In these Terms and Conditions, the following words have these meanings, unless the context otherwise requires:
“Budget Direct Travel Insurance Policy” means Budget Direct Travel Insurance Cover issued by Travel Insurance Partners.
“Commencement Date” means 8th September 2023.
“Draw Date” means 6th February 2024.
“End Date” means 15th January 2024.
“Gift Card Supplier” means Digital Glue Australia Pty Limited ABN 36 127 466 899.
“Gift Card Value” means $5,000.
“Unclaimed Draw Date” means 8th May 2024.
The promoter is Auto & General Services Pty Ltd (ABN 61 003 617 909), AFSL 241 411 (operating under the brand Budget Direct) of Level 13, Toowong Tower, 9 Sherwood Road, Toowong 4066 (Promoter). The Promoter’s contact number is 1300 858 747.
Subject to these Terms and Conditions the Promoter is offering customers a chance to win one (1) prize being a digital gift card valued at the Gift Card Value (Gift Card) when they either get a quote or purchase a new Budget Direct Travel Insurance Policy as set out under the heading “Eligibility and Participation” (Promotion).
Information on how to enter, mechanics of entry and prizes form part of these Terms and Conditions. Entry into the promotion is deemed acceptance of these Terms and Conditions. If there is any conflict between these Terms and Conditions and any other published material, these Terms and Conditions prevail.
The Promotion commences at 12:01am AEST on the Commencement Date and ends at 11:59pm AEST on the End Date (Promotion Period). Despite the Promotion Period, the Promoter may elect to cease the Promotion at any time in its sole discretion.
If a person other than the traveller completes a quote or purchases a new Budget Direct Travel Insurance Policy on behalf of another person who is the traveller, that person must obtain the consent of the traveller for entry into the Promotion, and they acknowledge and agree that any Gift Card won will be awarded to a traveller.
Eligibility and Participation
In order to be eligible for the Gift Card, the customer must meet all of the following criteria (Eligible Participant):
During the Promotion Period:
complete a quote for a new Budget Direct Travel Insurance Policy on the Budget Direct website
www.budgetdirect.com.au/travel-insurance.html; or
purchase a new Budget Direct Travel Insurance Policy through the Promotor’s website at
www.budgetdirect.com.au/travel-insurance.html and ensure the Budget Direct Travel Insurance Policy purchased pursuant to this Promotion remains active and valid for a period not less than 21 days from the purchase date,
be a traveller noted in the quoted or purchased new Budget Direct Travel Insurance Policy;
be an Australian resident aged 16 or over at time of entry;
provide your full name, valid email and postal address;
not be an officer or employee of the Promoter, its related bodies corporate, or their immediate family; and
not be an officer or employee of any agents or service providers of the Promoter directly associated with the conduct of the Promotion, or their immediate family.
For avoidance of doubt, persons who purchase a Budget Direct Travel Insurance Policy via third party aggregation platforms such as Compare the Market or iSelect are ineligible to participate in the Promotion.
Each Eligible Participant will be awarded a maximum of:
one (1) entry into the Promotion for completing a quote. Additional entries will not be awarded for multiple quote completions in the Promotion Period. The maximum number of entries that will be awarded for quote completion is one (1); and
five (5) entries into the Promotion per Budget Direct Travel Insurance Policy purchased during the Promotion Period. Additional entries will be awarded for multiple Budget Direct Travel Insurance Policy purchases,
with each entry having an equal chance of winning the Gift Card.
The Gift Card draw will take place at Level 13, 9 Sherwood Road, Toowong Brisbane 4066 (Draw Location) at 10.30am (AEST) on the Draw Date.
There is a total of one (1) Gift Card prize with a total maximum prize value of the Gift Card Value for the Promotion. A total of one (1) Eligible Participant, who has provided evidence of their eligibility and the validity of their entry, upon request, to the reasonable satisfaction of the Promoter (Eligible Winner) will be drawn on the Draw Date or Unclaimed Draw Date, as is relevant.
The Eligible Winner will be notified via their nominated email address within two (2) business days of the Draw Date. The Eligible Winner’s name will be published on the terms and conditions page of the Promoter’s website within 28 days of the Draw Date and will remain on the Promoter’s website for no less than 28 days. All reasonable steps will be taken by the Promotor to locate the Eligible Winner.
The Gift Card will be deemed unclaimed if the Promoter is not reasonably able to contact the Eligible Winner within three (3) months and one (1) day of the relevant Draw Date via the Eligible Winner’s contact details provided at the time of entry into the Promotion.
If the Gift Card remains unclaimed, an unclaimed prize draw (Unclaimed Gift Card Draw) will be held at the Draw Location at 10.00am (AEST), on the Unclaimed Draw Date, subject to any written directions made under applicable State or Territory Legislation.
The Unclaimed Gift Card Draw Eligible Winner will be notified via their nominated email address within two (2) business days of the Unclaimed Draw Date. The Unclaimed Gift Card Draw Eligible Winner’s name will be published on the terms and conditions page of the Promoter’s website within 28 days following the draw and will remain on the Promoter’s website for no less than twenty-eight (28) days.
The Eligible Winner, or Unclaimed Gift Card Draw Eligible Winner, will receive an email with a link to access their Gift Card at no cost within twenty-eight (28) days of the Draw Date or Unclaimed Draw Date from the Gift Card Supplier who operates the redemption website. Each Eligible Winner, or Unclaimed Gift Card Draw Eligible Winner, will then be required to follow the instructions contained in the email and on the website of the Gift Card Supplier for the redemption of the Gift Card.
Privacy Statement and Marketing Consent
The Promoter is committed to protecting Personal Information and agrees to be bound by the Privacy Act 1988 (Cth). The Promoter’s privacy policy is available on the website
www.budgetdirect.com.au and further details of how the Promoter will collect, store, use and disclose Personal Information can be found there. In these Terms and Conditions, Personal Information has the meaning given to it in the Privacy Act 1988 (Cth).
Personal Information is collected in connection with entry into this Promotion for the purpose of facilitating access to the Gift Card. If the Personal Information requested is not provided, then a person will be ineligible to participate in this Promotion. By entering into the Promotion, the customer consents to the Promoter disclosing the Personal Information to the Gift Card Supplier, and to any of the Promoter’s related entities, using the Personal Information to process and validate the customer’s claim for the Gift Card, and to arrange delivery to the customer (if eligible).
By entering the Promotion, entrants acknowledge that a further primary purpose for collection of the entrant’s Personal Information is to contact the entrant in the future with information about the Promoter, including special offers, market research or to provide marketing materials via any medium including mail or any other form of non-real time electronic, emerging, digital or conventional communications channel whether existing now or in the future.
The Promoter will never sell an entrant’s Personal Information to other companies, however the Promoter may share an entrant’s Personal Information with its Australian and overseas related bodies corporate, promotional partners, servants, employees, agents and trusted third parties who may contact the entrant for their legitimate commercial purposes. By entering the Promotion, entrants acknowledge and agree that the Promoter and any applicable third parties may use their Personal Information in the manner set out in this condition.
General
This Promotion is not available in conjunction with any other promotion or offer, and the Promoter reserves the right to disqualify any person from receiving the Gift Card if any of the following occurs:
If it suspects fraudulent activity; or
for a breach of these Terms and Conditions; or
if it decides the person has not acted in good faith; or
for any false or misleading conduct of any kind.
The Gift Card is not refundable, reloadable, transferable or exchangeable and cannot be taken as cash. Expired Gift Cards cannot be extended or replaced. If a Gift Card or receipt of it incurs a tax liability, the relevant recipient of the Gift Card is liable for payment of such tax.
Terms and Conditions of the individual gift card will be printed on the reward itself and/or be made available on the Gift Card Supplier's website. Check the Gift Card for usage instructions and expiry date.
The redemption website is operated and hosted by the Gift Card Supplier. The Promoter is not responsible for, or liable in respect of, products and services provided by the Gift Card Supplier.
The Promoter reserves the right in its sole discretion or subject to any written directions from a regulatory authority, to modify, suspend, terminate, withdraw, or cancel the Promotion at any time without notice. The Terms and Conditions may be varied at any time without notice.
The Promoter reserves the right to request that an Eligible Participant provides supporting documentary evidence of their identity (e.g. driver’s licence, passport, birth certificate). If the Eligible Participant fails to do so, or the Promoter determines the policy does not meet the eligibility criteria of the offer, the Eligible Participant will not be eligible for the Gift Card.
The Promoter (including their officers, employees and agents) will not be liable for any loss or damage whatsoever (including but not limited to direct or consequential loss) including any theft, unauthorised access, third party interference, any technical difficulties or equipment malfunction, or personal injury (including loss of opportunity) suffered or sustained in connection with the Promotion, or the receipt, acceptance, or use of the Gift Card (whether negligent or not), except for any liability that cannot be excluded by law.
The Promoter reserves the right to substitute the Gift Card with another incentive of the same value.
