Competition Terms and Conditions
Parties
These terms and conditions (Terms) are entered into between Ocean Blue Coastal Retreats (we, us or our),Metung Hot Springs, Metung Country Club and you, together with the Parties and each a Party.
These Terms become effective and binding upon the Parties at the time it is accepted by you, which shall include by electronic means.
Promoter
The promoter of the Competition is Ocean Blue Coastal Retreats (Promoter)
Competition Name & Duration
We are running a competition called “Gippsland Escape Giveaway – August 2023” subject to these Terms (competition)
The Competition runs from 10:00 am on August 1st, 2023 until 11.59pm on August 21st, 2023.
Prize
The winners of the Competition will be awarded a 2 night midweek (Monday to Thursday) stay for 2 guests at The Mariner Metung (valued at $1200) together with a $180 gift voucher for a renew bathing pass for 2 at Metung Hot Springs and a $180 gift voucher for Metung Country Club Golf and Grazing. No credit will be available for outstanding amounts not spent.
For clarity, the Prize does not include (without limitation):
1. Transport
2. Travel Insurance; and
3. Meals
2 night booking is for The Mariner at Metung only and stays can only be between 23rd August 2023 and 30th November 2023 and excludes all public holidays and school holidays.
The value of the Prize is valued at $1,500 AUD.
All the prizes are valued in Australian dollars.
All prizes must be taken as offered and are not exchangeable, transferrable, redeemable for cash of for resale. In the event that a Prize is unavailable, the Promoter reserves the right to substitute a Prize of equal or greater value.
Photographic identification of the winner will be required (such as driver’s licence, passport or student card where photo is included) to claim a Prize.
In exceptional situations, and subject to our absolute discretion, a winner may nominate a designated representative to collect a Prize. The representative will be required to present written authorisation from the winner and photographic identification of both the winner and their representative to collect the Prize.
Drawer and Winner
The winner(s) will be randomly selected by a computerised random generator from the database of all entries.
The selection of the winner(s) will be final and not subject to review.
The winners will be notified by direct message through the Instagram or Facebook account that they submitted their entry on.
If the winner does not confirm acceptance of the Prize in writing within 48 hours of receiving notification from us, they we may, at our complete discretion:
1. Cancel the Prize; or
2. Redraw the Prize ( by selecting another entrant).We shall not be responsible for any winners not receiving a message as a result of incorrect contact details being provided to us.
Entry & Conditions
Everyone who lives in VIC + NSW, likes, shares, and tags a friend on our competition post on Instagram or Facebook, as well as follows @oceanbluecoastalretreats, @themarinermetung, @trulypetfriendly, @metunghotsprings and @metungcountryclub and subscribes to our newsletter is eligible to enter the competition.
Acceptance of the Prize is conditional upon showing evidence that you are over 18 years of age.
Employees of the Promoter and their families may not enter the Competition.
You may only enter the Competition once unless we agree otherwise. Only the first entry will be valid if more than one entry is received from any single participant.
Conditions of Entry
By entering the Competition, you agree to be bound by these Terms and any terms and conditions advertised on our website or otherwise notified by us specific to the Competition.
It is the sole responsibility of each entrant to ensure that their entry meets the conditions of entry to be eligible to win a Prize. This includes submitting the entry within the entry dates and ensuring that the entry is complete and comprehensible. For clarity, entries not completed in accordance with the conditions of entry or received after the closing date will not be considered by us, and we take no responsibility for such in any way.
Privacy
The details contained in your entry are protected by security safeguard as detailed in the Promoter’s Prize Policy, which is also available on their website. The personal information collected as part of the entry is collected to enable the identification of the winner and for future marketing and promotional purposes. Your personal information will only be disclosed to the Promoter and its related bodies corporate for these purposes and/or in accordance with our Privacy Officer if you would like details of the personal information that the Promoter may hold about you or if you would like it to be corrected or deleted. Depending on the nature of your request, we may ask you to complete a personal information request form.
Internet
If for any reason the Competition does not run for its duration due to a computer virus, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter that corrupts or affects the administration, security fairness, integrity or proper conduct of the Competition, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the Competition or disqualify any individual who tampers with the entry process. The Promoter is not responsible for any;
1. Malfunction, delay or traffic congestion on any telephone network or line, computer online system, servers or providers, computer equipment, software, or website;
2. Failure of any email or entry to be received by the Promoter; nor
3. Any injury or damage to entrants or any other person related to or resulting from participation in the competition or downloading any materials in a competition.
Limitation of Liability
The Promoter makes not representations or warranties as the quality, suitability or merchantability of any goods or services offered as prizes. To the extent permitted by law, the Promoter is not liable for any loss suffered to a person or property by reason of any act or omission, deliberate or negligent, by the Promoter or its employees or agents, in connection with the arrangement for the supply, or the supply, of goods and services by any person to the prize winner and, where applicable, to any persons accompanying the prize winner.
This clause does not affect any rights a consumer may have which are unable to be excluded under Australian law. To the fullest extend permitted by law, any liability of the Promoter or its employees or agents for breach of any such rights is limited to the payment of the costs of having the prize supplied again.
Governing Law
This relationship of the parties under these Terms shall be governed by the laws of Victoria, Australia. Each of the parties hereby submits to the non-exclusive jurisdiction of courts with jurisdiction there.
