Promotion Period The Promotion commences at 12:01am AEST on 18/07/2023 and closes at 11.59pm AEDT on 31/10/2023.

Maximum number of entries

Details of Prize Draw The draw will take place at 12:00pm AEDT on 02/11/2023 at 136 Cathedral St Woolloomooloo, NSW, 2011.
Winner The first valid entry drawn will win the Prize.
Notification and publication of winners
Winner will be notified in writing by email within 14 days of the draw.
The name of the winner and their state or territory of residence (and the address of the winner if from SA) will be published online at winwithethicalnutrients.com.au within 7 days of the draw for a minimum of 28 days (unless the winner requests that these details not be published).
If there is no prize winner or the prize winner cannot be located, this information will be published at winwithethicalnutrients.com.au.
Details of the Prize
The Digital Prepaid Mastercard prize will be issued to the winner’s mobile number, as provided in the online entry form.

Unclaimed prizes
Prize must be claimed by 2pm AEDT on 02/01/2024 (Prize Claim Date).
A second chance draw may be held on 15/01/2024 at the same time and place as the original draw to distribute any unclaimed Prize, subject to any directions from a regulatory authority.
Notification and publication details of unclaimed prize draw winner(s) (if any)
The winner of the second chance draw will be notified in writing by email within 14 business days of the unclaimed prize draw.
The name of the winner and their state or territory of residence (and the address of winner if from SA) will be published online at winwithethicalnutrients.com.au within 7 days of the draw for a minimum of 28 days (unless the winner requests that these details not be published).
Delivery of prize The winner should allow 28 days from the draw for Prize delivery.
Restriction on winner(s)
It is a condition of the Prize being awarded that the winner provide to the Promoter a clear copy of their original receipt or tax invoice as proof of a valid purchase to enter this Promotion. If any of the details in the purchase receipt or tax invoice for the purchase do not match the information received by the Promoter in accordance with these Terms, the entry may be invalid.

These Terms and Conditions include the matters in Details above (collectively, the Terms). Entrants are deemed to accept these Terms by participating in this Promotion. Entries must comply with these Terms to be valid.
Eligibility
Employees, directors and officers (and their immediate family members and members of their households) of the Promoter or of its subsidiaries or related companies, prize drawers and retailers or any agencies associated with the Promotion, are not eligible to participate in the Promotion.
Prize
The Prize is set out in the Details above. If the Prize becomes unavailable for any reason beyond the Promoter’s control, the Promoter may substitute the Prize with an item of equal or greater value, subject to any written directions from a regulatory authority.
Prize values are in Australian dollars.
Method of entry
Entries must be received by the Promoter during the Promotion Period. The Promotion Period may be varied or extended at the Promoter’s absolute discretion, to the extent permitted by law and subject to any approval required from a regulatory authority. Any entry received after the Promotion Period will not be accepted.
The Promoter does not accept any responsibility for inaccurate or incorrect information provided to the Promoter in connection with this Promotion. Entrants are responsible for notifying the Promoter of any changes to contact or mailing details they provide to the Promoter.
Verification
Entries that do not comply with these Terms are invalid and may not be accepted. If an entrant does not provide the Promoter with all the information requested on the entry form, the entry will be invalid.
The Promoter is not responsible for receipt of incomplete, damaged or illegible entries. All such entries may be deemed invalid (at the Promoter’s sole discretion).
Prize will only be awarded to the winner following any validation and verification that the Promoter requires in its sole discretion. If documentation requested by the Promoter is not received by the Promoter (or its nominated agent) or an entry has not been verified to the Promoter’s reasonable satisfaction within the time requested, that entrant’s entry will be invalid.
The Promoter may in its sole discretion, disqualify, any entrant:
in breach of these Terms;
who has provided false information or failed to provide information to the Promoter in accordance with these Terms;
who has submitted an entry which is not in accordance with these Terms;
if the Promoter has reason to believe the entrant:
is not the original entrant;
has (or appears to have) forged, manipulated, interfered or tampered with the Promotion;
has engaged in conduct that is fraudulent, unlawful, misleading or deceptive, or other conduct that interferes with the fair and proper conduct of the Promotion; or
does anything that may adversely affect the reputation of the Promoter or any of its related entities.
The use of any software or any other mechanical or electronic means that enables an entrant to automatically submit multiple entries is prohibited and will render all entries submitted from that source and by those entrants invalid.
Entrants consent to the Promoter using their name, image, likeness and voice in any media for an unlimited period without remuneration for publicity, commercial and promotional purposes.
Entries will not be returned to any entrant.
Notification and Prize Delivery
Subject to any unclaimed prize draw, if a winner does not redeem the Prize or any part of the Prize by the Prize Claim Date described in the Details, then the Prize or that part of the Prize will be forfeited and cash will not be awarded in place of that Prize or part of that Prize.
Prize will be delivered to Australian addresses only.
The Promoter is not responsible for any delays in delivery outside its control.
Liability
Nothing in these Terms excludes, limits or modifies, or purports to exclude, limit or modify any consumer rights (including statutory guarantees, implied warranties and conditions) under any statute, including but not limited to the Competition and Consumer Act 2010 (Cth), that may not be lawfully excluded, limited or modified by agreement. If in the conduct of this Promotion, the Promoter is liable for a breach of any such consumer right, the Promoter’s liability under that consumer right is limited, to the extent permitted by law, to the cost of replacement of any benefit or Prize won.
Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability for any personal injury, or any loss or damage, whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to that arising out of the following:
any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
acts or omissions of the Promoter’s employees, agents or third parties involved in the conduct of this Promotion;
any third party interference or unlawful act;
any loss or damage to any computer related to or resulting from participation in this Promotion, downloading any materials in connection with the Promotion or use of a Prize, including loss arising from a security breach, theft or destruction;
any conduct or event that is beyond the reasonable control of the Promoter;
any variation in the value of a Prize or the Prize Pool;
any tax liability incurred by an entrant; or
any receipt, taking, acceptance or use of a Prize.
Before a Prize is awarded, the winner may be required to sign an agreement to release the Promoter from any liability arising from the use of a Prize or participation in this Promotion.
The Promoter will have no responsibility for entries or other communications that are late, lost, delayed, misdirected, incomplete, illegible or incorrectly submitted. The Promoter will also have no responsibility for any failure to receive an entry or for inaccurate information as a result of technical or telecommunications problems, including security breaches.
If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated for any reason, the Promoter reserves the right, at its sole discretion to modify, suspend, terminate or cancel the Promotion (subject to any regulatory requirements or directions of regulatory authorities).
Failure by the Promoter to enforce any of its rights under these Terms or otherwise at any stage does not constitute a waiver of those rights.
Disputes
Any dispute relating to this Promotion must, prior to a person commencing proceedings, be dealt with as follows:
the affected person will notify the Promoter of the details of the dispute in writing and within 14 days of receiving this notice, the affected person and a representative of the Promoter will convene via an agreed medium to attempt to resolve the dispute;
if unresolved within 30 days after that meeting, the dispute will be escalated to a more senior manager of the Promoter not directly involved in the Promotion, who will investigate the dispute and convene via an agreed medium with the affected party to further attempt to resolve the dispute; and
if still unresolved within a further 14 days of being escalated, then the senior manager of the Promoter will make a decision in respect of the dispute.
Collection and use of personal information
The Promoter will collect personal information from entrants for the purposes of conducting this Promotion and for future promotional, marketing and publicity purposes, including to contact entrants to provide information about special offers or other marketing materials via any medium. Entrants consent to the collection, storage and use of their personal information for these purposes.
The Promoter may disclose personal information to:
its related companies and to third parties (including promotional partners, contractors and agents) within Australia for the purposes of conducting this Promotion; and
its related companies and promotional partners within Australia for promotional, marketing and publicity purposes who may use that personal information to provide information about special offers or other marketing materials to entrants via any medium.
By participating in this Promotion, entrants consent to the collection, storage, use and disclosure of their personal information by the Promoter in accordance with these Terms.
If personal information requested by the Promoter in the course of conducting this Promotion is not provided, the entrant may not be eligible to participate in the Promotion and/or the Promoter may not be able to provide the Prize.
Entrants may obtain access to, update, correct or require destruction of personal information held by the Promoter, make a complaint about a breach of privacy, or opt out of receiving any communications by contacting the Promoter at the address specified in the Details.

General
The entrant is solely responsible for:
any costs associated with entering the Promotion and making an entry, including accessing the Promotion website, are the responsibility of entrants;
all taxes (excluding GST) which may be payable as a consequence of receiving a Prize; and
all other incidental and ancillary costs including but not limited to insurance, taxes (excluding GST) and any and all other expenses.
Prize is not refundable, transferable or exchangeable and are not redeemable for cash (except where the Prize is specified to be cash).
These Terms are governed by the laws of the place set out in the Details, and where applicable, each of the relevant States/Territories.
