The Promotion
Information on how to enter and prizes form part of these Terms and Conditions.
Entry in the competition to win 1 of 6 $500 Booktopia Gift Certificates
(“the Promotion”) is deemed acceptance of these Terms and Conditions.
The Promotion commences at 12:01am AEDT, Wednesday 1 November 2023 and closes at 11:59pm AEDT, Monday 15 December 2023 (“Promotion Period”).
The Promotion is a game of chance.
Promoter’s Details
The Promotion is provided by Booktopia Pty Ltd ABN 24 096 845 126, Level 6, 1A Homebush Bay Drive, Rhodes NSW 2138 Australia (“the Promoter”).
These terms and conditions (including without limitation the information on how to enter, eligibility criteria and the prize giveaway details which we publish in relation to the Promotion) apply to the Promotion.
The terms and conditions below set out important information about the Promotion.
By participating in the Promotion you as an entrant (“Entrant”) agree to be bound by the Conditions. Entries must comply with the Conditions to be valid.
How to Enter
Order an eligible product at
www.booktopia.com.au during the Promotion Period.
You must create or log into your Booktopia account to order.
Entrants must provide an email address, phone number, name and address (all of which must be valid), in order for the Promoter to retrieve the entrant's Promotion entry.
Entry Eligibility
Entry is open to new and existing customers of Booktopia who order an eligible product from
www.booktopia.com.au during the identified Promotion Period to be delivered to an Australian delivery address, and:
are a resident of Australia;
the order is made from a Personal or Student account; and
the order includes a product (book, eReader, or stationery) featured in the Booktopia Christmas Gift Guide 2023 (eligible product), full list available at:
www.booktopia.com.au/promo3305.html.
Gift Certificates, Magazine Subscriptions, eBooks, eTexts and digital Audiobooks are not eligible products
Employees (and immediate family members) of the Promoter are ineligible to enter the competition.
Participants who are under the age of 18 must seek permission from their parent or guardian. If a winner is under 18 years of age, the prize will be awarded to the winner's parent or guardian.
The Promoter reserves the right to verify the validity of each entry. The Promoter reserves the right to disqualify any person found to be tampering with the entry process, providing fraudulent or misleading order details, or who otherwise does not comply with these Terms and Conditions.
Orders that are cancelled or refunded in full will be ineligible.
All valid orders must be received during the Promotion Period to enter the prize draw of the identified prize giveaway.

The Prize
The Promoter is offering entrants the chance to win 1 of 6 $500 Booktopia Gift Certificates.
Booktopia Gift Certificates are redeemable via the Booktopia website and do not have to be used in one transaction.
Prize Winners
There are six (6) prizes and there will be six (6) winners.
Date & Location of the draw
The prize draw for the Promotion will take place at Level 6, 1A Homebush Bay Drive, Rhodes NSW 2138 Australia
The prize draw for the Promotion will take place via random electronic draw at 11:00am on Monday 8th January 2024.
Draw determination
The valid entries that comply with Clause 4 will be randomly drawn from all valid entries received during the Promotion Period.
Notification of draw results
Within three (3) business days of the draw the Promoter will notify the winners of the Promotion by:
email, at the email registered with the Promoter;
telephone, at the telephone number registered with the Promoter;
publishing the winner’s name on the Booktopia website at
www.booktopia.com.au/news223.html.
The eligible prize winners will be asked to confirm their details/identity and following the eligible Winner’s Acceptance, the Prize will be delivered to the Winner via their Booktopia account, to the account registered with the Promoter and the same account used to place their entry order
If the winner is unable to be contacted or does not accept the prize within 60 days from the announcement date, a second chance redraw will take place on Wednesday, March 8th 2023.
Prize Details
The Promoter is not responsible thereafter for the manner in which the Booktopia Gift Certificates are redeemed.
Any ancillary costs associated with redeeming a Booktopia Gift Certificate are not included. Any unused balance of a Booktopia Gift Certificate will not be awarded as cash. The Promoter accepts no responsibility for any variation in prize value.
Replacement of prizes
If the prize becomes unavailable for reasons beyond the Promoter’s control, the Promoter may substitute a prize of equal or greater value, subject to any written directions from the various Authorities. The Prize Winners shall be notified accordingly.
Transferability of prizes
All prize giveaways are not transferable or exchangeable and cannot be taken in cash.
Decisions are final
The Promoter’s determination regarding the draw is final and binding on all elements. No correspondence will be entered between the Promoter and entrants. The Promoter accepts no responsibility for late, lost or misdirected entries or other communications. Entries will be deemed void if illegitimate, forged or manipulated or tampered in any way.
Promotion privacy
As a result of you entering the competition, we will collect certain personal information about you, such as your name, email address, and phone number.
By entering this Promotion, each Entrant is taken to consent to the Promoter using the Entrant’s personal information to administer the Promotion and disclosing the Entrant’s personal information to organisations that assist the Promoter with administering the Promotion to third parties as required by law.

Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)), or similar state-based consumer protection laws (Non-Excludable Guarantees).
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter and its related bodies corporate (including their respective officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity) whether direct, indirect, special or consequential, arising in any way:
out of the Promotion; or
out of: (i) any technical difficulties, equipment malfunction, any delayed email, any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, technical problems or traffic congestion on the internet or any website (whether or not under the Promoter or its related bodies corporates’ control); (ii) any theft, destruction, unauthorised access or third party interference of entries under this Promotion; (iii) any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter or its related bodies corporate; (iv) any tax liability incurred by a Prize Winner or Entrant; or (v) use of a Prize.
Variations
Subject to the approval of any relevant gaming authorities, the Promoter reserves the right at its sole discretion to modify, suspend or terminate all or part of the Promotion, or disqualify and prohibit further participation in this Promotion, in the event that any portion of this Promotion is compromised by a virus, bugs, non-authorised human intervention, fraud, hackers or other causes, including but not limited to war, terrorism, state of emergency or disaster (including natural disaster), beyond the reasonable control of the Promoter which, in the sole opinion of the Promoter, corrupts or impairs the administration, security, fairness, or proper conduct of the Promotion. Further, the Promoter at its sole discretion may recommence this promotion under the same conditions.
The Promoter reserves the right to update these Terms and Conditions from time to time in its sole discretion for administrative reasons or to ensure efficient operation of the Promotion. Changes will be posted on the Promoter’s website at

Failure by the Promoter to enforce any one of these Terms and Conditions in any instance(s) will not give rise to any claim or right of action by any Entrant or Prize Winner or other person.
The laws of the State where an Entrant is based apply to this Promotion.
