry by the Promoter, in accordance with these Terms and Conditions, will not infringe the rights of any third parties; and your entry does not breach any law.
You agree to indemnify the Promoter against any loss or damage resulting from any breach of the warranties above and acknowledge that the Promoter may, in its absolute discretion, not award the Prize to you for breach of the warranties above.
If there is any event that prevents or hinders the Promoter’s conduct of the Promotion or the Promoter’s ability to deliver the Prize to the Prize Winner(s) the Promoter may, in its discretion, cancel the Promotion and recommence it at another time under the same conditions or select another winner.
The Promoter is not responsible for any incorrect or inaccurate information, or for any failure of the equipment or programming associated with or utilised in the Promotion, or for any technical error that may occur in the course of the administration of the Promotion. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer networks and systems, servers, or providers, computer equipment, software, failure of any email or entry to be received by the Promoter on account of technical problems or traffic congestion on the Internet or at any web site, or any combination of them, including any injury or damage to any entrant's or any other person's computer related to or resulting from participation or downloading any materials in this Promotion. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries.
To the full extent permitted by the law, the Promoter will not be liable for any delay, death, injury, damages, expenses, or loss whatsoever (whether direct or consequential) to persons or property as a result of any person entering into the Promotion or accepting or using any Prize, including without limitation non-receipt of any Prize or damage to any Prize in transit and the Prize Winner’s failure to comply with the terms and conditions (if any) specified by any third party.
If for any reason the Promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness or integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process or to cancel, terminate, modify or suspend the Promotion without liability to any entrant or other person, subject to State Regulations. The Promoter will not award prize(s) if the Promotion is terminated.
In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders its determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes; the Promoter may in its absolute discretion, subject to State Regulations, cancel the Promotion and recommence it from the start on the same conditions at a later date.
Failure by the Promoter to enforce any one of these Terms and Conditions in any instance(s) will not give rise to any claim or right of action by any other person or entrant.
